Haul In, Rider, Equine Event Release Agreement

 

1. ACKNOWLEDGEMENT OF RISK
   In consideration of the privilege of riding, using and enjoying a horse on the premises or participating in events of Stable Waters, I understand and acknowledge that all equestrian related activities are inherently dangerous, that accidents involving horses are frequent and involve risks which may result in serious injury, permanent disability, death, or property damage, that the condition of the land is often hazardous, and that the ring or arena footing is rarely perfect.
   
   
2. ASSUMPTION OF RISK
   I knowingly and freely assume all risks, and undertake full responsibility for any loss or damage or injury incurred by self, rider, bystander or spectator, or participating child or legal ward arising out of or in connection with Stable Waters events, or with the riding, using or enjoying of a horse on the premises of Stable Waters.
   
   
3. LIABILITY, INSURANCE, AND HOLD HARMLESS
   
   
   1. Rider agrees to hold Stable Waters harmless its employees, volunteers, agents, or affiliates from any and all liability, claims, demands, damages, actions, causes of action, costs and disbursements, including but not limited to all legal fees and expenses incurred by Stable Waters in defense of such claims or expenses arising out of any injury, death, or property damage resulting from participation in connection with Stable Waters events, or the riding, using or enjoying of a horse on Stable Waters property, including those caused by negligence to the fullest extent permitted by law.
      
      
   2. Stable Waters shall not be liable for any sickness, disease, theft, death, or injury suffered by any horse while on the premises. All risks relating to horses are borne by Rider and/or the horse owner.
      
      
   3. Stable Waters is not rendered liable for any theft or damage to Rider's personal property. It is the responsibility of each Rider to insure horses & personal possessions as Stable Waters will not insure nor be responsible for horses or personal possessions, regardless of the cause of the loss or damage. Owner consents to make no claim and expressly waives any and all claims against Stable Waters on behalf of any loss or damage to personal property caused on the premises.
      
      
4. HORSE HEALTH, SAFETY, AND VETERINARY REQUIREMENTS
   
   
   1. Rider shall promptly notify Stable Waters Management in writing of any conditions that require attention or repair, or that are dangerous to the health or safety of horses, persons, or the property.
      
      
   2. Horses brought onto Stable Waters property for open riding, clinics, or other equine events must meet the same health and vaccination requirements as boarding horses: proof of current tetanus, sleeping sickness, and influenza vaccinations is required.
      
      
   3. A negative current Coggins test is required for all haul in horses on the grounds.
      
      
   4. All males must be gelded, unless approved by management.
      
      
5. MEDICAL AUTHORIZATION
   In the event of an emergency, I authorize Stable Waters to obtain emergency medical treatment for me if I am unable to do so myself. I understand I am solely responsible for all medical costs incurred.
   
   
6. DISPUTE RESOLUTION
   In the event of any dispute or disagreement relating in any manner to this Agreement, the parties agree to engage in mediation in a good faith effort to resolve the dispute amicably before resorting to court action. Contractor agrees to pay all court costs and attorney's fees incurred by Stable Waters in enforcing any of its rights under this Agreement.
   
   
7. TERMINATION
   Stable Waters may terminate this Agreement immediately, without notice, for any material breach of the conduct, property, or safety rules described in this Agreement, including violations of the Stable Waters Conduct & Property Rules, which is incorporated herein by reference.
   
   
8. MISCELLANEOUS PROVISIONS
   
   
   1. ENTIRE AGREEMENT: This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior oral or written negotiations or agreements.
      
      
   2. GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of the State of South Dakota.
      
      
   3. STABLE WATERS CONDUCT & PROPERTY RULES: Rider agrees to abide by all rules and regulations set forth in the Stable Waters Conduct & Property Rules, which is incorporated into this Agreement by reference. Any violation of those rules is also a violation of this Agreement.
      
      
   4. SEVERABILITY: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

 

This Agreement shall be effective for one (1) calendar year, unless earlier terminated as provided herein.

Current Coggins will be required for all horses on grounds

Riding Fee must be paid prior to or upon arrival of event

 tax + additional 3% charge will be added for Venmo & credit cards

 

• No Smoking Smoking is strictly prohibited on all Stable Waters property. Rider is responsible for ensuring compliance by their clients and guests.
• Rider(s) and/or guests may not have any additional animal(s) on the property, at any time, for any reason unless approved by Management in writing.
  
  
• Clean up after your horse and yourself
  • Garbage is to be properly discarded. Personal items or trash left inappropriately on Stable Waters grounds may result in a fee assessed to Rider.
  • Manure should be placed in provided wheelbarrows or bins around arena and barn.
    
    
• Be courteous and friendly to other riders, Stable Waters boarders, guests, & staff personnel. Riders and guests shall at all times act in a respectful manner toward other boarders, management, vendors, and guests on Stable Waters property. Foul language, intimidation, threats, harassment, or any similar conduct is not tolerated.
  
  
• Use your horse in a safe and humane manner
  
  
• Be respectable to others’ property
  
  
• No alcoholic beverages
  
  
• No illegal activity on or near the premises, including but not limited to drug-related activity, violence, or unauthorized use of firearms.
  
  
• All children under 18 must have guardian present
  
  
• All riders must sign a release form before riding
  
  
• No horses are to be turned out loose or free lunged
  
  
• Open riders are NOT permitted in the barn or pastures without permission of management. Please stay off lawn areas, including grass fields/pastures north & north-west of arena.
  
  
• Return ALL equipment to the North East Corner of the Arena (Barrels, Poles, etc…)
  
  
• Always enter Stable Waters arena grounds using the back entrance off of 169th Street (the gravel road just north of Schuchard Rd). *see website www.stablewaters.com/event-parking for a map
  
  
• Parking: please park on the back gravel lot & take care as not to block guests in or block entrances/exits.
  
  
• All riders, vehicles, & trailers must be off the grounds 30 minutes after the end time of open riding unless otherwise approved by management

PLEASE NOTE: Stable Waters also hosts guest stays, cooperate retreats, other private gatherings, and is a stable home for many resident horses and their owners. You are responsible for the actions of their guests/spectators. Riders and their guests are to act in such a manner that other riders & guests on the Stable Waters property are not disturbed.

Stable Waters is not responsible for accidents or injuries to individuals or horses, theft, loss or damage to personal property.

It is the responsibility of each rider to be aware of and obey these policies. Failure to comply makes rider(s) subject to immediate removal from Stable Waters property.
