Heavy Equipment Rental Release of Liability Form

HEAVY EQUIPMENT RENTAL RELEASE OF LIABILITY

ASSUMPTION OF RISK

The Renter understands and acknowledges that operating heavy machinery and construction equipment involves inherent risks including, but not limited to:

• Property damage
• Serious bodily injury
• Death
• Equipment rollover
• Mechanical failure
• Flying debris
• Ground collapse
• Contact with underground utilities
• Accidents caused by improper operation

The Renter voluntarily assumes all risks associated with the operation, transportation, loading, unloading, and use of the rented equipment.

RELEASE OF LIABILITY

The Renter agrees to fully release, waive, discharge, and hold harmless Farmhouse Flips LLC, its owners, employees, agents, contractors, and affiliates from any and all liability, claims, demands, damages, injuries, losses, expenses, or causes of action arising out of or related to:

• Use or misuse of the equipment
• Mechanical breakdowns
• Property damage
• Personal injury
• Serious injury or death
• Theft or vandalism
• Transportation of the equipment
• Failure to follow safety procedures

Farmhouse Flips LLC shall not be held responsible for any injuries, accidents, damages, or death resulting from the use, operation, transportation, or possession of the equipment.

This release applies whether caused by negligence or otherwise, to the fullest extent permitted under North Carolina law.

Each person operating or working with the New Holland Track Loader must sign and date below before operating or working around the equipment.

DAMAGE & RETURN RESPONSIBILITY

The Renter agrees to be fully financially responsible for:

• Any damage to the equipment
• Tire or track damage
• Broken glass
• Hydraulic damage
• Undercarriage damage
• Improper fueling
• Negligent operation
• Rollovers
• Theft or vandalism occurring during rental period

The unit must be brought back in the same condition that it was originally picked up in, excluding normal wear and tear.

 

INDEMNIFICATION

The Renter agrees to indemnify and defend Farmhouse Flips LLC against all claims, lawsuits, attorney fees, damages, and liabilities resulting from the use or possession of the equipment during the rental period.

NO WARRANTIES

The equipment is rented “AS IS” without warranties or guarantees of any kind, either expressed or implied.

GOVERNING LAW

This Agreement shall be governed under the laws of the State of North Carolina.

ACKNOWLEDGEMENT

By signing below, the Renter acknowledges that they:

• Have read and understand this Agreement
• Understand the risks involved
• Voluntarily agree to all terms
• Understand this is a legally binding document
• Are at least 18 years of age, no one under the age of 18 is allowed in the skid loader
