  • 2.1 SERVICES PROVIDED

  • Animal Arc | Paradise Pet Jets ("Company") provides professional pet transportation and relocation services throughout the United States and other destinations as permitted by applicable laws and regulations.
    Services may include, but are not limited to:
    • Private Ground Transportation
    • Semi-Private Ground Transportation
    • Shared Ground Transportation
    • Flight Nanny Services (In-Cabin)
    • Commercial Airline Coordination
    • Cargo Transportation Coordination
    • Airport Transfers
    • Breeder Deliveries
    • Rescue Transportation
    • Pet Relocation Services
    The Company reserves the right to determine the safest and most appropriate transportation method based upon the pet's age, health, size, temperament, destination requirements, weather conditions, carrier availability, and operational considerations.
  • 2.2 CLIENT RESPONSIBILITIES

  • Prior to transportation, Client agrees to provide accurate and complete information regarding:
    • The pet's health condition
    • Vaccination status
    • Behavioral history
    • Medication requirements
    • Feeding instructions
    • Emergency contact information
    Client is solely responsible for ensuring all required travel documentation, health certificates, permits, and vaccinations are current and valid.
  • TRANSPORTATION RISKS, VEHICLE ACCIDENTS & DELAYS

  • 3.1 ASSUMPTION OF TRANSPORTATION RISK

  • Animal Arc | Paradise Pet Jets ("Company") exercises reasonable care in the transportation and handling of all pets entrusted to its care. However, Client acknowledges that the transportation of live animals involves inherent risks that cannot be completely eliminated.
  • Such risks may include, but are not limited to:
    • Vehicle accidents
    • Mechanical failures
    • Severe weather conditions
    • Traffic delays
    • Road closures
    • Airline disruptions
    • Illness or injury during travel
    • Acts of nature
    • Actions of third parties
    • Other unforeseen emergencies
  • By signing this Agreement, Client voluntarily accepts and assumes these inherent transportation risks.
  • 3.4 SCHEDULE DELAYS

  • Pickup and delivery times are estimates only and are not guaranteed.
  • Transportation schedules may be affected by:
    • Traffic congestion
    • Weather conditions
    • Construction zones
    • Road closures
    • Airline disruptions
    • Veterinary emergencies
    • Government restrictions.
    • Other circumstances beyond the Company's reasonable control
  • The Company shall not be liable for delays resulting from such events.
  • 3.2 VEHICLE ACCIDENT POLICY

  • Client understands that transportation vehicles may be involved in accidents despite reasonable safety precautions and professional operating practices.
  • In the event of a vehicle accident:
    • The safety and welfare of transported pets shall be the Company's highest priority.
    • Emergency veterinary treatment may be obtained when reasonably necessary.
    • Transportation schedules may be delayed, altered, or suspended.
    • Alternative transportation arrangements may be utilized when available and appropriate.
  • The Company shall not be liable for delays, schedule disruptions, or circumstances resulting from accidents beyond its reasonable control.
  • 3.5 FORCE MAJEURE

  • The Company shall not be liable for delays, interruptions, or inability to perform services resulting from events beyond its reasonable control, including but not limited to:
    • Hurricanes
    • Tornadoes
    • Floods
    • Wildfires
    • Snowstorms
    • Earthquakes
    • Public emergencies
    • Government actions
    • Civil disturbances
    • Acts of God
  • The Company may suspend, postpone, reroute, or cancel transportation services when necessary to protect animal welfare, public safety, or Company personnel.
  • 3.3 MECHANICAL FAILURE & EMERGENCY DELAYS

  • Despite regular maintenance and inspections, transportation vehicles and equipment may experience unexpected mechanical failures.
  • Should such an event occur, the Company may:
    • Suspend transportation operations temporarily
    • Obtain necessary repairs
    • Arrange replacement transportation when available
    • Modify pickup or delivery schedules
    • Utilize temporary boarding arrangements when reasonably necessary
  • No refund, credit, or compensation shall be owed solely due to delays resulting from circumstances beyond the Company's reasonable control.
  • 3.6 ANIMAL WELFARE PRIORITY

  • Client acknowledges that the Company may make operational decisions necessary to protect:
    • The transported pet
    • Other transported animals
    • Company personnel
    • Contractors and handlers.
    • Members of the public
  • Such decisions may include route changes, additional rest periods, weather holds, emergency veterinary visits, temporary boarding, or transportation delays.
  • All such decisions shall be made with animal welfare and safety as the primary consideration.
  • HEALTH REQUIREMENTS, VACCINATIONS & PUPPY POLICY

