TRIVUX FITNESS — RELEASE OF LIABILITY AND ASSUMPTION OF RISK Parent or Legal Guardian Acknowledgment — Elite Summer Performance I am the parent or legal guardian of the minor athlete I am registering ("the Athlete") for Trivux Fitness's Elite Summer Performance program ("the Program"). I am signing this Release on the Athlete's behalf and on my own behalf. 1. NATURE OF THE PROGRAM. The Program is an indoor youth athletic development program operated by Trivux Fitness LLC at 2555 N Forsyth Rd, Suite C, Orlando, FL 32807. Training includes sprinting, change-of-direction drills, plyometrics, resistance training, soccer-specific conditioning, medicine ball and dumbbell work, agility drills, and contact with athletic equipment. Sessions are coached by Ricardo and run Monday/Wednesday/Friday, 9:00 to 11:00 AM, in week-long blocks. The Athlete may participate in any individual weeks and is not committed to any minimum number of weeks. 2. ASSUMPTION OF INHERENT RISKS. I understand that participation in athletic training carries INHERENT RISKS that cannot be eliminated regardless of the level of care taken. These risks include but are not limited to: strains, sprains, fractures, dislocations, and other musculoskeletal injuries; cuts, bruises, abrasions; heat-related illness, dehydration, exhaustion, or fainting; cardiac, respiratory, or neurological events brought on by physical exertion; injuries from collisions with other athletes during drills; equipment failure or misuse; permanent disability and, in rare cases, death. I voluntarily accept these inherent risks for the Athlete and for myself as observer. 3. STATUTORY NOTICE — REQUIRED BY FLORIDA LAW - NOTICE TO THE PARENT OR GUARDIAN OF MINOR CHILD: YOUR CHILD IS PARTICIPATING IN A SPORTS OR RECREATIONAL ACTIVITY THAT MAY INVOLVE BOTH INHERENT RISKS AND RISKS NOT INHERENT IN THE ACTIVITY. THIS WAIVER OR RELEASE OF LIABILITY APPLIES ONLY TO THE INHERENT RISKS OF THE ACTIVITY. INHERENT RISKS ARE THOSE THAT EXIST BECAUSE OF THE NATURE OF THE ACTIVITY AND THAT CANNOT BE ELIMINATED REGARDLESS OF ALL REASONABLE CARE. BY SIGNING THIS DOCUMENT, YOU ARE WAIVING YOUR CHILD'S RIGHT TO RECOVER FROM TRIVUX FITNESS LLC AS A RESULT OF ANY INJURY YOUR CHILD MAY SUSTAIN DUE TO THE INHERENT RISKS OF THE ACTIVITY. 4. RELEASE AND WAIVER. In consideration of being permitted to enroll the Athlete in the Program, I hereby RELEASE, WAIVE, and DISCHARGE Trivux Fitness LLC, its owners (Sebastian Velez and Ricardo), employees, contractors, agents, and assigns from any and all liability, claims, demands, actions, and causes of action arising out of the INHERENT RISKS of the Program. This release does NOT apply to injury caused by gross negligence, intentional misconduct, willful disregard of safety; failure to supervise to a reasonable standard; use of defective equipment Trivux Fitness knew or should have known was unsafe; or conduct outside the scope of normal athletic instruction. Florida law does not permit a parent to waive a minor's claim against a provider's own negligence, and this waiver does not attempt to do so. 5. MEDICAL ACKNOWLEDGMENT. I represent that the Athlete is in good physical condition with no medical condition that would prevent safe participation. I have disclosed any known conditions in the intake fields above. I authorize Trivux Fitness to obtain emergency medical care for the Athlete if necessary, and I agree to be responsible for any costs not covered by my insurance. 6. CODE OF CONDUCT. The Athlete will arrive on time in appropriate athletic attire; treat Coach Ricardo, staff, and other athletes with respect; follow all safety instructions; and refrain from conduct that endangers others. Trivux Fitness reserves the right to dismiss the Athlete from the Program without refund for serious or repeated violations. 7. REFUND AND CANCELLATION POLICY. Each week is a separate registration. Cancellation more than 7 days before a registered week: full refund. Cancellation 3 to 7 days before: 50 percent refund. Cancellation less than 3 days before, or no-show: no refund. Medical cancellation with documentation: full refund credit toward a future week. 8. GOVERNING LAW. This Release is governed by Florida law. Disputes shall be brought exclusively in courts located in Orange County, Florida. 9. ACKNOWLEDGMENT. By signing below I confirm: I am the parent or legal guardian of the Athlete and have legal authority to sign on the Athlete's behalf; I have read and understand the entire Release; I sign voluntarily; I understand my electronic signature has the same legal force as a handwritten signature.
