  • Insurance Requirements

    All VENDORS participating in Dog Days of Kenmore must maintain commercial general liability insurance with limits of not less than $1,000,000 per occurrence. All VENDORS must provide a current ACORD 25 Certificate of Liability Insurance naming: The Kenmore Village Improvement Society, its officers, agents, employees and the Village of Kenmore, its officers, agents, employees as additional insureds. The ACORD 25 Certificate of Liability Insurance must be submitted within fourteen (14) days of application approval and no later than September 2, 2026. Applications will not be considered complete until the required certificate has been received. VENDORS who fail to provide the required certificate by the deadline may forfeit their participation in the event.

  • Dog Days of Kenmore Vendor Agreement

    Please review this vendor agreement carefully. You MUST agree and sign on to this agreement to complete this application.
  • The individual signing this contract is an authorized representative of the company or organization with full power and authority to sign and deliver this contract. Submission of this application and signature on this contract indicate understanding and agreement to comply with all policies, including but not limited to the Exhibitor Terms and Conditions and any other policies issued by the Kenmore Village Improvement Society (KVIS) regarding Dog Days of Kenmore.

    Submission of an application does not guarantee acceptance. KVIS reserves the right to accept or reject any application at its sole discretion.

    This contract is entered into between the vendor in this application (hereinafter known as "VENDOR") and the Kenmore Village Improvement Society (hereinafter known as "KVIS") for participation in Dog Days of Kenmore 2026.

    Both parties agree as follows:

    A. RESPONSIBILITIES OF KVIS
    KVIS will provide the VENDOR with the agreed-upon number of 10' x 10' booth spaces at locations determined by event organizers.
    KVIS reserves the right to modify booth locations, event layouts, and traffic patterns as necessary for safety, operational, or logistical purposes.

    B. RESPONSIBILITIES OF THE VENDOR
    Vendor Setup and Occupancy

    • Vendors must occupy their assigned booth space no later than 11:00 AM.
      All vendor vehicles must be unloaded and removed from the event grounds by 11:00 AM. For safety reasons, vehicles will not be permitted in vendor areas after that time.
    • Vendors should complete booth setup by 11:30 AM and be prepared for attendees who may arrive before the official event start time.
    • Teardown may not begin until the conclusion of the event at 4:00 PM unless otherwise authorized by KVIS.
    • Vendors who have not occupied their assigned booth space by 11:00 AM may forfeit the space, and KVIS reserves the right to reassign it without refund.

    Booth Equipment and Safety

    • Vendors must provide their own tables, chairs, tents, displays, and equipment.
    • Tents must be secured with appropriate weights at all times. Stakes may only be used with prior approval from event organizers.
    • Electrical service is not available to vendors.
    • Smoking, vaping, open flames, and combustible materials are prohibited except where specifically authorized by KVIS and permitted by applicable regulations.

    Vendor Conduct and Operations

    • The VENDOR may not sell, sublet, assign, or donate space within its booth for advertising, promotion, or operation by any third party without prior written consent from KVIS.
    • The VENDOR must operate in compliance with all applicable federal, state, county, and local laws, regulations, permits, licenses, and ordinances.
    • The VENDOR is responsible for paying all applicable federal, state, and local taxes. If applicable, a valid sales tax certificate must be obtained and displayed at the booth.
    • The VENDOR agrees to pay all fines, penalties, fees, or assessments levied due to the VENDOR'S failure to comply with applicable laws or regulations and shall reimburse KVIS for any related costs incurred as a result of such non-compliance.
    • Sound amplification, music, microphones, speakers, or public-address equipment may not be used without prior approval from KVIS.
    • The VENDOR may not operate any gambling activity, game of skill, game of chance, raffle, or similar activity within the booth unless specifically authorized by KVIS and permitted by law.
    • Vendors shall provide a cell phone number capable of receiving calls or text messages on the day of the event.

    Food Vendors

    • Any VENDOR offering food, beverages, pet treats, or food samples of any kind must possess all required permits and approvals from the Erie County Department of Health and any other applicable regulatory authority.
      Copies of all required permits and certificates must be available for inspection and displayed when required by law.

    Animals

    • Any VENDOR bringing animals to the event as part of its business, organization, exhibit, demonstration, rescue, or activity is solely responsible for the care, control, supervision, and safety of those animals and must comply with all applicable laws and event rules.
    • Animals displaying aggressive, dangerous, or disruptive behavior may be required to leave the event at the discretion of KVIS or public safety officials.

