Responsible Pet Ownership & Non-Breeding Agreement Form

The purpose of this Agreement is to establish the conditions under which the animal is released from YMMARC into the care of the Adopter, in accordance with YMMARC's guidelines and the Animal Control and Responsible Pet Ownership requirements of the Regional Municipality of Wood Buffalo (RMWB), to ensure the humane treatment and welfare of the animal, and to prevent the breeding of animals placed through the YMM Animal Relocation Centre (YMMARC). This Agreement further establishes mandatory sterilization requirements as a condition of adoption in order to support animal welfare, reduce unwanted animal populations, and promote responsible pet ownership within the community.

This Agreement is made between the YMM Animal Relocation Centre (YMMARC), hereinafter referred to as “YMMARC” and the individual identified in the Adopter / Guardian Information section of this Agreement, hereinafter referred to as “the Adopter” or “the Guardian.”

The Adopter/Guardian confirms that all information provided in the Adopter/Guardian Information section and Animal Information section of this Agreement is true and complete to the best of their knowledge at the time of signing. The Adopter acknowledges that YMMARC relies on this information in determining eligibility for adoption and ongoing compliance.

The Guardian acknowledges that the following animal information is correct as provided by YMMARC at the time of adoption: Name, Species or Breed, Colour or Markings, Age or Date of Birth if known, and Microchip or Tattoo Identification number if applicable.

The Gaurdian agrees that the animal shall not be bred, mated, or intentionally used for reproduction under any circumstances. The Guardian further agrees to take all reasonable and necessary precautions to prevent accidental breeding and acknowledges that failure to do so may constitute a breach of this Agreement.

The Guardian agrees that the animal will be spayed or neutered by a licensed veterinarian within six to eight months of the adoption date unless the procedure has already been completed under YMMARC's care, or another licensed veterinarian prior to adoption. The Guardian further agrees that if a licensed veterinarian determines in writing that the procedure is not medically appropriate at the time, the procedure will be completed once medically cleared. The Guardian agrees to provide written veterinary confirmation of sterilization to the Shelter within fourteen days of the procedure being completed. The Adopter acknowledges that compliance with this requirement is a material condition of adoption and forms an essential term of this Agreement.

The Guardian agrees to provide the animal with appropriate and humane care at all times. This includes providing adequate nutrition and access to clean drinking water, socialization, maintaining safe, clean, and appropriate shelter and living conditions, ensuring routine veterinary care including vaccinations, parasite prevention, and wellness examinations, and providing prompt veterinary attention in the event of illness, injury, or distress. The Guardian acknowledges that failure to provide adequate caremay constitute neglect and a breach of this Agreement.

The Adopter agrees that if they are unable or unwilling to continue providing care for the animal, they will notify YMMARC and return the animal in accordance with YMMARC's direction. The Adopter further acknowledges that YMMARC may reclaim the animal at any time, without compensation, where permitted by law, including in cases of breach of this Agreement or concerns regarding animal welfare. At the time of return or surrender, the Adopter agrees that the animal must be sterilized unless already completed or medically deferred with written veterinary confirmation. The Adopter agrees to provide documentation verifying sterilization status or medical exemption. Where the animal has not been sterilized, the Adopter agrees that they are responsible for either the full cost of sterilization or a surrender fee determined by YMMARC based on species, size, and veterinary costs. The Adopter acknowledges that all fees must be settled or arranged at the time of surrender and that YMMARC reserves the right to refuse intake where permitted by law and operational capacity.

The Adopter agrees not to sell, assign, transfer, re-home, or otherwise dispose of the animal to any third party without prior written consent from YMMARC. Any unauthorized transfer shall constitute a material breach of this Agreement.

The Guardian assumes full responsibility for all costs, damages, liabilities, and veterinary expenses incurred during the period the animal is in their care. This includes any injuries, damages, or incidents involving third parties that are caused by or related to the animal while under the Guardian’s custody.

The Adopter acknowledges that any breach of this Agreement, including but not limited to unauthorized breeding, failure to comply with sterilization requirements, or unauthorized transfer of the animal, may result in YMMARC exercising its right to reclaim the animal where legally permitted. The Adopter further acknowledges that YMMARC may pursue any available remedies under applicable municipal, provincial, or federal law, including enforcement under Alberta legislation.

The Guardian acknowledges that they have read, understood, and voluntarily agree to all terms and conditions contained within this Agreement. The Guardian further acknowledges that this Agreement is binding upon acceptance of the adoption and continues for the lifetime of the animal unless otherwise terminated by YMMARC in accordance with applicable law.

The Guardian acknowledges that by signing below, they are entering into a legally binding agreement with the YMM Animal Relocation Centre (YMMARC) and that by adopting the animal, the adopter agrees to follow all conditions in this agreement.
