4G Performance Liability Waiver

Participation in 4G Performance activities includes strenuous physical exercise, speed and agility training, strength and conditioning, sport-specific drills, contact instruction, competitive gameplay, and other athletic activities that involve inherent risks of injury. Participants understand that these activities may include physical contact, collisions, rapid changes in direction, jumping, tackling instruction, and high-intensity movement, all of which may result in injury. Potential injuries include, but are not limited to, sprains, strains, fractures, concussions, contusions, dislocations, heat-related illness, cardiac events, paralysis, and, in rare circumstances, serious injury or death. I acknowledge that not all risks can be known or anticipated in advance.

I acknowledge that participation in all 4G Performance activities is voluntary and undertaken at my own risk. If the participant is under the age of 18, I certify that a parent or legal guardian has reviewed and approved participation in these activities.

I HEREBY, for myself, my heirs, executors, administrators, assigns, and personal representatives (collectively “Releasor”), knowingly and voluntarily enter into this Waiver and Release of Liability and waive any and all rights, claims, or causes of action arising out of participation in any 4G Performance activity.

I HEREBY release and forever discharge 4G Performance, its owners, coaches, affiliates, managers, members, staff, volunteers, agents, representatives, successors, and assigns (collectively “Releasees”) from any and all liability for physical, emotional, or psychological injury, illness, damages, or losses that may occur as a direct or indirect result of participation in these activities.

I FURTHER AGREE to indemnify, defend, and hold harmless the Releasees against any and all claims, demands, damages, costs, expenses, or attorney fees arising from participation in 4G Performance activities by me or on my behalf.

I ACKNOWLEDGE that Releasees are not responsible for the acts, omissions, or failures of third parties conducting activities on behalf of 4G Performance. In the event of injury or medical emergency, I authorize 4G Performance staff to administer or obtain emergency medical treatment deemed necessary, including first aid, CPR, AED usage, emergency transportation, and the sharing of medical information with emergency personnel. I understand and agree that I am financially responsible for any medical costs incurred and acknowledge that I should maintain my own health insurance coverage.

I further agree to be responsible for any damage caused to equipment, facilities, or fields due to willful misconduct, negligence, or reckless behavior by myself, my family members, or guests. Both participant and 4G Performance agree that this Waiver and Release is intended to be as broad and inclusive as permitted by applicable law and shall be interpreted according to its plain meaning and intent.

I hereby grant the 4G Performance permission to use my likeness in a photograph, video, or other digital media ("photo") in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of the 4G Performance and will not be returned.

I hereby irrevocably authorize the 4G Performance to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

I hereby hold harmless, release, and forever discharge the 4G Performance from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
