The Boston Birding Festival offers educational programs, bird walks, festivals, and other activities that may take place in public parks, conservation lands, urban spaces, trails, and other locations that are not owned, controlled, or managed by us.
Participation in outdoor activities involves inherent risks, including, but not, limited to, uneven terrain, weather conditions, wildlife encounters, insects, traffic hazards, water hazards, physical exertion, and other natural or human-caused conditions that may result in injury, illness, property damage, inconvenience, or other loss.
By participating in any program, event, bird walk, festival, or activity organized by Boston Birding Festival or by using maps, directions, resources, or information provided through our website, you acknowledge and accept these risks and agree to the following:
Assumption of Risk
You voluntarily assume all risks associated with participation in outdoor activities and understand that participation is entirely at your own discretion and responsibility.
Personal Responsibility
You are solely responsible for using your own judgment regarding your safety, preparedness, physical condition, and ability to participate safely in any activity.
You agree to exercise reasonable care for your own safety and for the safety of other participants.
No Guarantee of Conditions or Outcomes
We make reasonable efforts to provide accurate information, safe programming, and educational guidance; however, we do not guarantee:
- site conditions or trail conditions
- weather conditions
- wildlife or bird sightings
- accessibility of locations
- uninterrupted event schedules
- the completeness or accuracy of maps, directions, or third-party information
- current level of accessibility this location provides
All information provided is offered as a public service without warranties of any kind, express or implied.
Limitation of Liability
To the fullest extent permitted by law, Boston Birding Festival, and their directors, officers, employees, volunteers, contractors, partners, and affiliates shall not be liable for any accident, injury, illness, loss, damage, delay, inconvenience, or other claim arising from participation in any program or from reliance on information provided through our website or events.
Code of Conduct and Ethics
Participants agree to comply with our Code of Conduct and the American Birding Association (ABA) Birding Ethics Guidelines while participating in any program or event.
Advice and Guidance
Any suggestions, recommendations, or guidance provided by staff, volunteers, or program leaders are offered for general informational purposes only. Final decisions regarding safety, conduct, and participation remain solely the responsibility of each participant.
Severability
If any provision of this disclaimer is found to be unlawful, invalid, or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.
Duration
This waiver will be valid for one year from the date of signing.
