**2027 Smokeout Cigar Festival Cruise & Excursion
Release of Liability, Assumption of Risk & Hold Harmless Agreement**
By booking or participating in the Smokeout Cigar Festival Cruise & Excursion (“Event”), you acknowledge, understand, and agree to the following terms:
1. Voluntary Participation
I understand that my participation in the Event—including all cruise activities, private parties, cigar‑related activities, excursions, transportation, and any optional add‑ons—is completely voluntary. I certify that I am physically and mentally able to participate.
2. Assumption of Risk
I acknowledge that participation in a cruise and cigar‑related event involves inherent risks, including but not limited to:
- Exposure to cigar smoke and related health risks
- Slips, trips, falls, or injuries aboard the ship or during excursions
- Motion sickness or adverse reactions to ship movement
- Weather‑related hazards
- Risks associated with alcohol consumption
- Risks associated with water activities, port visits, and third‑party excursions
I voluntarily assume all risks, whether known or unknown, associated with participation in the Event.
3. Release of Liability
To the fullest extent permitted by law, I hereby release, waive, and discharge:
SFX Travel, the Smokeout Cigar Festival organizers, event promoters, hosts, partners, vendors, volunteers, and representatives
from any and all claims, demands, damages, losses, injuries, or liabilities arising from or related to my participation in the Event, whether caused by negligence or otherwise.
This release includes, but is not limited to:
Personal injury or illness
Property damage or loss
Delays, changes, or cancellations by the cruise line
Issues arising from third‑party vendors, excursions, or transportation providers
4. Cruise Line Responsibility
I understand that Norwegian Cruise Line (NCL) is solely responsible for all cruise‑related operations, policies, safety procedures, and onboard services.
SFX Travel and the Event organizers are not responsible for:
Cruise line decisions, itinerary changes, or cancellations
Cabin assignments or shipboard incidents
Medical care or emergency services provided by the ship
5. Health & Medical Acknowledgment
I certify that I am solely responsible for managing my own health needs, medications, and medical conditions. I understand that cigar smoke exposure may aggravate certain medical conditions and that participation is at my own risk.
6. Alcohol & Substance Use
I acknowledge that alcohol may be served during the Event. I agree to drink responsibly and understand that I am solely responsible for my actions and any consequences resulting from alcohol consumption.
7. Photography & Media Release
I grant SFX Travel and the Event organizers permission to use photos, videos, or recordings of me taken during the Event for promotional or marketing purposes without compensation.
8. Financial Responsibility
I understand that all payments—including deposits, installments, and final balances—are subject to the Event’s stated payment schedule and cancellation policies.
I acknowledge that advertised cruise pricing may differ from NCL’s website due to private events, entertainment, and amenities included in the Event package.
9. Binding Agreement
I certify that I have read and fully understand this Release of Liability. I am signing/agreeing voluntarily and acknowledge that this agreement is binding upon me, my heirs, executors, and assigns.
By submitting my registration and/or payment, I acknowledge that I have agreed to this Release of Liability in full.
