WORKCOVER NSW & OHS REGULATIONS
In accordance with the requirements of Workcover NSW and OHS & Regulations 2001 all electrical leads and appliances must be tested and tagged according to AS/NZS3760. All exhibitors, competitors, and all side show alley participants must adhere to the above requirement. It is also required that portable RCD (Residual Current Device) units are provided to ensure that above regulations are followed. The Albury Show Society Inc. is deemed a workplace according to the act; therefore, all regulations must be adhered to. Further to the above all side show alley participants are reminded of their responsibilities according to the Work Health and Safety Act 2011 OH&S Regulations Act 2001 and AS/NZA3002:2002 shows and carnivals, AS3533. Appropriate testing and tagging of all electrical cables should be carried out before arriving at the Showground. Please note that Albury Show Society Inc. will close the activity on any site and cause the site to be vacated if the site holder or any person acting on his/her behalf:
Supplies any item on the list of banned items;
Engages in deceptive or fraudulent conduct;
Behaves abusively, offensively or aggressively towards any other person on the Showground.
ADVERSE WEATHER CONDITIONS
The Albury Show is an all-weather event and site holders must be prepared for adverse weather conditions. No refund will be paid. The Albury Show Society will not be responsible for any loss, damage or injury whatsoever due to adverse conditions.
PRODUCTS FOR SALE
Stallholders are not permitted to sell any item/items deemed by the Albury Show Society Management to be offensive, illegal or prohibited. The site holder is responsible for ensuring all products comply with relevant Australian federal, state and local safety and compliance standards fit for purpose.

Toy Guns are acceptable; however, the following are NOT:
· Ball Bearing Guns
· Eight Shot Caps
· Pellet Guns
· Pop Downs (Throw Downs)
· Potato Guns (Bullet Type)
· Roll Caps
· Strip Caps
· Water Pistols over 150mm (6”)
Samurai Swords, English Swords and Fencing Swords are to be sold in Sealed Packages by Licensed Traders ONLY
FOOD STALLS
It is the site holder’s responsibility to apply to the Albury City’s Council Environmental Health Office, obtain and pay any registration required to trade as a food stall at the Albury Show. Stallholders must supply copies of registration to the Albury Show Society Management prior to trading and also have all necessary documentation with them on the day.
Food stallholders must comply with any local / state / federal health regulations and food acts. The Albury Show Society holds no responsibility for loss of trade if proper documentation is not held. Stallholders selling food are subject to the Albury Show Society Management approval.
Stallholders selling alcohol are prohibited. Failure to comply this condition will result in an immediate closure of a stall.
As a responsible Stallholder, please acknowledge our request:
· To reduce packaging or use recycled or recyclable packaging
· To promote the disposal of all waste in an environmentally friendly manner
· To encourage patrons to use reusable bags by limiting the availability of plastic bags to customers.
All electrical equipment and leads must be tested and tagged in compliance with relevant workplace regulations.
Gas appliances are prohibited to be used by site holders without written approval from Albury Show Society Management.
SITE HOLDER INDEMNITY
Without limiting the generality of any other provisions contained in these Terms & Conditions, the site holder hereby indemnifies and holds Albury Show Society Inc. harmless from and against all claims for loss arising in connection with or in relation to:
a) The site holder’s occupation of the show;
b) The sale or attempted sale of the products approved by the Albury Show Society Inc. Management, or any other products and services;
c) Any injury or harm suffered by the Stall holder, its agents or employees;
d) Any injury or harm caused to any property or suffered by any person as a direct or indirect consequence, in whole or part of any act or omission by the Site holder;
e) Any loss or damage to the Site holder’s property regardless of the cause of that loss or damage;
f) The death of any person as a consequence, in whole or in part, of any act of omission by the Site holder;
g) Any breach of these Terms and Conditions by the Site holder;
h) Any legal costs in a full indemnity basis incurred by Albury Show Society as a result of the Site holder’s breach of these Terms and Conditions;
i) Theft or damage of products, equipment or goods under the control of the site holder;
j) Any journey by the Site holder to and from the Show; or
k) Damage or injury to any property or person.
ALCOHOL & DRUGS POLICY
a) All traders and staff and any authorised persons using the Showground are to be below the legal BAC (Blood Alcohol Concentration) whilst on showground site.
b) The Society will not allow alcohol to be provided to its patrons, by its traders to their patrons, or by other persons, not so licensed or authorised.
c) Under no circumstances is a trader to consume alcohol.
d) The Society requires all traders and any persons using the Showground to take all possible care for their own safety and wellbeing and the safety and wellbeing of all others and to comply with the requirements of this policy.
e) The Society recognises that its awareness of any trader or trader employee, or authorised persons using Showground property drinking or drugs status/problem places it under a positive duty to take all reasonable precautions to remove the affected person from reasonable foreseeable accident situations while maintaining the highest degree of confidentiality.
f) The Society does not condone the excessive use of any drug, prescribed or legal, and will not accept the use of illegal drugs or the excessive use of prescribed or legal drugs.
g) Any person so affected and engaged in performing trader duty on or within Society property will be asked to leave showground and will nullify their participation at event.
PAYMENT
Payment must be received and cleared by invoice due day to confirm site.
Parking – Limited parking is available for site holders. Please ensure that site holder requests authorisation from Management prior event. Wristbands- two (2) x worker’s wristbands for entry to the Show will be provided. Additional worker’s wristbands can be purchased at a fee of $10.00 each. All prices quoted are exclusive of GST.
Upon approval of application/s; payment is due and payable.

TERMS AND CONDITIONS
Site holders must not cause damage, make alterations or additions, of any nature to, or carry out works of any nature to the show site property, and that, if any damage is caused, the costs of any repairs, making good or replacement are borne by the Site holder.
The Site holder acknowledges and agrees that Albury Show Society Management makes no warranty or representation in relation to or in connection with the site holder’s occupation or use of the show.
Without limiting the generality of this clause, the Site holder acknowledges and agrees that the Albury Show Society has made no warranty or representation to or in connection with:
· The prospects of the Site holder for selling products at the Show;
The Site holder’s access to people visiting the Show or the access those people have to the Site holder;
· The existence or number of products that will compete with the products for the attention of the prospective buyers;
· The existence or extent of services and/or facilities of any kind at the Show;
· The position within the Show that each site holder will occupy;
· The suitability of the Show for any particular purpose or the existence of any latent or patent defect at the Show;
· The extent, if any, to which other visitors to the Show might interfere with the Site holder’s use of the Show;
· The existence or extent of any advertising or promotional activity or material that may or may not be published or undertaken by the Albury Show Society Management;
· The existence or extent of any security measures undertaken to protect the Site holder, the Products and/or the Show against criminal
activity; or
· The existence or extent of any security at the Show.
Any site holders who do not adhere to these terms and conditions may forfeit any future rights to participate at the Albury Show, regardless of any monies paid.
