  • 1. Agreement Overview

  • This Purchase Agreement and Service Terms document ("Agreement") is entered into between Cutting Edge Aerials LLC, doing business as Cutting Edge Property Watch ("Company," "we," "us," or "our") and the purchasing client ("Client," "you," or "your"). By signing, paying an invoice, scheduling service, approving a proposal, or accepting delivered services, Client agrees to this Agreement.
  • Company provides visual property documentation, aerial video, aerial photography, exterior property monitoring, and optional guest welcome bag services. Services are intended for informational, marketing, monitoring, and visual documentation purposes only.
  • 2. Services and Starting Prices

  • 3. Property Documentation Package

  • This Agreement applies to the Client named below and governs all services provided by Cutting Edge Aerials LLC, doing business as Cutting Edge Property Watch, to Client unless replaced or modified by a later written agreement signed or approved by both parties.

    This Agreement may apply to multiple properties owned, managed, represented, or authorized by Client, including current and future properties for which Client requests services.

    Client represents that they have ownership, management authority, or legal authorization to request services for any property submitted to Company for documentation, monitoring, welcome bag service, or related services.

    Future services requested by Client may be governed by this Agreement together with any applicable invoice, estimate, proposal, work order, service description, or written pricing approval provided for that specific service.

    Each future service may be subject to separate pricing, scheduling, availability, property access requirements, complexity modifiers, and service-specific terms.

    If there is a conflict between this Agreement and a later written invoice, estimate, proposal, or service authorization, the more specific written terms for that service shall control only for that specific service.

  • 4. Property Documentation Package

  • The Property Documentation Package starts at $199. Final pricing may increase based on property size, location, complexity, number of structures, waterfront features, requested deliverables, travel, urgency, access limitations, or other project-specific factors.
    • Exterior aerial video documentation
    • Exterior aerial photo documentation (as requested)
    • Date and time-stamped video and/or photo files when available
    • General visual documentation of accessible exterior property areas
    • Digital delivery of files
    • Use for property records, owner updates, pre-storm documentation, purchase documentation, or general property monitoring
  • 5. Annual Monitoring Membership

  • The Annual Monitoring Membership starts at $249 per year. Membership benefits are intended to help clients maintain updated visual property records and receive priority scheduling after storms when service is safe, legal, and operationally possible.
    • (One) Yearly updated video documentation via digital delivery
    • 25% off additional on-demand videos
    • Priority scheduling post-storm, when safe, legal, and operationally possible
  • Client understands that annual membership pricing is based on the selected property, service area, property size, complexity, and requested deliverables. Additional fees may apply for larger properties, waterfront properties, multi-structure properties, commercial sites, rush requests, additional videos, special requests, travel, or post-storm demand.

    Unless otherwise stated in writing, annual memberships are billed once per year and are valid for twelve (12) months from the date of purchase or activation.

    Annual memberships do not automatically renew. Renewal requires Client approval before a new annual membership term begins.

    Company may contact Client before the membership expiration date to offer renewal. Client is under no obligation to renew. If Client chooses to renew, the renewal rate, services included, and any updated terms must be approved by Client before the renewal takes effect.

    Annual memberships do not guarantee immediate service, emergency response, post-storm access, access to restricted areas, or service completion during unsafe, restricted, or legally prohibited conditions.

    Priority scheduling means Company will make reasonable efforts to prioritize Client’s service request when conditions allow. Service is always subject to FAA regulations, weather, safety conditions, property access, operator availability, and local restrictions.

  • 6. Complexity Modifiers and Price Adjustments

  • Advertised prices are starting prices or suggested prices unless clearly stated otherwise. Pricing may increase based on factors including but not limited to:
    • Large properties, waterfront properties, luxury homes, multi-structure properties, condos, townhomes, commercial sites, or construction sites
    • Difficult access points, tight flight areas, nearby obstacles, complex rooflines, seawalls, docks, pools, boats, or exterior features
    • Special client requests, additional videos/photos, rush scheduling, travel distance, post-storm demand, FAA limitations, weather limitations, or access issues
    Company will make reasonable efforts to communicate any price adjustments before service begins.
  • 7. Not an Inspection

  • Client understands and agrees that Company provides visual documentation and property monitoring services only. Company is not acting as a licensed home inspector, building inspector, roof inspector, engineer, structural evaluator, contractor, public adjuster, insurance company representative, legal advisor, mold/moisture/electrical/plumbing/pest inspection provider, or other licensed inspection professional.Company does not certify property condition, guarantee detection of damage or defects, identify hidden/internal/structural/inaccessible conditions, provide engineering opinions, provide repair estimates, determine cause of damage, determine insurance coverage, negotiate or assist with insurance claims, or guarantee insurance claim acceptance, approval, or payout.
  • 8. No Guarantee of Insurance Acceptance or Claim Outcome

  • Documentation may be useful for personal records, owner updates, property monitoring, or pre/post-storm visual comparison. However, Company makes no guarantee that an insurance carrier will accept the documentation, that documentation will affect claim approval or claim value, or that documentation will satisfy any insurance requirement. Client is responsible for consulting their insurance carrier, attorney, licensed inspector, contractor, engineer, or other qualified professional when needed.
  • 9. Weather, FAA, Safety, and Operational Limitations

  • Drone operations and property documentation services are subject to safety, legal, and operational limitations. Services may be delayed, rescheduled, modified, limited, or canceled due to FAA restrictions, temporary flight restrictions, airport or airspace limitations, unsafe weather, high winds, rain, lightning, low visibility, equipment issues, property access limitations, emergency conditions, post-storm restrictions, safety concerns, or operator discretion.Priority scheduling means Company will make reasonable efforts to prioritize Client when service is safe, legal, and operationally possible. It does not guarantee immediate service.
  • 10. Property Access and Client Authorization

  • Client represents that they own the property or have legal authority from the property owner to request services. Client grants Company permission to access exterior areas of the property as reasonably necessary to complete purchased services.

