By signing, participants understand and acknowledge the following terms and conditions and must be signed by all persons prior to using the Facilities at Camp Krietenstein.

RELEASE AND ASSUMPTION OF RISK:

I, on behalf of myself, my spouse, children, estate, heirs, executors, administrators, assigns, and personal representatives (hereinafter collectively referred to as the "Participant") hereby request permission from Camp Krietenstein, LLC ("Camp Krietenstein") to use the premises, building, equipment, tents, and other personal
property located thereon (collectively the "Facilities"). I understand that my presence at the Facilities and use of the personal property thereon is entirely at my sole risk. I assume full responsibility for any injuries or damages which may occur to me or be caused by me to any other person present at the Facilities or by reason of my use of the equipment therein at any time, now or in the future. By endorsing this Agreement, the Participant acknowledges the inherent perils of damage or injury linked to participation in the event or activities, including travel. The Participant willingly accepts all risks of loss, impairment, damage, or injury, including death, stemming from acts, omissions, negligence, or unintentional missteps by Camp Krietenstein, along with its owners, directors, managers, employees, volunteers, representatives, and agents) (collectively the "Indemnified Parties"). To the fullest extent permitted by law, the Participant agrees to release, hold harmless, and indemnify the Indemnified Parties from any claims, demands, actions, causes of action, lawsuits, expenses, or losses (including reasonable attorneys' fees and costs) asserted against any of the Indemnified Parties caused in whole or in part, by, or arising directly or indirectly from Participant's use of the Facilities at any time, participation at any event, and/or Participant's breach of this Waiver, Release and Indemnity. The Participant comprehends and acknowledges the inherent risks associated with activities at Camp Krietenstein, such as physical injuries (including but not limited to sprains and fractures from hiking, swimming, and sports), encounters with wildlife
and unpredictable weather, risks tied to recreational equipment and facilities, as well as environmental conditions like uneven terrain and water bodies. By using the Facilities at any time, the Participant embraces these risks, as in any endeavor involving fellow adventurers. I have been informed and acknowledge that Camp Krietenstein will not provide any supervision at or in connection with the event or use of the Facilities and I agree to use the equipment without any such supervision by Camp Krietenstein. I acknowledge that I have not requested or received any express or implied representations or warranties as to the use of the Facilities
by Camp Krietenstein. This agreement shall be governed by and enforced in accordance with the laws of the State of Indiana, and the agreed venue shall be the superior courts of Vigo County, Indiana. This agreement supersedes all prior agreements, understandings, negotiations, statements and promises, oral or written between the parties.

Medical Authorization:

The Participant consents, on his/her behalf and for any minor children under their guardianship, to permit any necessary medical treatment in the event of injury or illness while at Camp Krietenstein. They also agree to bear all costs associated with any rescue and/or medical services that may be incurred on behalf of Participant and for the minors in their care.

Photo and Video Authorization: The undersigned Participant hereby grants permission to Camp Krietenstein, its agents, and its employees the irrevocable and unrestricted right to produce photographs and video taken of my child, myself, and members of my family while at Camp Krietenstein for any lawful purpose including publication, promotion, illustration, advertising, trade, or historical archive in any manner or in any medium. I hereby release Camp Krientenstein and its legal representatives from liability for any violation or claims relating to said images or video. Furthermore, I grant permission to use the statements of my child, myself, or my family members given during an interview or evaluation with or without my name for the purpose of advertising and publicity without restriction to time limit or geographic area. I waive my right, my child's rights, and my family's rights to any and all compensation stemming from the use of these materials.

ACKNOWLEDGEMENT: By signing below, the Participant affirms that he/she has read and understands this document and the provisions of this agreement will continue in full force and effect even after the termination of any events and activities at the Facilities. The undersigned recognizes the significant risks entwined with utilizing Camp Krietenstein's Facilities. Such risks include, but are not limited to injuries from falls, equipment malfunctions, negligence by fellow participants, terrain hazards, wildlife encounters, exposure to outdoor elements, and accidents involving bodies of water. The individual understands that the aforementioned list does not exhaust all potential risks related to using Camp Krietenstein's facilities, and unforeseen risks may result in injury, illness, paralysis, or even death. The individual agrees to adhere to all rules and regulations of Camp Krietenstein and acknowledges that noncompliance may lead to removal from the Facilities without a refund. If the Participant is under eighteen (18) years of age (a "Minor") then a parent or guardian of the Minor must first consent in writing to the Minor's use of the Facilities by the execution of this Agreement. This is to certify that I, as parent with legal responsibility for this Minor, do hereby consent and agree to such Minor's execution of this Waiver, Release and Indemnity, and I, for myself and on behalf of such Minor, agree to be bound by all terms and conditions contained herein.
