Race Waiver and Liability Release
By registering for a Capital Kamikaze event operated by Pinned Events Pty Ltd ("the Organiser"), you agree to the following terms and conditions.

In consideration of the Organiser accepting my participation in any event organised, promoted, or conducted by the Organiser, which may involve a significant risk of physical harm, I agree to this Release of Claims, Waiver of Liability, and Assumption of Risk.

Assumption of Risk
I acknowledge that mountain biking and cycling are inherently hazardous activities conducted in varying terrain, surface, weather, and environmental conditions. These activities differ from road cycling in that they may take place on partially improved and unimproved trails, roads, tracks, and naturally rugged terrain.

I understand that mountain biking and cycling are dangerous recreational activities that may involve, in addition to their inherent risks:

Personal injury or illness;
Serious physical harm or death;
Physical exertion for which I may not be prepared;
Equipment failure;
Collisions with other riders, spectators, vehicles, animals, or natural obstacles;
Exposure to extreme weather conditions;
Remoteness from medical services;
Delays in emergency response or evacuation; and
Damage to or loss of personal property.
I voluntarily accept all inherent and obvious risks associated with participation in the event and acknowledge that my participation is entirely at my own risk.

Medical Fitness
I certify that I am medically fit and physically capable of participating in the event. I acknowledge that it is my responsibility to determine whether I am sufficiently fit and healthy to participate and to seek medical advice where appropriate.

I acknowledge that the Organiser has relied upon this declaration in accepting my entry.

Compliance with Event Rules
I agree to:

Comply with all event rules, regulations, and instructions issued by the Organiser, race officials, volunteers, marshals, and event staff;
Conduct myself in a safe and responsible manner;
Wear an Australian Standards-approved cycling helmet at all times while racing;
Ensure that my bicycle is in a safe and roadworthy condition;
Inspect and familiarise myself with the course wherever possible before racing; and
Ride within my abilities and with due care for other participants and course users.
I acknowledge that failure to comply with event rules may result in penalties, removal from the course, or disqualification.

Release and Waiver
To the fullest extent permitted by law, I release and forever discharge the Organiser, its directors, officers, employees, volunteers, contractors, agents, sponsors, event partners, landowners, public authorities, licensors, and representatives from any and all claims, demands, actions, proceedings, liabilities, costs, expenses, damages, losses, or causes of action arising out of or connected with my participation in the event, including any personal injury, illness, death, property damage, or economic loss.

This release does not apply to any liability that cannot be excluded by law or that arises directly from the negligent or unlawful conduct of the Organiser.

Indemnity
To the fullest extent permitted by law, I indemnify and hold harmless the Organiser, its directors, officers, employees, volunteers, contractors, agents, sponsors, event partners, landowners, public authorities, licensors, and representatives against any claim, demand, action, liability, cost, expense, or loss arising directly or indirectly from:

My participation in the event;
Any breach of this waiver by me;
Any negligent, reckless, or unlawful act or omission by me; or
Any injury, loss, or damage caused by me to another person or their property.
Medical Treatment and Emergency Assistance
I authorise the Organiser to obtain medical treatment, ambulance services, rescue services, and emergency evacuation on my behalf if, in the opinion of event officials or medical personnel, such assistance is necessary.

I agree that all costs associated with medical treatment, ambulance transport, rescue services, or evacuation are my sole responsibility.

Photography and Media Release
I grant the Organiser and its sponsors, partners, media representatives, and promotional agencies the unrestricted right to use photographs, video footage, audio recordings, live-stream content, and other media containing my image, likeness, name, voice, or race results for promotional, marketing, editorial, social media, broadcast, or commercial purposes without compensation.

Privacy and Communications
I agree that my personal information may be collected, stored, and used by the Organiser for event administration, timing and results services, participant communications, safety management, and future event marketing in accordance with applicable privacy laws.

I acknowledge that podium finishers may have their details shared with prize sponsors solely for prize fulfilment purposes. Any marketing communications from sponsors will be subject to the sponsor's own privacy policy and unsubscribe procedures.

Acknowledgement
I acknowledge that:

I have carefully read and understood this waiver;
I fully understand the risks involved in participating in mountain biking events;
I enter the event voluntarily and at my own risk;
I understand that I am giving up certain legal rights by agreeing to this waiver; and
I agree to be bound by all terms contained within this document.
Parent or Guardian Consent
If the participant is under 18 years of age, this waiver must be accepted by a parent or legal guardian who agrees to these terms on behalf of the participant and accepts responsibility for the participant's conduct and participation.

E-Bike Rider Addendum
For participants competing on an e-bike:

I acknowledge that the e-bike I am using complies with all applicable Australian laws and regulations relating to power-assisted pedal cycles.

I understand that the use of a non-compliant e-bike may create safety risks for myself and others.

I acknowledge that:

Event officials may inspect my e-bike at any time before, during, or after the event;
Non-compliance may result in penalties, disqualification, removal from the event, or exclusion from future events operated by Pinned Events Pty Ltd; and
Any injury, loss, damage, or liability arising from the use of a non-compliant e-bike remains solely my responsibility.
By participating in the event, I confirm that my e-bike complies with all applicable Australian standards and regulations.
