EVENT RELEASE AND WAIVER OF LIABILITY
Event Name: Family Forest Days with Forest Academy
Release and Waiver of Liability
- I, on behalf of myself and/or my child, enter into this Release and Waiver of Liability as a condition of, and in consideration for, my/our participation in the above-named Forest Academy, LTD event (the “Event”). I understand that Forest Academy’s programming includes outdoor, nature-based activities and experiences, and that there are inherent risks associated with such activities. I acknowledge and voluntarily assume all risks associated with participation in the Event.
- I understand and acknowledge that participation in the Event may involve physical activity and exposure to outdoor elements, including uneven terrain, weather conditions, wildlife, tools, fire-building activities, and other environmental factors. These risks may not always be obvious and cannot be entirely eliminated. I also understand that participation may include risk of illness, including communicable diseases. Participation in the Event is voluntary, and I assume all risks of injury (including death), illness, damage, or loss arising from participation.
- I, on behalf of myself, my child, and any other parent, guardian, or person who may act on our behalf, hereby release and discharge Forest Academy, LTD, and their directors, officers, employees, volunteers, agents, and event partners (collectively, the “Released Parties”) from any and all liability, claims, and causes of action for any injury, illness (including death), damage, or loss that may arise from participation in the Event. This release includes claims arising from the negligence of the Released Parties, except in cases of gross or willful negligence. I agree not to bring any legal action against the Released Parties for such claims.
- I understand that I am responsible for my own and/or my child’s medical care and insurance coverage, and that Forest Academy, LTD does not provide insurance for participants.
- I agree that this Release and Waiver is binding upon myself, my child, and our respective heirs, assigns, and legal representatives.
- This agreement shall be governed by the laws of the State of Indiana. If any portion of this agreement is held invalid, the remaining provisions shall remain in full force and effect.
Photo/Video Release
I understand that photographs and/or video recordings may be taken during the Event. I grant permission to Forest Academy, LTD to use images or recordings of myself and/or my child for promotional, educational, and marketing purposes, including on websites and social media. I understand that I may revoke this permission in writing at any time.
Acknowledgment
I HAVE READ AND UNDERSTAND THIS RELEASE AND WAIVER OF LIABILITY. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM WAIVING CERTAIN LEGAL RIGHTS. I SIGN THIS AGREEMENT VOLUNTARILY.
