  • Please read the following requirements carefully. By checking the box below, you acknowledge that you have read and understand these requirements.

  • 1. The defendant must reside within the Jurisdiction of the 35th District Court and/or within 15 miles of the court.

    2. The Pending OWI offense must be alcohol related (35th District Court does not accept OWID/ drug related offenses). If the defendants has entered a plea, it must be a plea of guilt. A plea of no contest will not be accepted.

    3. The 35th District Court does not accept defendants who have a Medicinal Marijuana Card and/or use medicinal marijuana.

    4. The defendant must not have any active criminal warrants. If the defendant has any active warrants all warrants must be cleared prior to an intake being scheduled.

    5. The transfer must be a COMPLETE TRANSFER and not a transfer of supervision transfer into the 35th District Court.

    6. The 35th District Court will collect its program fees, and the transferring court will collect its own fines and court costs at their own court.

    7. The defendant must complete an intake with the 35th District Court Sobriety Court Probation Officer in addition to a clinical screening with Counseling Assessment and Associates to determine his/her eligibility.

    8. The following documents/information must be provided to the 35th District Court prior to the screening:

        a. A contact person from the transferring court (Probation officer/ Specialty               Court Administrator including the individual's name, phone number and email         address)

        b. The defendant's contact information (ie: address, phone number, email                address)

        c. Updated Register of Actions

        d. Copy of the police report and complaint

        e. Updated Criminal History and driving record (this may be sent via secure fax          or encrypted email)

        f. Copy of any screening tool administered by the transferring court and/or                 completed PSI

        g. Updated progress reports and/or certificates from any treatment providers              and/or agencies the defendant is currently working with or recently attended.          (ie: IOP, Out-Patient TX, inpatient treatment)

    9. Once the intake and clinical screening have been completed the case will be reviewed with the 35th District Court Sobriety Court Judge.

    10. The defendant and his/her attorney will be notified of the final determination.
