CANICROSSPH LIABILITY WAIVER & RELEASE

By signing or clicking "I Agree," I acknowledge that I have read, understood, and voluntarily agree to the terms of this Waiver. I understand that I am giving up certain legal rights, including the right to bring certain claims against the Released Parties. This waiver applies to the primary registrant as well as all additional participants and dogs included under this registration form.
1. Assumption of Risk
I understand that Canicross is a physically demanding outdoor activity involving inherent and unpredictable risks. These risks include, but are not limited to: severe falls, slips, collisions with other participants or dogs, rough or uneven trail terrain, extreme weather conditions (such as heat, high humidity, or sudden temperature drops), equipment failure, dehydration, illness, and dog-related incidents including bites, scratches, or fights. I voluntarily, knowingly, and expressly assume all known and unknown risks associated with my participation and that of my dog(s), accepting that participation could result in serious injury, permanent disability, or death.
2. Health Declaration & Participant Conduct
Age Restriction: I certify that I am at least eighteen (18) years of age.
Medical Fitness: I explicitly certify that I am healthy, not suffering from any illness or contagious sickness, and medically fit to participate in this event. I further certify that all participants registered under my form are properly trained and similarly fit. I will immediately withdraw myself or my dog if continuing would endanger anyone.
First Aid Acknowledgement: I understand that basic first aid personnel will be available on-site to cover initial emergency care. However, I assume ultimate financial and legal responsibility for any secondary medical treatment, transport, or hospitalization.
Substance Ban: The use of illegal drugs or performance-impairing substances is strictly prohibited. Any participant under the influence of alcohol, drugs, or any substance that compromises safety will be immediately barred from racing and removed from the venue without a refund.
3. Event Rules, Conduct & Disqualification
Compliance: I agree to comply with all event rules, safety protocols, course markings, and the lawful instructions of race officials and volunteers.
Zero Tolerance Code of Conduct: Organizers reserve the absolute authority to immediately remove and disqualify any participant from the venue, without a refund, for:
Abusive, threatening, or vulgar language directed at staff, volunteers, or other racers.
Unsportsmanlike conduct or intentional obstruction of other participants.
Harassment of any kind, theft, or bullying.
Refusal to obey direct safety orders from event officials.
4. Dog Health, Safety, and Responsibility
Age and Leash Requirements: Anyone handling a dog during the event must be at least eighteen (18) years old. Off-leash dogs are strictly prohibited. Dogs must remain on a maximum 6-foot leash (or a designated, sport-specific Canicross line) at all times across all event areas. Failure to comply results in immediate disqualification and removal.
Clean As You Go (Poop & Scoop): "Clean As You Go." When your dog poops, you must scoop it immediately. It is the sole responsibility of the handler to clean up after their dog across all areas of the venue. Receptacles will be provided for proper disposal.
Inspections and Aggression: Dogs must be social and friendly toward humans and other dogs. Event organizers reserve the express authority to inspect any dog at any time, refuse participation before the race, or remove/isolate any dog at any point if it exhibits aggression, severe stress, fear, or becomes unmanageable.
Vaccinations & Restrictions: I certify that my dog is healthy, properly conditioned, non-vicious, free from contagious disease, and fully up-to-date on its rabies vaccination.
❌ Prohibited: Female dogs in heat and puppies under 12 months old are strictly banned from the venue.
⚠️ Restricted: Unneutered male dogs require constant, close supervision at all times.
⚠️ Brachycephalic Breeds (High Risk): I acknowledge that short-nosed breeds (e.g., Bulldogs, French Bulldogs, Pugs, Boston Terriers, Shih Tzus) face elevated risks of breathing difficulties and overheating. Participating with a brachycephalic dog is entirely at my own risk. Event officials reserve the absolute right to pull any dog from the course showing signs of respiratory distress.
Liability & Refunds: I accept full and exclusive liability for any injury, dog fight, or property damage caused by myself, my dog, or members of my party. If I or my dog are asked to leave due to behavioral, leash, or safety violations, no refund will be issued.
5. Release of Liability
To the fullest extent permitted by Philippine law, I, for myself, my belongings, heirs, administrators, personal representatives, and assigns, hereby release, waive, acquit, and forever discharge CanicrossPH, Driftwoods Action Park, the property owners, event coordinators, officers, directors, employees, volunteers, sponsors, contractors, medical responders, and all persons acting on their behalf ("Released Parties") from any and all claims, demands, liabilities, damages, or causes of action arising out of or relating to my participation in the event, including claims arising from ordinary negligence. This release does not apply to gross negligence, willful misconduct, or intentional acts.
6. Medical Authorization
If I or a member of my registered party become injured or incapacitated during the event, I authorize the organizers to obtain emergency medical assistance on our behalf. I understand that I am solely responsible for all resulting medical expenses, transport costs, and treatment fees, and that the organizers do not provide personal medical or accident insurance.
7. Indemnity
I agree to indemnify, defend, and hold harmless the Released Parties against any and all third-party claims, liabilities, damages, losses, costs, or reasonable attorney's fees arising directly or indirectly from my conduct, my dog's conduct, the actions of anyone included in my registration, or my breach of this Agreement.
8. Media Consent
I grant the organizers full permission to photograph, film, or record me, my registered group, and my dog during the event, and to use such materials for promotional, educational, marketing, or commercial purposes across any media platform without further compensation or notification.
9. Event Changes & Alteration Policy (Force Majeure)
The organizers reserve the right to modify, postpone, shorten, reroute, suspend, or cancel the event whenever necessary for safety, weather, or other circumstances beyond their reasonable control. If the event is postponed due to force majeure, my registration may be transferred to the rescheduled event in accordance with the organizers' policies.
10. Governing Law & Severability
This Agreement shall be governed by the laws of the Republic of the Philippines. If any provision is held invalid, the remaining provisions shall continue in full force and effect.
Participant's Declaration
I acknowledge that I have carefully read this Waiver, fully understand its legal contents, have had sufficient opportunity to ask questions, and voluntarily agree to be legally bound by its terms. By completing this registration form and paying the required fees, I acknowledge and agree that my registration fee is 100% non-refundable.
