OUTBACK RANCH, INC. PARTICIPANT AGREEMENT, ASSUMPTION OF RISK, RELEASE OF
LIABILITY AND INDEMNITY AGREEMENT. INCLUDING MOTOR VEHICLE (UTV/ATV) AND
EQUINE ACTIVITIES

READ CAREFULLY, THIS IS A LEGALLY BINDING AGREEMENT. YOU ARE WAIVING IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE

1. Participant Information: In consideration for being allowed to enter, remain on, and/or participate in activities at Outback Ranch, Inc. (OBR) I agree to the following:

Covered Activities: This agreement applies to all activities conducted on the premises, including but not limited to: Campground use and general recreational activities, Attendance at events, weddings, camping and gatherings, Operation or occupancy (driver or passenger) of UTVs, ATVs, golf carts, or similar motorized vehicles, and Horseback riding, equine interaction, and related activities.

 

3. Inherent Risks (Important): I understand and acknowledge that the above activities involve INHERENT RISKS, including but not limited to: Motorized Vehicles (ATV/UTV) (Rollover accidents, collision, loss of control, uneven terrain, weather-related hazards, mechanical failure, operator error, passenger movement, and passenger ejection.) Equine Activities (Horses may behave unpredictable, including kicking, biting, bolting, or bucking.) Premises Hazards (Natural terrain, obstacles, weather conditions, and other environmental factors.) 

I acknowledge that these risks can result in: SERIOUS INJURY, PERMANENT DISABILITY, OR DEATH

4. Controlled Use of UTV’s/ATV’s: I understand and agree that UTV’s and similar vehicles are operational equipment used and controlled by OBR; I will not operate any motorized vehicle unless expressly authorized. Any use will occur only on private land, within designated areas, and under established rules and supervision. I agree to follow all instructions from staff, remain seated and use the safety features provided, and comply with all safety restrictions and guidelines.

 

5. Assumption of Risk: I voluntarily assume all risks, whether known or unknown, including those arising from my participation or presence, the actions of other guests or participants, the condition of equipment or property, and the negligence of Outback Ranch or its staff.

 

6. Release of Liability (Including Negligence): To the fullest extent permitted by Minnesota Law, I agree to release, waive, and discharge Outback Ranch Inc., Leonard & Holly Wieser, and all employees, agents, volunteers, and affiliates (“releasees”), from any and all claims arising out of or related to use of occupancy of UTV’s or other motorized vehicles, participation in equine or recreational activities, and presence on any part of the property. Including claims arising from the negligence of the releasees.

7. Indemnification: I agree to defend, indemnify, and hold harmless the releasees from any claims, demands, lawsuits, damages, costs, and attorney fees arising from my conduct or participation, my failure to follow rules, and claims brought on my behalf or connected to my presence.

 

8. Participant responsibilities (Very Important for UW’s): I agree to follow all posted and verbal safety rules, not to engage in reckless or unsafe behavior, to immediately stop participation if directed, and to inform staff of unsafe conditions.

 

9. Minor Participants: If signing on behalf of a minor I certify that I am the parent/legal guardian and I authorize participation. I agree to assume all risks on behalf of the minor and release and indemnify OBR from any claims involving the minor.

 

10. Medical Authorization: I authorize OBR to obtain emergency medical treatment if needed and agree to be financially responsible.

 

11. Media Release: I grant permission for OBR to use photographs or video for business purposes.

 

12. Governing Law: This agreement shall be governed by the laws of the State of Minnesota.

 

13. Severability: If any portion is found unenforceable, the remainder remains in effect.

Final Acknowledgment: I have read and understand this agreement. I understand I am waiving significant legal rights. I sign this agreement voluntarily.

Attach a Copy of their Certificate of Insurance & Driver's Lic. Insurance must include Recreational Vehicle Liability & list Outback Ranch, Inc & Leonard & Holly Wieser as an Additional Insured.