  • 4.1 HEALTH CERTIFICATION

  • Animal Arc | Paradise Pet Jets ("Company") requires that all pets presented for transportation be healthy enough to travel and free from any known contagious illness, injury, or condition that may endanger the transported pet, other animals, Company personnel, or members of the public. The Company reserves the right to refuse transportation of any pet appearing ill, injured, medically unstable, or otherwise unfit for travel.
  • 4.4 NO PAWS ON GROUND POLICY

  • For puppies that have not completed their vaccination series:
    • No paws shall be placed on public ground.
    • No contact shall occur with unknown animals.
    • Potty breaks may be conducted through sanitary kennel procedures.
    • The puppy may remain inside its kennel throughout transportation.
  • 4.2 VACCINATION & TRAVEL DOCUMENTATION REQUIREMENTS

  • This policy is intended to reduce exposure to communicable diseases including:
    • Parvovirus
    • Distemper
    • Kennel Cough
    • Other contagious illnesses
  • Client is solely responsible for ensuring compliance with all applicable:
    • Federal requirements
    • State requirements
    • Local requirements
    • Airline requirements
    • Import and export requirements
    • Rabies vaccination requirements
    • Health Certificate (CVI) requirements
    The Company does not guarantee entry into any state, airport, airline, country, or destination if required documentation is missing, expired, incomplete, or inaccurate. Any costs arising from non-compliance shall remain the responsibility of the Client.
  • 4.5 PARASITES & COMMUNICABLE CONDITIONS

  • Client certifies that the pet is free from:
    • Fleas
    • Ticks
    • Mange
    • Known communicable diseases
    • Other contagious conditions
  • 4.3 UNDER-VACCINATED PUPPY POLICY

  • If undisclosed infestations, parasites, or contagious illnesses result in cleaning costs, veterinary expenses, quarantine expenses, treatment expenses, or operational disruptions, Client agrees to reimburse the Company for resulting costs.
  • The Company may, at its sole discretion, accept puppies that have not completed their vaccination series. Client understands and agrees that:
    • Under-vaccinated puppies may present increased health risks.
    • Puppies may remain kenneled throughout transportation.
    • Exposure to unknown animals may be restricted.
    • Additional sanitation procedures may be utilized.
    • Public potty breaks may be limited or prohibited.
    The Company reserves the right to decline transportation of any puppy deemed too young, medically fragile, or otherwise unsuitable for travel.
  • 4.6 MEDICATION DISCLOSURE

  • Client agrees to disclose all medications, supplements, medical conditions, injuries, allergies, and special care requirements prior to transportation. Failure to disclose relevant medical information may result in cancellation of services and may limit the Company's ability to respond appropriately to medical emergencies.

  • PAYMENT TERMS, DEPOSITS, TRANSFERS, CANCELLATIONS & ROUTE MODIFICATIONS

  • 5.1 PAYMENT REQUIREMENTS

    • Ground transportation requires a 50% deposit at booking. The remaining balance is due at pet pick-up before transport begins.
    • Flight nanny, commercial airline coordination, cargo transportation, and air transportation services require payment in full prior to booking, ticketing, scheduling, or transportation arrangements.
    • Animal Arc and Paradise Pet Jets do not accept Cash on Delivery (COD) payments.
    • Failure to make required payments may result in cancellation, suspension, delay, or refusal of transportation services.
  • 5.4 CLIENT CANCELLATION

    • All client cancellations must be submitted in writing.
    • If Client cancels transportation, refuses transportation, fails to appear, fails to provide required documentation, fails to make payment, or otherwise prevents transportation from moving forward, all payments shall remain non-refundable unless a transfer credit is approved pursuant to Section 5.3.
    • Client may be responsible for route changes, lodging expenses, fuel expenses, administrative expenses, and other recoverable business losses permitted by law.
  • 5.2 DEPOSITS

    • Deposits reserve route space, transportation dates, staffing, scheduling, equipment, and transportation resources.
    • Deposits are non-refundable once transportation services have been scheduled and confirmed.
  • 5.5 PICK-UP, DELIVERY DELAYS, ROUTE MODIFICATIONS, ADDITIONAL PICKUPS & DELIVERIES

