I acknowledge that swimming at ALVINE LYNNYARD is a recreational activity, and the use of the facilities and swimming pool, as well as my presence on the premises, are AQUATIC ACTIVITIES. All participants who visit Alvine Lynnyard must use common sense at our facility when encountering the features that we have provided for your enjoyment.

I acknowledge and confirm that my participation in aquatic activities is voluntary. I am in good health and suffer from no physical or mental condition that would make me especially susceptible to injury or disability while participating in aquatic activities.

I acknowledge that there are numerous inherent risks of injury from aquatic activities and includes, but is not limited to, the following: drowning, near-drowning, falling, concussion, fractures, heat stroke, other heat and cold injuries, over-use syndrome, injuries involving acts of God, and the potential for permanent paralysis and death. These activities include, but are not limited to, swimming, walking in water, heavy lifting, swimmers colliding, climbing into and out of the pool, participating in any action in the pool, tripping or falling over obstacles in the pool area. While rules, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist. There are natural and environmental conditions and risks associated with aquatic activities, which independently or in connection with my actions or the actions of others, may cause severe or even fatal injuries to me or others.

I acknowledge there is no lifeguard on duty, I am responsible for the safe operation of the pool.

I acknowledge that should I consume, provide alcohol and/or serve food to family, friends, guests, or third parties on property, I acknowledge that I am solely responsible for any and all damages suffered by myself or third parties as a result of said consumption to include, but not limited to, property damage, personal injury, death, disfigurement, or loss of consortium.

I understand that I may be asked permission to have my picture taken and if I agree, I hereby grant to Alvine Lynnyard all right, title and interest in any and all photographic images (the “Images”) that may be made during the Event. Alvine Lynnyard has the right to publish, by any method and in any media, the Images into its website, publications, brochures, social media sites or informational, educational, advertising, or promotional materials relating thereto (collectively, the “Works”). I agree Alvine Lynnyard is and shall be the exclusive owner of all right, title, and interest, including copyright, in the Images and the Works.

NO WEAPONS ALLOWED ON PREMISE!!!!

No ticketed events.

Guest count strictly enforced. Exceeding count can result in guests being asked to leave and a $150 fine.

Everyone must park on the street. Do not block driveways or mailboxes.

Please adhere to your reserved pool time.

Music, noise and voices should be kept at normal respectable levels (you may be asked to lower volume).

No nudity, sex, or lewd acts.

No unattended minors 18 and younger are allowed to use the pool. Adult(s) 21 over MUST present. One (1) adult for every ten (10) minors.

All small children (under 4ft) are REQUIRED to wear life jacket or arm floats.

No diving, horse play or running.

No climbing out the pool over the sides. Use the pool stairs.

No urinating, spitting or blowing nose in water.

No standing or sitting on the swim up bar.

No coal hookah (electric/battery operated only)

If you are sick or have any open wounds, you will not be allowed in the pool area.

Fire pit must be operated by management.

No pets allowed.

If using tanning oils, please use towels on furniture before sitting.

Clean up before leaving property. Put things back in their spot and leave space clean the way it was when you arrived.

Management reserves the right to revoke pool access and have guests removed at any time if any rules are broken.

I RELEASE AND HOLD HARMLESS ALVINE LYNNYARD

In consideration for the opportunity to participate in aquatic activities at Alvine Lynnyard, I (or the minor) agree to release, indemnify, and hold harmless Alvine Lynnyard from any and all responsibility and legal liability for any injury, damage, death, or loss of any kind which may result directly or indirectly from participation in aquatic activities or any other cause or claim arising from participation in aquatic activities, including, but not limited to, breach of contract and negligence. I AGREE TO RELEASE AND FOREVER DISCHARGE, INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASES FROM ALL CLAIMS, SUITS, COSTS, AND ATTORNEYS’ FEES FOR DAMAGE AND PERSONAL INJURY TO ME OR THE MINOR CHILD ON BEHALF OF WHOM I AM SIGNING, OR MINE OR THE MINOR’S PROPERTY, RESULTING FROM THE NEGLIGENT ACTS OR OMISSIONS OF THE RELEASED PARTIES DURING THIS RECREATIONAL ACTIVITY. I understand that this Agreement shall be binding upon my heirs, executors, administrators, and assigns, and shall be governed by the laws of the State of Tennessee with venue being proper in Davidson County, Tennessee. I also understand that if any part of this Agreement is determined to be unenforceable, all other parts shall be given full force and effect. I agree that there have been no warranties, expressed or implied, which have been made to me, which extend to all equipment used by Alvine Lynnyard.

I understand that permission to use Alvine Lynnyard’s, equipment, and premises is being given to the undersigned participant to exchange for the execution of this Agreement.

I have read and understand this Agreement and fully understand its terms. I acknowledge that this is a release of liability of all claims that arise out of my participation in this recreational activity, which I understand prevents me or anyone on my behalf or anyone on behalf of the minor child for whom I am signing, from filing suit or making any other claims of any kind for damage or loss sustained as a result of this recreational activity. I have made no representations to Alvine Lynnyard regarding my name, age, or physical or medical conditions that was untruthful or that would otherwise prevent me from engaging in this activity.

I HAVE CAREFULLY READ THIS AGREEMENT AND AGREE TO ITS TERMS, WHICH ARE FULLY BINDING UPON ME. I AM EIGHTEEN (18) YEARS OF AGE OR OLDER, AND I FREELY AND VOLUNTARILY ENTER THIS AGREEMENT ON BEHALF OF MYSELF AND MY MINOR UNDER EIGHTEEN (18).
