ADULT PARTICIPANT WAIVER AND RELEASE OF LIABILITY
I am 18 years or older, and I acknowledge that participation in swim instruction and related activities with Soberal Swim School involves inherent risks, including the risk of injury in, on, or around water. Soberal Swim School is not liable for injuries in, on, or around the water. This includes but is not limited to slips, falls, concussions, cuts, bruises, broken bones, drowning, Near-drowning, Water aspiration, Spinal injuries, Diving injuries, head injuries, Chemical exposure, Allergic reactions, Physical contact with other swimmers, Fatigue, Medical emergencies in water, death, or other losses arising from participation. I understand that improper diving or swimming can cause serious bodily injury, permanent disability, paralysis, or death. By signing this form, I agree that Soberal Swim School is not responsible for any injuries, accidents, or incidents that may occur during training or lessons, whether in, on, or around water. In the event of injury or medical emergency, I authorize Soberal Swim School to obtain emergency medical treatment, contact emergency medical services, and take reasonable actions deemed necessary to protect my health and safety. I understand that I am responsible for any resulting medical expenses. Participants/swimmers take full responsibility for their own actions at public and private facilities. I voluntarily accept all risks associated with participation and agree to be responsible for my own actions. I understand that by agreeing, I forfeit any and all arising claims. I release, waive, discharge, and covenant not to pursue litigation or legal action against Soberal Swim School, its owners, employees, instructors, contractors, agents, and representatives from any and all claims, demands, judgements, causes of action, damages, or liabilities arising from participation in swim instruction, including claims arising from ordinary negligence. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising from this Agreement shall be brought exclusively in a court of competent jurisdiction located in Florida. I acknowledge that I have carefully read this Agreement, fully understand its contents.
PARENT/GUARDIAN WAIVER AND RELEASE OF LIABILITY
I am the parent or legal guardian of the participant named below and have the legal authority to enter into this Agreement on behalf of the participant. I acknowledge that participation in swim instruction and related activities with Soberal Swim School involves inherent risks, including the risk of injury in, on, or around water. I understand that such risks include, but are not limited to, slips, falls, cuts, bruises, broken bones, drowning, near-drowning, water aspiration, spinal injuries, diving injuries, head injuries, chemical exposure, allergic reactions, physical contact with other swimmers, fatigue, medical emergencies in water, permanent disability, paralysis, death, and other losses arising from participation. I understand that improper swimming, diving, or aquatic activities can result in serious bodily injury, permanent disability, paralysis, or death. I acknowledge and understand these risks and voluntarily allow my child to participate in swim instruction and related activities offered by Soberal Swim School. On behalf of myself and my child, I voluntarily assume all risks associated with participation and accept full responsibility for any injury, loss, damage, or expense that may occur as a result of participation in swim instruction and related activities. To the fullest extent permitted by applicable law, I release, waive, discharge, and covenant not to persue litigation or legal action against Soberal Swim School, its owners, employees, instructors, contractors, agents, representatives, successors, and assigns from any and all known or unknown claims, demands, causes of action, damages, judgments, liabilities, costs, and expenses arising from or related to my child's participation in swim instruction and related activities, including claims arising from the ordinary negligence of the released parties. I understand and agree that my child is responsible for following all instructions, rules, and safety requirements established by Soberal Swim School and the facility where instruction is conducted. In the event of injury or medical emergency involving my child, I authorize Soberal Swim School to obtain emergency medical treatment, contact emergency medical services, and take reasonable actions deemed necessary to protect my child's health and safety. I understand that I am responsible for any resulting medical expenses. I acknowledge that I have carefully read this Agreement, fully understand its contents, understand that I may be giving up substantial legal rights on behalf of myself and my child, and sign this Agreement freely and voluntarily. If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute arising from this Agreement shall be brought exclusively in a court of competent jurisdiction located in Florida.
