⚠️ WARNING: THIS IS A LEGALLY BINDING CONTRACT UNDER TEXAS LAW. BY AGREEING YOU WAIVE CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE. READ CAREFULLY.

1. Assumption of Risk
Participation in foam party activities involves physical activity and exposure to foam, water, and wet surfaces. Risks include but are not limited to

• Slipping, falling, or physical injuries on wet surfaces
•  Skin or eye irritation from foam solution
• Allergic reactions in individuals with sensitivities
•  Respiratory irritation in individuals with pre-existing conditions
• Any other inherent risks associated with foam party activities

I voluntarily accept and assume all such risks, known and unknown, arising from participation in any Chaotic Party Animals event.

2. Release of Liability — Texas Liability Waiver

NOTICE: UNDER TEXAS LAW, THIS RELEASE COVERS CLAIMS ARISING FROM ORDINARY NEGLIGENCE. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, INTENTIONAL ACTS, OR WILLFUL/WANTON CONDUCT.

In consideration of being permitted to participate, I hereby RELEASE, WAIVE, DISCHARGE, COVENANT NOT TO SUE, and HOLD HARMLESS Chaotic Party Animals, its owners, employees, agents, volunteers, and contractors ("Released Parties") from any and all liability, claims, damages, losses, or causes of action — including claims for personal injury, death, or property damage — whether known or unknown, arising from participation in any Chaotic Party Animals event. This release expressly includes claims arising from the ORDINARY NEGLIGENCE of the Released Parties.

3. Foam Solution & Health Safety
Our foam solution is non-toxic and formulated for safe skin contact. Participants with known skin sensitivities, allergies, asthma, or respiratory conditions should consult a physician before participating. Avoid foam contact with eyes — rinse with clean water if contact occurs. Chaotic Party Animals is not liable for allergic reactions or health complications from foam exposure.

4. Supervision of Minors
Children under 18 must have a parent or legal guardian present who accepts this waiver on their behalf. Chaotic Party Animals staff are not responsible for individually supervising participants. The event organizer/booking client is responsible for ensuring adequate adult supervision.

5. Venue & Property Responsibility
The client is responsible for ensuring the venue is suitable for foam activities. Chaotic Party Animals is not liable for damage to flooring, surfaces, landscaping, or personal property, or for incidents occurring outside the designated foam area.

6. Deposit & Cancellation Policy
A non-refundable $100 deposit is required to secure your booking date, applied toward your total balance. Deposits are non-refundable under any circumstances. Dates may be rescheduled with at least 7 days written advance notice, subject to availability. Cancellations with less than 7 days notice forfeit the full deposit.

7. Travel Fees
Travel within Odessa and Midland, TX is free. Events outside these areas are subject to a travel fee, disclosed prior to booking confirmation. Signing this waiver confirms acceptance of any quoted travel fee.

8. Photography & Media Consent
Chaotic Party Animals may photograph or record events for promotional use on social media and marketing materials. If you do not consent to photography of yourself or your minor child, notify us in writing at least 48 hours before your event.

9. Indemnification
To the fullest extent permitted by Texas law, I agree to indemnify, defend, and hold harmless the Released Parties from all claims, damages, losses, and expenses — including reasonable attorney's fees — arising from my (or my minor child's) participation or any breach of this agreement.

10. Governing Law & Venue
This waiver is governed by the laws of the State of Texas. Exclusive jurisdiction for any dispute shall be the courts of Ector County, Texas. The parties confirm they have had the opportunity to consult legal counsel prior to agreeing.

Waiver Terms

Weather Policy: Events may be delayed, rescheduled, or canceled due to unsafe weather conditions.

Equipment Tampering: Participants may not tamper with, move, or operate equipment.

Footwear Recommendation: Bare feet or secure footwear are recommended in foam areas.

Medical Disclosure: Participants with asthma or respiratory conditions participate at their own risk.

Parent/Guardian Authorization: Parent or guardian acknowledges acceptance of this waiver on behalf of all minor children attending.

Photo/Video Consent: I understand that photos and videos may be taken during the event and used to promote the business.

PAYMEN & RESERVATION POLICY:

To reserve your event date, a non-refundable $100 deposit is required at the time of booking and goes towards the balance.  Deposits may be submitted via CashApp $ChaoticPartyAnimals.

Please note:

• Event dates are not guaranteed until the deposit has been received.

• Deposits are non-refundable but may be transferred to a new date if approved by Chaotic Party Animals and subject to availability.

• The remaining balance is due before or at the time of service.

• Pricing begins at $300 + tax for a 1-hour foam party package.

• Additional services and upgrades may be available upon request.

By submitting your booking request and deposit, you acknowledge and agree to these terms.
