Online Training Membership Agreement
Program Description:
The Choice Lyfestyle Online Training Program is designed to provide individualized coaching, accountability, and performance development through an online platform.
Program benefits may include:
- Individualized training programs
- Strength and conditioning programming
- Athletic performance development
- Adult fitness programming
- Exercise video demonstrations
- Progress tracking
- Program modifications as needed
- Coach support and communication
- Performance testing recommendations
- Accountability and coaching guidance
- Access to training through widget based application or designated coaching platform
Choice Lyfestyle LLC reserves the right to modify programming structure and delivery methods as necessary to improve client experience and results.
Client Responsibilities:
Client agrees to:
- Complete all intake forms honestly and accurately
- Communicate any injuries, illnesses, limitations, or health concerns immediately
- Follow prescribed workouts and instructions to the best of their ability
- Perform exercises safely and responsibly
- Maintain communication regarding progress and concerns
- Obtain medical clearance when appropriate
- Use proper judgment when participating in physical activity
- Client understands that results depend on consistency, effort, nutrition, recovery, compliance, and factors outside the Coach's control.
No specific results are guaranteed.
Coach Responsibilities:
Choice Lyfestyle LLC agrees to:
- Provide individualized programming based on information supplied by Client
- Review training progress and make adjustments when appropriate
- Provide reasonable support and communication throughout the coaching relationship
- Deliver coaching services professionally and ethically
- Coach response times may vary but generally occur within 24–48 business hours.
Payment Terms:
Membership Fee: $299/ $249/ $229 per month or PIF ($747 or $1,374)
Billing Cycle: Recurring monthly payment every 30 days.
Client authorizes Choice Lyfestyle LLC and its payment processor to automatically charge the payment method on file according to the selected membership plan.
Failure to maintain an active payment method may result in suspension of coaching services and access to programming.
Commitment Term:
Client agrees to remain enrolled for the selected commitment period:
3-Month Membership
Minimum commitment of three (3) consecutive months.
6-Month Membership
Minimum commitment of six (6) consecutive months.
Month-Month Membership: client can cancel with no commitment required.
Client remains financially responsible for all payments due during the selected commitment period.
Cancellation Policy:
Cancellation requests must be submitted in writing via email.
Cancellation requests received before the completion of the selected commitment period do not release Client from financial responsibility for remaining payments owed under this Agreement.
Upon completion of the selected commitment period, Client may cancel future billing by providing written notice at least seven (7) days before the next scheduled payment date.
NO REFUND POLICY
Due to the digital nature of online coaching services and immediate access to proprietary training programs:
ALL SALES ARE FINAL.
No refunds, partial refunds, credits, chargebacks, or transfers will be issued after programming, coaching services, or digital materials have been delivered.
Client acknowledges that coaching time, program design, and intellectual property are provided immediately upon enrollment.
ASSUMPTION OF RISK
Client understands that participation in exercise, strength training, conditioning, sports performance training, and physical activity involves inherent risks including, but not limited to:
- Muscle strains
- Sprains
- Falls
- Cardiovascular events
- Illness
- Permanent disability
- Death
- Client voluntarily assumes all risks associated with participation.
RELEASE OF LIABILITY
To the fullest extent permitted by law, Client releases and discharges Choice Lyfestyle LLC, its owners, coaches, employees, contractors, and affiliates from any and all claims, liabilities, demands, damages, losses, costs, or causes of action arising from participation in the program.
Client agrees to hold harmless and indemnify Choice Lyfestyle LLC against any claims arising from participation in training activities.
INTELLECTUAL PROPERTY
All programming, documents, videos, educational materials, assessments, and coaching resources provided by Choice Lyfestyle LLC remain the intellectual property of Choice Lyfestyle LLC.
Client may not reproduce, distribute, share, sell, copy, or transfer materials to another individual without written permission.
GOVERNING LAW
This Agreement shall be governed by and interpreted under the laws of the Commonwealth of Virginia.
ACKNOWLEDGMENT
By signing below, Client acknowledges that they have read, understood, and voluntarily agree to all terms and conditions outlined in this Agreement.
