Waiver and Release of Liability

BY PARTICIPATING IN THIS EVENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS. PLEASE READ CAREFULLY:

I, the undersigned participant, do hereby acknowledge, understand, and agree that my participation in the NAAM HOUSE INITIATIVE, INC. Annual "Chat & Chew" Veteran Picnic on July 16, 2026, held within Central Park, New York, NY—including but not limited to any physical activities, stretching, yoga, guided meditation, sound bathing, and the consumption of provided food and beverages (collectively, the "Activities")—is entirely voluntary.

I fully understand that these Activities may involve inherent risks of property damage, personal injury, illness, or severe psychological or physical stress. I knowingly, freely, and voluntarily assume all such risks, both known and unknown, associated with my participation in this event, even if arising from the negligence of the releasees or others, and assume full responsibility for my participation.

I, for myself, my heirs, executors, administrators, assigns, and next of kin, hereby release, waive, covenant not to sue, and forever discharge NAAM HOUSE INITIATIVE, INC., its officers, directors, employees, volunteers, agents, sponsors, vendors, independent contractors (including wellness and yoga instructors), and the City of New York, its Department of Parks and Recreation, and the Department of Veterans' Services (collectively, the "Released Parties"), from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the active or passive negligence of the Released Parties or otherwise, while participating in, traveling to or from, or present at the location of the Activities.

I further agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney fees, that they may incur due to my participation in said Activities. This Waiver and Release shall be governed by, and construed in accordance with, the laws of the State of New York, without regard to principles of conflicts of law. If any portion of this release is found to be invalid or unenforceable under New York law, the remaining portions shall continue in full force and effect.

By attending and engaging in this event, I acknowledge that I have read this document in its entirety, understand that I am giving up substantial legal rights by signing or participating, and do so freely and voluntarily without any inducement.

Media, Photography, and Testimonial Consent and Release

PLEASE READ CAREFULLY BEFORE ASSENTING:

For valuable consideration received, I hereby grant to NAAM HOUSE INITIATIVE, INC., its legal representatives, successors, assigns, and those acting with its authority (collectively, the "Organization"), the absolute, irrevocable, and unrestricted right and worldwide permission to take, use, reuse, publish, and republish photographic portraits, pictures, digital images, videotapes, audio recordings, and/or written or verbal testimonials of me, or in which I may be included, in whole or in part, without restriction as to changes or alterations.

This consent includes, but is not limited to, the use of my name, image, likeness, voice, and testimonials in any and all media forms now or hereafter known, including the Organization's websites, social media accounts (e.g., Facebook, Instagram, LinkedIn), newsletters, press releases, grant applications, promotional brochures, and any other educational or marketing materials designed to promote the Organization’s programs and services.

I hereby acknowledge and agree to the following terms:

No Compensation: I understand and agree that I will receive no monetary compensation, royalties, or residual payments for the taking or use of these media materials or testimonials.
Right of Inspection: I waive any right that I may have to inspect or approve the finished product, the advertising copy, or any printed/digital matter that may be used in connection with my likeness or testimonial.
Ownership: I acknowledge and agree that all digital files, photographs, negatives, video footage, and audio recordings are the sole and exclusive property of the Organization.
Release of Claims: I hereby release, discharge, and agree to hold harmless the Organization, its officers, directors, board members, employees, volunteers, and legal representatives from any and all claims, demands, liabilities, actions, or causes of action arising out of or in connection with the use of said media, including but not limited to any claims for defamation, invasion of privacy, right of publicity, or copyright infringement under New York State or federal law.
I represent that I am at least 18 years of age and have the full legal capacity to execute this release. I acknowledge that I have read this document in its entirety, understand its legal implications under New York law, and freely give my consent.
