Liability Waiver Form

LIABILITY WAIVER, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT ABN: 35 843 059 484

This Liability Waiver forms part of the agreement between the Hirer and Taio’s Softplay Hire. By signing this document, You acknowledge that You have read, understood, and agree to be bound by the Terms and Conditions of Hire.

I agree that:

1. I am responsible for ensuring that all children using the Equipment are appropriately supervised at all times by a responsible adult aged 18 years or older, in accordance with the supervision ratios in Clause 4 of the Terms and Conditions (1 adult per 2 children aged 0–2; 1 adult per 4 children aged 3–6).

2. I will comply with all supervision, safety, and operational requirements outlined in the Terms and Conditions.

3. I will ensure that only children aged 0–6 years use the Equipment. Children over 6 years are strictly prohibited.

4. I will ensure that all users follow the Rules of Play and safety requirements.

5. I will immediately stop any unsafe behaviour and remove any child engaging in dangerous conduct.

6. I will not allow the Equipment to be used in wet conditions, rain, storms, high winds, or temperatures over 38°C, or contrary to the Terms and Conditions (including Clauses 3.5 and 6). Outdoor use is only permitted in fully covered/sheltered areas on hard, level surfaces.

7. I confirm I have a satisfactory wet weather Plan B (indoor or fully covered area) and will move the Equipment there immediately if weather conditions become unsuitable.

To the fullest extent permitted by law, I release and discharge Taio’s Softplay Hire, its owners, employees, contractors, agents, and representatives from any liability, claim, demand, action, loss, damage, injury, cost, or expense arising from or connected with:

• The use of the Equipment;

• Failure to adequately supervise children;

• Misuse of the Equipment;

• Breach of the Terms and Conditions;

• Acts or omissions of the Hirer, guests, parents, guardians, or attendees.

This release does not exclude any rights that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

I agree to indemnify and hold harmless Taio’s Softplay Hire, its owners, employees, contractors, and representatives against any claims, demands, actions, losses, damages, costs, legal expenses, or liabilities arising from:

• Injury to any participant, guest, parent, guardian, or third party;

• Damage to property;

• Failure to comply with the Terms and Conditions;

• Negligent supervision;

• Misuse of the Equipment;

• Any act or omission by me or persons attending the event.

I acknowledge that:

• A refundable security bond of $200 applies to the hire.

• I am responsible for any damage, loss, theft, contamination, or excessive cleaning required beyond fair wear and tear (as detailed in Clause 7.1 of the Terms and Conditions).

• Costs may be deducted from the bond.

• If costs exceed the bond amount, I agree to pay the additional amount upon request.

I agree to:

• Prevent visibly unwell children from using the Equipment.

• Notify Taio’s Softplay Hire within 24–48 hours if any child who used the Equipment develops symptoms of a contagious illness, vomiting, diarrhoea, or other gastrointestinal illness (Clause 10).

• Immediately report any contamination including vomit, blood, urine, or faeces.

I declare that:

• I am at least 18 years of age.

• I have read and understood this Liability Waiver and the full Terms and Conditions of Hire.

• I understand that payment of the deposit and signing this form constitute acceptance of the Terms and Conditions.

• I understand that this signed Liability Waiver must be received by Taio’s Softplay Hire no later than 7 days prior to the event date (or immediately for bookings made within 7 days). Failure to provide it may result in cancellation of the booking without refund (Clause 15).

Terms and Conditions

If rain, storms, or unsuitable weather occurs, the Equipment will be moved to (Plan B Location):

I understand and agree that:

• Softplay is dry hire only - no water, moisture, or wet conditions are permitted. 
• I must move all Equipment according to Wet Weather Plan B location immediately if rain or unsuitable weather starts.
• Taio's softpaly hire will determine if plan B location is satisfactory.
• I am responsible for any damage, contamination, or extra cleaning caused by moisture.
• Without Satisfactory plan submitted on time, Taio's Softplay Hire may refuse outdoor set up.
