Legal Notice and Acceptance
This document is a legally binding agreement. Each attendee must complete this waiver using their full legal name.
By clicking or checking the “I AGREE” button(s) or box(es), you confirm that you have read, understood, and agreed to be legally bound by all terms of this Agreement. Please read thoroughly before signing.
Eligibility and Health
I certify that I am at least 21 years of age and in good physical and mental health to participate in this event. I understand my participation is voluntary and that I am solely responsible for assessing my personal health and ability to engage in event activities.
Private Event and Membership Requirement
I understand that Peach Pals is a private, invitation-only event not open to the general public. Attendance is restricted to individuals who are registered with Peach Pals, Inc. and included on the official email list.
All attendees must read, understand, and comply with this Assumption of Risk Agreement, Covenant Not to Sue, and General Release of Liability throughout the duration of the event.
Organizer Authority
Peach Pals, Inc., its agents, representatives, and volunteers reserve the right to limit, restrict, or revoke any participant’s ability to engage in some or all event activities, or to remove a participant entirely, at any time and for any reason, including violations of this Agreement or other event policies.
Definitions
- “Released Parties” includes all individuals and organizations identified in the section titled Exemption from Liability.
- “Premises” refers to the Host Venue, including any private residence, club, resort, event hall, or other location designated for Peach Pals activities, as well as adjacent or connected spaces such as parking lots, walkways, outbuildings, and event-specific areas.
- “Organizers” refers to Peach Pals, Inc., its board members, committee chairs, staff, volunteers, and agents.
Understandings and Assumed Risks
I confirm that I have prior knowledge of fisting practices and understand the health and safety risks involved, including potential transmission of sexually transmitted infections such as HIV, hepatitis A/B/C, syphilis, gonorrhea, chlamydia, and others. These risks may result in serious harm or death if untreated.
I understand that safer-sex practices are designed to reduce, but not eliminate, these risks and assume full responsibility for following such precautions
Equipment Use
I acknowledge that various equipment may be provided for my use during this event. I agree not to use any equipment with which I am unfamiliar unless I first receive proper instruction. I will inspect all equipment for safety prior to use and promptly report any hazards to the organizers.
Volunteer Cooperation
I understand that all participants, including myself, may serve as volunteers at Peach Pals events. I agree to follow all instructions from event staff, particularly from playroom monitors and safety personnel. In the event of a dispute, I agree to seek resolution through designated organizers.
Communicable Illnesses
I acknowledge the possibility of infection from communicable conditions such as COVID-19, Monkeypox, or Meningitis. I understand that vaccines may prevent or reduce such risks, and that CDC-recommended vaccination is strongly encouraged but not required at this time.
I release the Released Parties from any claim, injury, or damages arising from communicable illness as provided in the Assumption of Risk and Exemption from Liability sections.
Assumption of Risk
I acknowledge that all activities at Peach Pals events involve inherent dangers that cannot be fully eliminated. I voluntarily assume all risks, known and unknown, including but not limited to personal injury, emotional distress, infection, or death, whether caused by my actions, the actions of others, negligent instruction, the use of equipment, or the condition of the premises.
I assume full responsibility for any harm, loss, or injury sustained while participating in Peach Pals activities.
Exemption from Liability and Indemnification
I hereby release, discharge, and hold harmless Peach Pals, Inc., its affiliates, the Host Venue, and all Released Parties—including directors, officers, employees, volunteers, presenters, and fellow participants—from any and all claims, damages, liabilities, or demands arising out of or related to my participation, travel, lodging, or presence at Peach Pals events.
This release applies to any injury, illness, or loss, including those caused in whole or in part by negligence, gross negligence, or other acts.
I agree not to sue any Released Party, and I will indemnify and hold harmless each Released Party from any loss, cost, or legal expense (including attorney’s fees) resulting from any claim asserted by or through me.
Choice of Law and Venue
This Agreement shall be governed by the laws of the State of Georgia. Any dispute, claim, or legal action shall be brought exclusively in the City of Atlanta, County of Fulton, Georgia, which constitutes the principal place of business of Peach Pals, Inc.
Waiver of Rights
I understand that by signing this document, I am surrendering substantial legal rights, including rights of recovery under federal and state law. I acknowledge that this Agreement cannot be modified orally and shall be enforceable to the fullest extent allowed by law.
Certification
I certify that I am at least 21 years of age, legally competent, and voluntarily entering into this agreement. I have carefully read and fully understand this document and agree to be legally bound by it on behalf of myself, my heirs, executors, and assigns.
