Binding Contractual Agrreement between signing party and Blue Egg Images
General terms:
1. THE CLIENT and/or PHOTOGRAPHY SUBJECT SHALL ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH THIS EVENT, on location or in studio including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
2. The Client and/or minor of Client agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Due to the limited and subjective nature of the event, the Photographer cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or location restrictions. The Photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the clients or other principles. The Photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decorations of the location.
3. The client will in no way alter the final image received, no filters added, no further editing and they must stay in their original form delivered to you. Additional editing can be requested and priced as such. Blue Egg Images is not responsible for clients inability to properly download package digital files. Blue Egg Images does not perform printing of and kind and is not responsible for outside print vendor quality and pricing.
4.The Photographer may include the images in any portfolio whether in a print or digital format and used to promote Photographers’ Services, including placement on Photographers website or social media sites. Photographer shall have no other right to exploit the images for any other purpose without the written consent of the Client.
5.Robyn Aylward will be photographing your event/session unless there is an unforeseen circumstance or emergency that arises. I will do my very best to have a qualified photographer there to replace me in such instance. If that is not possible you will receive a full refund of down payment/deposit and any money paid to the balance.
6.The Client is to agree to Blue Egg Images (a.k.a Robyn Aylward’s) branding and photographic style upon consent of this contract. The photographer shall be granted complete artist license including in relation to the poses photographed and the locations used as well as the post production editing styles and output. The photographer’s judgment regarding the location poses and number of images taken that shall be considered proofs. Due to variances in weather and temperature and the willingness of subjects it may not be possible to capture the images requested.
7. If the Photographer or its assigns cannot perform this Agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client, less retainer fee and expenses, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.
The Photographer keeps all the copyright of ALL photographs/digital images. Digital Images may only be re-sized. They may not be altered in any other
8) There will be no cell phone photos taken by the client or guest(s) of the event during the actual photography session. If cell phone photos are taken it will result in the forfeit of full payment to Blue Egg Images and the loss of all images taken by Blue Egg Images.