    Insurance Requirements

    • Any VENDOR selling or distributing food, beverages, pet treats, or food samples of any kind, and any VENDOR bringing animals as part of its business, organization, exhibit, demonstration, rescue, or activity, must maintain commercial general liability insurance.
    • Such VENDORS must provide a current ACORD 25 Certificate of Liability Insurance naming the Kenmore Village Improvement Society (KVIS) and the Village of Kenmore, its employees, agents, and officials as additional insureds.
    • The ACORD 25 Certificate of Liability Insurance must be submitted with the vendor application. Applications requiring proof of insurance will not be considered complete until the certificate has been received.

    Cleanup

    • The VENDOR is responsible for maintaining its booth area in a clean, orderly, and safe condition throughout the event.
      Upon departure, the VENDOR shall remove all merchandise, equipment, signs, decorations, trash, and other materials from the assigned area.

    Emergency Reporting

    • The VENDOR shall immediately report any accident, injury, fire, hazardous condition, lost child, aggressive animal, or other emergency occurring within or near its booth area to event organizers.
    • The VENDOR agrees to comply promptly with directions from KVIS staff, volunteers, law enforcement officers, firefighters, EMS personnel, and other emergency responders.

    C. GENERAL TERMS AND JOINT RESPONSIBILITIES

    • Booth placement, event layout, and sales locations are at the sole discretion of KVIS.
    • KVIS and the VENDOR act as independent contractors. Nothing in this agreement shall be construed as creating an employer-employee relationship, partnership, joint venture, agency relationship, or other business association between the parties.
    • The VENDOR, including its owners, employees, volunteers, agents, affiliates, and subsidiaries, agrees to defend, indemnify, and hold harmless KVIS and its officers, directors, members, volunteers, employees, agents, sponsors, and representatives from and against any claims, liabilities, damages, losses, costs, expenses, or reasonable attorney fees arising from the VENDOR'S participation in the event, except to the extent caused by the sole negligence or intentional misconduct of KVIS.
    • KVIS reserves the right to require the removal of any display, activity, product, service, animal, equipment, or VENDOR deemed unsafe, unlawful, disruptive, offensive, inconsistent with the family-friendly nature of the event, or otherwise contrary to the mission or interests of KVIS. No refund shall be issued in such cases.
    • KVIS reserves the right to prohibit the sale, display, or promotion of any product, service, material, or activity deemed unsafe, unlawful, offensive, inappropriate, or inconsistent with the event.
    • Submission of this application constitutes a commitment to participate. Full payment for vendor space must accompany this signed contract. No refunds will be issued.
    • The event will proceed rain or shine unless conditions are determined by KVIS to be unsafe.
    • KVIS shall not be liable for delays, cancellations, postponements, modifications, or interruptions caused by circumstances beyond its reasonable control, including but not limited to severe weather, natural disasters, government actions, public health emergencies, utility failures, labor disputes, acts of God, or other unforeseen events.
    • KVIS and Dog Days of Kenmore organizers shall not be liable for claims, losses, damages, expenses, lost profits, or other costs arising from event cancellation, postponement, venue unavailability, relocation, or modification. Organizers may, at their sole discretion, issue partial refunds but shall have no obligation to do so.
    • If the event must be postponed, relocated, rearranged, or modified, this agreement shall remain in effect except for such reasonable changes as may be necessary, including changes to booth size, placement, scheduling, or event layout.
    • Security services are not provided for individual booth spaces. The VENDOR is solely responsible for safeguarding its property, merchandise, equipment, and personal belongings.
    • The use of the KVIS name, Dog Days of Kenmore name, logos, trademarks, or other branding elements on displays, signs, giveaways, advertisements, social media posts, or promotional materials requires prior written approval from KVIS. All design concepts and promotional materials utilizing such branding must be reviewed and approved before production or distribution.
    • The VENDOR grants KVIS permission to photograph, record, and otherwise capture images of the VENDOR, booth, products, representatives, employees, volunteers, displays, and activities during the event for promotional, educational, fundraising, archival, and other lawful purposes without compensation.
    • The VENDOR agrees to comply with all event rules, policies, procedures, and instructions issued by KVIS before or during the event.

    D. ACKNOWLEDGEMENT

    By signing below, the VENDOR acknowledges that it has read, understood, and agrees to comply with all terms and conditions contained in this agreement and any event rules subsequently provided by KVIS.
