MEMBERSHIP TERMS & CONDITIONS Please read before ticking the consent boxes below. 1. YOUR MEMBERSHIP. Begins on the Start Date in your application, once we accept it and receive your first payment. Must be 16+. Members aged 16-17 need a parent/guardian co-signature. 2. PLANS, FEES & PAYMENT. Plan 1 Flexi: $27/week ($54 fortnightly). No minimum term. 30 days written notice to cancel. $99 joining fee (waived for first 50 members). Rate may change with 90 days notice, max once per year. Plan 2 Lifestyle: $19.50/week ($39 fortnightly). 12-month minimum term. Rate locked. No joining fee. Plans 1 and 2 billed fortnightly via Stripe direct debit. All fees AUD, GST inclusive where applicable. Failed payments: retried within 3 business days, $15 dishonour fee per failed attempt, access may be suspended after 14 days overdue. 3. USING THE FACILITY. Check in every visit, don't share credentials. Athletic attire and footwear required, robes in spa areas. Children under 12 not permitted in gym/spa; 12-15 must be accompanied by member parent/guardian. No external personal trainers. We don't accept responsibility for personal property. 4. CANCELLATION & SUSPENSION. Plan 1: cancel anytime with 30 days written notice. Plan 2: no cancellation in minimum term except Permitted Grounds (permanent relocation 25km+ with proof, certified medical incapacity, or death). 30 days notice after minimum term. Suspension: all members may suspend up to 4 weeks per year free, submit in writing 7 days in advance. We may terminate without refund for material breach, abusive behaviour, false information, or fees 30+ days overdue. 5. HEALTH & SAFETY. You confirm your Pre-Activity Screening answers are true. If you answered Yes to any question, we may require medical clearance. Tell us if your health changes, you become pregnant, or you're injured. Use of the Facility carries inherent risks which you voluntarily assume to the extent permitted by law. 6. OUR LIABILITY. Our total liability is limited to fees you paid in the 12 months before the event giving rise to the claim. You release us from claims arising from your use of the Facility, except where caused by our negligence or wilful misconduct. Nothing here excludes your rights under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010). 7. PRIVACY. We collect your personal and health information to administer your membership and ensure your safety, in accordance with the Australian Privacy Principles. Health information not disclosed to third parties except emergency services, your practitioner with consent, or as required by law. Marketing emails/SMS only if you consent below; opt out anytime. 8. GENERAL. We may amend these terms with 30 days written notice; you may cancel without penalty during the notice period if you don't accept. Memberships are personal and non-transferable without consent. Disputes referred to mediation before tribunal/court. Governed by laws of Victoria, Australia.
