  • EQUIPMENT PROVIDED

  • The following equipment ("Equipment") is made available for guest use during the rental period:
    • Two (2) Bicycles
    • Two (2) Electric Scooters
  • AGREEMENT AND WAIVER

  • By signing below, the undersigned Guest(s) ("Guest") agree to the following terms and conditions in consideration of being permitted to use the Equipment provided at the above-referenced vacation rental property.
  • 1. ASSUMPTION OF RISK

  • Guest acknowledges and agrees that the use of bicycles and electric scooters involves inherent risks, including but not limited to: falls, collisions, equipment malfunction, road hazards, traffic accidents, serious bodily injury, and death. Guest voluntarily and knowingly assumes all risks associated with the use of the Equipment.
  • 2. RELEASE OF LIABILITY

  • Guest hereby releases, waives, discharges, and covenants not to sue the property owner, their agents, employees, successors, and assigns (collectively, "Owner") from any and all liability, claims, demands, actions, or causes of action arising out of or relating to any loss, damage, or injury — including death — that may be sustained by Guest or any third
  • party in connection with the use of the Equipment, whether caused by the negligence of the Owner or otherwise.
  • 3. INDEMNIFICATION

  • Guest agrees to indemnify and hold harmless the Owner from any loss, liability, damage, cost, or expense (including reasonable attorney's fees) arising out of Guest's use of the Equipment, including but not limited to: property damage, personal injury to Guest or any third party, traffic violations, and any claims brought by third parties as a result of Guest's actions while using the Equipment.
  • 4. RESPONSIBILITY FOR LOSS OR DAMAGE TO EQUIPMENT

  • Guest accepts full financial responsibility for any and all loss, theft, damage, or destruction of the Equipment during the rental period, regardless of cause. This includes, but is not limited to:
    • Theft or loss of any bicycle or electric scooter
    • Damage resulting from accidents, misuse, or negligence
    • Damage to tires, frames, batteries, motors, or any components
    • Any damage caused by a third party while the Equipment is in Guest's custody
  • Guest agrees to reimburse the Owner for the full replacement or repair cost of any Equipment that is lost, stolen, or damaged during the rental period. The Owner reserves the right to charge the Guest's credit card on file or deduct the cost from the security deposit.
  • 5. RULES OF USE

  • Guest agrees to comply with the following rules at all times:
    1. All riders must wear a helmet at all times while operating the Equipment.
    2. Guest must comply with all applicable federal, state, and local laws, including Florida traffic laws and regulations governing bicycle and electric scooter use.
    3. Electric scooters must not be operated by anyone under the age of 16.
    4. The Equipment shall not be operated under the influence of alcohol or drugs.
    5. The Equipment shall not be loaned, rented, or otherwise provided to any person not listed as a guest on this agreement without prior written consent from the Owner.
    6. Electric scooters must be charged using only the provided charger and in the designated manner.
    7. Guest shall secure the Equipment with the provided locks when not in use.
    8. Guest shall immediately notify the Owner of any damage, malfunction, or loss of Equipment.
  • 6. CONDITION OF EQUIPMENT

  • Guest acknowledges that they have inspected the Equipment and accept it in its current condition. Any pre-existing damage should be noted below prior to use:
  • If no pre-existing damage is noted above, Guest acknowledges the Equipment was received in good working condition.
  • 7. FLORIDA LAW

  • This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the courts located in Okaloosa County, Florida.
  • 8. SEVERABILITY

  • If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
  • 9. ACKNOWLEDGMENT

  • By signing below, Guest acknowledges that:
    • They have read and fully understand this Agreement;
    • They are signing this Agreement freely and voluntarily;
    • They are 18 years of age or older (or the parent/legal guardian of any minor guests);
    • They understand this is a legally binding contract releasing the Owner from liability; and
    • They accept full financial responsibility for the Equipment during the rental period.
    • By signing, you accept liability for all guests in your party who use the Equipment, whether or not they have signed individually.
    • They agree to use the Equipment only during the dates they have indicated in the Intended Use Dates field of this agreement, and that any use outside of those dates is unauthorized and not permitted by the Owner.