    • Client understands Animal Arc operates private, semi-private, and shared transportation services.
    • The Company reserves the right to modify routes, schedules, pick-up sequences, delivery sequences, travel plans, and transportation arrangements to accommodate additional clients, pets, operational needs, weather conditions, road conditions, safety concerns, vehicle maintenance requirements, lodging requirements, airline schedules, and other business necessities.
    • All pick-up and delivery times are estimates only and are not guaranteed appointment times.
    • No refunds, credits, discounts, or compensation shall be due as a result of route adjustments, schedule changes, additional pick-ups or deliveries, traffic delays, weather delays, airline delays, mechanical issues, or other operational circumstances reasonably necessary to complete transportation services safely and efficiently.
  • 5.3 TRANSFER CREDIT POLICY

    • If Client cancels within seven (7) days of the scheduled pick-up date, Animal Arc may, at its sole discretion, approve a transfer of funds or account credit toward a future transportation service.
    • Transfer approvals are not automatic and must be approved by the Company in writing.
    • Credits may only be applied toward future transportation services and have no cash value.
  • 5.6 COMPANY CANCELLATION

    • The Company reserves the right to delay, suspend, refuse, reroute, modify, or cancel transportation services when necessary for safety, animal welfare, legal compliance, weather conditions, road conditions, mechanical issues, documentation issues, non-payment, undisclosed medical or behavioral concerns, government restrictions, airline restrictions, or circumstances beyond the Company's reasonable control.
    • If the Company cancels transportation for reasons solely within the Company's control and no transportation services have been provided, the Company may issue a refund or transfer credit at its sole discretion.

  • LIABILITY, LIMITATIONS & INDEMNIFICATION

  • 6.1 LIMITATION OF LIABILITY

  • To the fullest extent permitted by law, the Company shall not be liable for any:
    • Injury
    • Illness
    • Escape
    • Delay
    • Death
    • Loss
    • Accident
    • Property damage
    • Consequential damages
    • Indirect or incidental damages
    arising from transportation services provided, except in cases of the Company's gross negligence or willful misconduct.
  • 6.5 RELEASE OF CLAIMS

  • Client releases and forever discharges the Company from any and all claims, demands, actions, or causes of action arising from transportation services, except those resulting from the Company's gross negligence or willful misconduct. This release includes claims known or unknown, foreseen or unforeseen.
  • 6.6 THIRD-PARTY SERVICES

  • The Company may utilize third-party vendors including but not limited to:
    • Airlines
    • Ground transport providers
    • Veterinary clinics
    • Boarding facilities
    • Customs agents
    • Handlers
  • The Company is not liable for the acts, omissions, delays, or errors of third-party providers.
  • 6.2 MAXIMUM LIABILITY

  • If the Company is found liable for any claim, the maximum liability shall not exceed the amount actually paid by Client for the specific transportation service. This limitation applies regardless of the nature of the claim or cause of action.
  • 6.7 CARGO TRANSPORTATION RISK

  • When pets travel as cargo, Client acknowledges that:
    • Cargo compartments are not climate-controlled at all times.
    • Noise, vibrations, and movement occur.
    • Airline policies vary.
    • Risks are increased compared to in-cabin transport.
    Client accepts all risks associated with cargo transportation.
  • 6.3 INHERENT RISK ACKNOWLEDGMENT

  • Client acknowledges that pet transportation involves inherent risks, including but not limited to:
    • Stress
    • Anxiety
    • Weather exposure
    • Travel fatigue
    • Carrier delays
    • Road hazards
    • Other uncontrollable variables
    Client voluntarily assumes all such risks by signing this Agreement.
  • 6.8 SPECIAL & INDIRECT DAMAGES

  • The Company shall not be liable for any special, indirect, punitive, or consequential damages including but not limited to:
    • Emotional distress
    • Loss of companionship
    • Loss of business
    • Breeding losses
    • Lost profits
    • Other economic losses
    This limitation applies even if the Company has been advised of the possibility of such damages.
  • 6.4 INDEMNIFICATION BY CLIENT

  • Client agrees to indemnify, defend, and hold harmless Animal Arc | Paradise Pet Jets, its owners, employees, agents, contractors, and affiliates from any and all claims, damages, liabilities, losses, costs, or expenses (including attorney fees) arising from:
    • Misrepresentation of pet health
    • Failure to disclose relevant information
    • Aggressive or dangerous pet behavior
    • Violation of this Agreement
    • Any act or omission of the Client
