Spa & Hot Tub Service Maintenance Agreement
1. Parties
This Spa/Hot Tub Maintenance Agreement ("Agreement") is entered into between: Amish Heirlooms Furniture & Clear Lake Spas ("Service Provider"), and Client/Property Owner ("Client"). Collectively referred to as the "Parties."
2. Scope of Services
Service Provider agrees to perform spa and hot tub diagnostic, repair, and technical services, which may include but are not limited to:
• Diagnosing mechanical, electrical, or plumbing issues
• Repairing or replacing pumps, heaters, plumbing components, control boards, sensors, or other system parts
• Leak detection and repair when feasible
• Winterization or de-winterization services
• System testing following repairs
Unless selected, this Agreement does not include routine cleaning services, cosmetic restoration, or ongoing maintenance.
3. Client Responsibilities
The Client agrees to:
1. Provide safe and reasonable access to the spa/hot tub and equipment area.
2. Ensure electrical, plumbing, and structural elements meet basic safety requirements.
3. Disclose any known issues, prior repairs, or visible damage before service.
4. Understand that repair work may require draining the spa, disconnecting components, or temporarily disabling systems.
5. Limitation of Liability To the fullest extent permitted by Iowa and Minnesota law:
Client acknowledges that spa/hot tub repair involves interacting with aging equipment, electrical systems, plumbing, and components that may fail during or after service, even when handled properly. Service Provider is not responsible or liable for any damage to the spa/hot tub or surrounding property that arises from:
• Pre-existing equipment failure
• Brittle plumbing, worn seals, or aged components breaking during repair
• Electrical shorts, GFCI shutdowns, or wiring issues
• Structural defects or manufacturer flaws
• Water leaks or flooding caused by system failure
• Frozen plumbing, weather conditions, environmental issues
• Client acknowledges that working on failing, old, or compromised components can result in additional damage simply due to their condition. Service Provider shall not be liable for incidental, consequential, or indirect damages, including but not limited to:
• Loss of use
• Water damage or flooding
• Mold, rot, or structural damage
• Electrical system issues
• Personal injury related to spa/hot tub operation
4. Indemnification
The Client agrees to indemnify, defend, and hold harmless Service Provider, its employees, contractors, and representatives from any and all claims, demands, losses, damages, liability, or expenses (including attorney fees) arising out of or related to:
• The condition, age, installation, or prior repair history of the spa/hot tub
• Failure of any mechanical, electrical, or plumbing component during or after repair work
• Water loss, leaks, flooding, or structural damage resulting from component failure
• Injuries occurring in or around the spa/hot tub after repair
• Client’s use, misuse, or modification of the spa/hot tub following service
This indemnification applies under both Iowa and Minnesota law and survives termination of this Agreement.
5. No Warranty
Service Provider makes no warranties, express or implied, regarding:
• The condition or future performance of any repaired component
• Longevity of repairs or compatibility with aging systems
• Prevention of future leaks, electrical issues, or system failures
Client acknowledges that repair work on older or compromised spas/hot tubs may not fully resolve underlying issues and that one failed component may cause additional failures not related to Service Provider’s work. Any manufacturer warranties remain solely between the Client and the manufacturer.
6. Assumption of Risk
Client understands and agrees that spa/hot tub repair involves inherent risks, including but not limited to:
• Equipment failure caused by age, wear, or manufacturer defects
• Electrical malfunctions
• Plumbing breaks, leaks, or water damage
• Component failure during diagnostic testing or disassembly
Client voluntarily assumes all risks associated with repair work and the continued ownership and operation of the spa/hot tub.
7. Compliance with Law
This Agreement is governed by and construed primarily under Iowa law, with additional enforceability provisions applicable for services rendered in Minnesota. If any term is invalid under either jurisdiction, the remaining terms remain fully enforceable.
8. Term & Termination
This Agreement continues on a month-to-month basis unless otherwise stated. Either Party may terminate the Agreement with written notice. Any unpaid balance remains due immediately upon termination.

9. Entire Agreement
This document constitutes the full and complete Agreement between the Parties and supersedes all prior oral or written agreements.
10. Emergency Repair Waiver
Client understands that emergency or time-sensitive repairs—especially during freezing temperatures—may require expedited work that increases the risk of component failure. Client agrees that Service Provider is not liable for any additional damage that occurs during or after such emergency repairs, including frozen plumbing, leaks, electrical issues, or structural failure.
11. Access & Site Conditions
Client agrees to ensure safe and reasonable access to the spa/hot tub area. This includes removal of snow, ice, debris, pets, or hazards. Service Provider is not responsible for delays or damage caused by unsafe or obstructed access conditions. Client agrees that service areas may become wet or slippery during repair work and assumes all risks related to property conditions.
12. Photographic Documentation Permission
Client grants Service Provider permission to photograph the spa/hot tub and surrounding equipment before, during, and after service for documentation, liability protection, and internal records. Photos will not be used publicly without client approval.
13. Declined Repairs Liability Release
If Service Provider recommends a repair and the Client declines it, postpones it, or opts for a temporary workaround, the Client agrees that Service Provider is not responsible for any resulting damage, equipment failure, leaks, electrical issues, or additional repairs. The Client fully assumes the risk of operating the spa/hot tub with known issues.
14. Customer-Supplied Parts Disclaimer
If the Client provides parts or requests installation of non-manufacturer or third-party components:
• Service Provider makes no warranty regarding compatibility, reliability, or performance.
• Service Provider is not liable for failure of the customer-supplied part.
• Additional failures caused by the part are the sole responsibility of the Client.
15. No Guarantee of Leak Resolution
Client understands that spas/hot tubs contain plumbing runs, jets, gaskets, unions, and shell penetrations that may be inaccessible without full teardown. Service Provider does not guarantee that any leak will be completely resolved,
especially in older units or those with multiple simultaneous failures. Leak repairs may reveal additional leaks that were previously undetectable. Client agrees that Service Provider is not liable for unresolved or future leaks.
16. Draining & Refilling Liability Waiver
Some repairs require draining and refilling the spa/hot tub. Client agrees that Service Provider is not responsible for:
• Damage caused by water runoff or drainage
• Structural damage due to spa weight changes
• Damage from improper water chemistry after refill
• Heater or pump failure caused by airlocks or restarting aged systems
• Damage caused by municipal water quality, pressure, or contamination Client assumes all risks associated with draining or refilling.
17. Electrical Lockout/Tag-out Responsibility
Client agrees that any required electrical shutoff or lockout/tagout must comply with local code and must be provided by a licensed electrician when necessary. Service Provider is not responsible for electrical hazards, improper wiring,
inaccessible disconnects, breaker issues, or any electrical risks associated with the spa/hot tub.
18. Customer-Friendly Summary
This section is a simplified overview for clients and does not replace the full Agreement.
• What We Do: Diagnose and repair spas/hot tubs.
• What We Don’t Cover: Pre-existing issues, old or brittle parts breaking, leaks, electrical faults,frozen plumbing, cosmetic issues.
• What You Agree To: Allow access, disclose any known issues, understand repairs on older spas may trigger more failures.
• What We Are Not Liable For: Water damage, leaks, equipment failure, electrical issues, or any damage related to age or condition of the system.
