    A deed signs away your rights to the property PERMANENTLY. There is no such thing as a "temporary" deed. You cannot change your mind later without the new owner's signature.

  • Documentary Transfer Tax Information

    An LDA cannot determine your tax liabilities or choose tax exemption codes for you. To complete your deed, you must provide the exact tax details or exemption language below. If you do not know if your transfer is taxable or exempt, please review the official guidelines provided by your local County Recorder or consult a tax professional/attorney.

    Note: You can also search your specific county's website to view local tax rates and affidavit requirements. Contra Costa County provides a list of exemptions for your reference. 

  • Documentary transfer tax is paid on all transfers of property unless the transfer falls into an exception. There are a number of exceptions available, such as gifts, property divided in divorce, and transfers into or out of trusts or after an owner dies. Sales, debt forgiveness, or exchanges of most kinds are NOT exempt.

  • Computed on Value. Complete this even if you do not owe Documentary Transfer Tax. Generally your Documentary Transfer Tax is calculated based on the value of the property you are purchasing, but in situations where you are taking over a foreclosed home, you may be able to subtract existing mortgages and liens from this value.
  • Declaration of Exemption from Gov't Code § 27388.1 Fee (Building Homes and Jobs Act)This is a $75 fee that applies when Documentary Transfer Tax does not. It raises money for affordable housing programs. There are a few exemptions from this fee. Any document that pays Documentary Transfer Tax is exempt.In many cases without DTT, no exemption will apply to your transaction, but if one does, select it here. Not all transactions will qualify.
