Equine Voices Rescue & Sanctuary

I ACKNOWLEDGE that I am voluntarily entering Equine Voices at Jumpin' Jack Ranch in the presence of horses and ranch equipment. 

I AM AWARE that being around horses is a hazardous activity which I am voluntarily participatin in with the knowledge of the danger involved.

I ACKNOWLEDGE (1) The propensity of the animal to behave in ways that may result in injury, harm or death to persons on or around them (the powerful and potentially dangerous and destructive ways in which these large animals can behave), (2) The unpredictability of the animal’s reaction to such things as sounds, sudden movements, and unfamiliar objects, persons, or other animals, (3) Certain hazards such as surface and subsurface conditions, (4) Collisions with other animals or objects, (5) The potential of myself or others to act in a negligent manner that may contribute to injury to myself or others, (6) Other unforeseeable accidents or events associated with or a result of horseback riding or being around horses in general.

In consideration of being permitted to attend the ranch and to participate in the activities of the ranch, I AGREE THAT I, MY HEIRS, DISTRIBUTEES, GUARDIANS, AND LEGAL REPRESENTATIVES WILL NOT SUE, MAKE A CLAIM, ATTACH THE PROPERTY OF OR PROSECUTE Equine Voices at Jumpin’ Jack Ranch and/or Karen Pomroy, or any operator, agent or volunteer or other participant for injury, death, or damage resulting from their negligence or other acts as a result of my attending the ranch and participating in the activity of the ranch.

I UNDERSTAND that the provisions of the Arizona equine liability statute, ARS 12-553, are applicable to this waiver and I am aware and understand the inherent risks associated with equine activities and I am willing and able to accept full responsibility for my own safety and welfare and I so hereby release EQUINE VOICES RESCUE & SANCTUARY from any and all liability associated with any such equine related activities I may willfully chose to engage in.

I HEREBY AGREE TO RELEASE AND DISCHARGE Equine Voices at Jumpin’ Jack Ranch from all actions, claims or demands in the activity my attending the ranch and participating in the activity of the ranch and that I, my heirs, distributees, guardians, and legal representatives now have or may hereafter have.

I AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS Equine Voices at Jumpin’ Jack Ranch due to their negligence or otherwise during my attending the ranch and participating in the activity of the ranch.

I agree that this RELEASE WAIVER AND INDEMNITY AGREEMENT is intended to be broad and inclusive and that if any portion is held invalid by the laws of the State of Arizona, it is agreed that the balance of the agreement shall continue in force.

The undersigned hereby declares that she/he has knowingly and voluntarily, free of duress, coercion, or inducements of any kind, chosen to sign this waiver and release form without availing herself/himself of the services of independent legal counsel and hereby declares that she/he has fully read this waiver and release form and that she/he has no questions, reservations, or questions relating to any term or provision, or to the application or effect of any such

PHOTO/VIDEO LICENSING AGREEMENT - • Equine Voices grants to Photographer/Videographer, his or her heirs, legal representatives and agents, and assigns the right to take photographs or other reproductions of the horses and other animals and other property found at Equine Voices Rescue & Sanctuary, Jumpin’ Jack Ranch. Photographer/videographer agrees that all photographs or other reproductions of the Sanctuary, its officers, employees, agents or volunteers, or any of its horses or other animals may not be published, sold, reproduced, transferred, distributed or otherwise commercially exploited in any manner whatsoever without the prior written permission of Equine Voices. Photographer also agrees that (a) If any photographs or other reproductions are sold or otherwise used for profit, Equine Voices shall receive 25% of the proceeds received or derived from said sale or profit and said proceeds shall be used for the continued care and training of Equine Voices horses and no other purpose; and (b) anything produced with the name "Equine Voices Rescue & Sanctuary", "Equine Voices", "Jumpin Jack Ranch", "Gulliver" or any version thereof on it such as photographs, greeting cards, note pads, website information or the like must be approved by Equine Voices prior to publication, distribution, dissemination or public display of same.

I AGREE TO ASSUME FULL RESPONSIBILITY AND RISK FOR ANY PERSONAL INJURY, DEATH OR DAMAGE from my attending the ranch and participating in the activity of the ranch.

I AGREE THAT I WILL NOT, maliciously, directly or indirectly, release or disclose to any person, corporation, company, non-profit organization or other entity, or use for my own purposes, any confidential or proprietary information obtained through my employment/volunteering at EQUINE VOICES, both during and after my employment/volunteering at EQUINE VOICES and I will not use the said information for personal or professional gain.

I HAVE CAREFULLY READ THIS AGREEMENT OF RELEASE, WAIVER OF LIABILITY AND INDEMNITY AND FULLY UNDERSTAND ITS CONTENTS. I AM SIGNING THIS AGREEMENT OF RELEASE, WAIVER OF LIABILITY AND INDEMINITY AGREEMENT OF MY OWN FREE WILL