  • Company will not enter interior spaces, locked areas, gated areas, private units, or restricted areas unless specifically authorized in writing and agreed to by Company. Client is responsible for providing access instructions and communicating hazards, occupancy, pets, gates, security, tenant/guest issues, or restrictions in advance.
  • 11. Client Responsibilities

    • Provide accurate property information and access instructions
    • Confirm legal authority for requested services
    • Communicate hazards, restrictions, or special circumstances in advance
    • Review delivered files promptly
    • Download and store copies of delivered files before links expire
    • Use documentation responsibly and within the limits of this Agreement
    • Not represent Company work as an inspection, engineering report, insurance report, public adjusting service, or claim evaluation
  • 12. File Delivery, 90-Day Link Access, and Storage

  • Company generally delivers files digitally through a cloud-based link, shared folder, email, or other digital delivery method. Delivery may include edited videos, raw or lightly edited video clips, photos, time-stamped files when available, organized folders, or basic visual summaries when included in the package.
  • Unless otherwise stated in writing, digital delivery links and/or shared folders are intended to remain available for up to 90 days from the date of delivery. After 90 days, links may expire, files may be removed from active storage, and Company does not guarantee continued availability.
  • Client is responsible for downloading, backing up, and maintaining their own copies of all delivered files before the 90-day access period expires. Company may retain copies for internal archival, business, marketing, legal, or quality-control purposes, but does not guarantee indefinite storage or future retrieval unless separately agreed in writing.
  • 13. Media Rights and Intellectual Property

  • All media captured by Company remains the intellectual property of Company unless otherwise agreed in writing. Client receives a limited, non-exclusive, non-transferable license to use delivered media for personal property records, owner updates, property monitoring, insurance documentation support, rental/property management communication, and approved real estate or rental-related use.
  • Client may not resell, redistribute, sublicense, or commercially repurpose Company media outside the intended use without written permission. Company may use selected media for portfolio, marketing, website, social media, internal training, or promotional purposes unless Client requests otherwise in writing before service begins.
  • 14. Payment and Service Authorization

  • Payment terms will be stated on the invoice, proposal, estimate, or checkout page. Unless otherwise agreed in writing, payment is due before or at the time of service. Deposits may be required to reserve scheduling. Annual memberships must be paid before membership benefits begin. Guest welcome bags may require advance payment due to product purchasing and preparation.

  • 15. Cancellations, Rescheduling, and Refunds

  • Client may request cancellation or rescheduling by contacting Company as soon as possible. Company may reschedule services due to weather, FAA restrictions, safety concerns, access issues, equipment problems, or other operational limitations.
    Refund eligibility depends on the service purchased, work already performed, products already purchased, scheduling commitments, travel, and preparation time. Welcome bags, custom materials, rush services, and completed documentation services may be non-refundable once preparation or service work has begun.
  • 16. Referral Program and Promotions

  • Company may offer referral promotions, discounts, or account credits from time to time. Unless otherwise stated in writing, referral rewards are issued only after the referred client completes and pays for their first eligible service, are not redeemable for cash, may not be stacked on the same service or invoice, and only one referral credit may be used per invoice or service period.
    Any limited-time promotion, including offers such as "first 20 customers get $50 off," is subject to availability, eligibility, and Company approval. Promotions may expire at any time, may be limited by geography or service type, may not apply to all services, may not be combined with other offers unless stated in writing, and have no cash value.
  • 17. Limitation of Liability

  • To the fullest extent permitted by law, Company's total liability for any claim arising out of or related to services shall not exceed the amount paid by Client for the specific service giving rise to the claim.
    Company shall not be liable for indirect damages, consequential damages, incidental damages, lost profits, lost bookings, lost rental income, insurance claim denial, missed damage, hidden defects, inaccessible areas, weather-related limitations, FAA or legal restrictions, guest dissatisfaction related to third-party products, or decisions made by Client or third parties based on delivered media.
  • 18. No Warranties

  • Services are provided on an "as available" and "as performed" basis. Company makes no warranties, express or implied, regarding insurance claim outcomes, damage detection, property condition, guest review improvement, booking increases, revenue generation, website traffic, continuous availability, uninterrupted service, or exact visual coverage of every property area.
  • 19. Dispute Resolution and Governing Law

  • This Agreement shall be governed by the laws of the State of Florida. The parties agree to first attempt to resolve disputes informally and in good faith. If a dispute cannot be resolved informally, the parties may pursue available legal remedies under Florida law.
  • 20. Entire Agreement

  • This Agreement, together with any written estimate, invoice, proposal, statement of work, or package description provided by Company, represents the entire understanding between Company and Client. If there is a conflict between this Agreement and a written proposal or invoice, the more specific written terms in the proposal or invoice shall control only for that specific service.

  • 21. Client Acceptance

  • By signing below, paying an invoice, scheduling services, approving a proposal, or accepting delivered services, Client acknowledges that they have read, understood, and agreed to this Agreement.

  • By paying this invoice or scheduling service, Client agrees to the Cutting Edge Property Watch Purchase Agreement and Service Terms. Services are for visual documentation and monitoring purposes only and do not constitute a home inspection, engineering evaluation, insurance claim service, public adjusting service, or guarantee of property condition or insurance outcome. Delivery links may expire after 90 days, and Client is responsible for downloading and storing their own copies.
