ASSUMPTION OF RISK AND WAIVER OF LIABILITY FOR INJURY OR ILLNESS

 

6th Annual TOYA TUFF Adaptive Softball Game 

 

By signing below, I acknowledge and agree that my participation, or the participation of the individual(s) I am signing for, in events organized, sponsored, or promoted by TOYA TUFF, is voluntary. I understand that participation in these events may involve physical activity and inherent risks, including but not limited to injury, illness, property damage, or even death.

I understand that by engaging in TOYA TUFF events, I or the individual(s) I am signing for may be exposed to risks such as bodily injury, accidents, exposure to infectious diseases, or medical emergencies during the event, and I voluntarily assume these risks, both known and unknown.

RELEASE AND WAIVER
I HEREBY RELEASE, WAIVE, AND FOREVER DISCHARGE ANY AND ALL LIABILITY, CLAIMS, AND DEMANDS OF WHATEVER KIND OR NATURE AGAINST TOYA TUFF AND ITS AFFILIATED PARTNERS AND SPONSORS, AND THE PROPERTY OR SITE OWNERS OF ANY ACTIVITY, INCLUDING IN EACH CASE, WITHOUT LIMITATION, THEIR DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS (THE “RELEASED PARTIES”), EITHER IN LAW OR IN EQUITY, TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT, OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASED PARTIES, INCLUDING BUT NOT LIMITED TO DEATH, BODILY INJURY, ILLNESS, ECONOMIC LOSS OR OUT-OF-POCKET EXPENSES, OR LOSS OR DAMAGE TO PROPERTY, WHICH I, MY HEIRS, ASSIGNEES, NEXT OF KIN, AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVES, MAY HAVE OR WHICH MAY HEREAFTER ACCRUE ON MY BEHALF, WHICH ARISE OR MAY HEREAFTER ARISE FROM MY PARTICIPATION WITH THE ACTIVITY.

BY ATTENDING AND/OR PARTICIPATING IN THE ACTIVITY, YOU ARE DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASED PARTIES TO THE FULLEST EXTENT PERMITTED BY LAW.

I acknowledge that I am fully responsible for any risks related to my own participation or, if applicable, the participation of the individual(s) I am signing for, including but not limited to risks associated with physical injury, illness, and any medical conditions. I understand that TOYA TUFF cannot guarantee the safety of any participants and that the event may involve risks beyond the control of the organization.

For Participants Signing for Themselves:
By signing below, I confirm that I have read, understand, and agree to this waiver of liability. I understand the risks involved in the event and agree to voluntarily assume full responsibility for any injury, illness, or damage that may occur during my participation in the event.

For Caregivers/Guardians Signing for Individual(s):
By signing below, I confirm that I am the legal guardian or authorized caregiver of the individual(s) named below and I consent to their participation in this event. I acknowledge that I am fully aware of the risks involved and I assume responsibility for these risks on their behalf. I further agree to indemnify and hold harmless TOYA TUFF, its staff, volunteers, and affiliates from any claims arising from the individual(s)' involvement in the event, including any injury, illness, or death that may occur.

 

I hereby grant TOYA TUFF permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration.

I understand and agree that all photos will become the property of the TOYA TUFF and will not be returned.

I hereby irrevocably authorize the TOYA TUFF to edit, alter, copy, exhibit, publish, or distribute these photos for any lawful purpose. In addition, I waive any right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photo.

I hereby hold harmless, release, and forever discharge the TOYA TUFF from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

I HAVE READ AND UNDERSTAND THE ABOVE PHOTO RELEASE. I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, OR, IF I AM UNDER 18 YEARS OF AGE, I HAVE OBTAINED THE REQUIRED CONSENT OF MY PARENTS/GUARDIANS AS EVIDENCED BY THEIR SIGNATURES BELOW. I ACCEPT

ASSUMPTION OF RISK, ACCIDENT WAIVER AND RELEASE OF LIABILITY

I, the undersigned, in consideration of my participation and/or my child’s participation in  the TOYA TUFF Adaptive Sports activities/events during the year of 2026,  acknowledge that this activity presents a test of a person's physical and mental limits and carries with it the potential for property loss or serious injury, including death. The risks include, but are not limited to, those caused by terrain, facilities, temperature, weather, condition of participants, equipment, vehicular traffic, actions of other people including but not limited to, participants, volunteers, spectators, event officials, and event monitors, and or the producer of the activity, or lack of hydration. These risks are inherent for participants and volunteers. I hereby assume all of the risks of my/my child participating and/or volunteering in this activity. I realize liability may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I acknowledge this form will be used by the activity holder, sponsors, and organizers in events in which I/my child may participate and that it will govern my actions and responsibilities at said activity. I also acknowledge that this form applies to me and all the participants listed below.

In consideration of permitting me/my child to participate in this activity, I take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: A) Waive, release and discharge from any and all liability for death, disability, personal injury, property damage, property theft or actions of any kind which may hereafter accrue to me or my child participating in this activity, the organizer and the following entities or persons: TOYA TUFF, their directors, officers, affiliated physicians, employees, volunteers, representatives, and agents, the event holders, event sponsors, event directors, event volunteers, and event officials. B) Indemnify and hold harmless the entities or persons mentioned in this paragraph from any and all liabilities or claims made by other individuals or entities as a result of my or any actions during this activity.
• This release extends to and includes any and all claims, liabilities, injuries, damages, and causes of action that the parties do not presently anticipate,  know ,or suspect to  exist, but that may develop, accrue, or be discovered in the future.
