Release/Waiver of Liability, Assumption of Risk and Indemnity Agreement: I have read this document, and I am signing it freely. I understand the legal consequences of signing this document, including

a) releasing the YMCA of Southwestern New Brunswick, their employees, officers, volunteers and agents from all liability including claims of the YMCA of Southwestern New Brunswick's negligence, resulting in any physical injury, illness (including death) or economic loss on my and the Participant's behalf,

b) agreeing to hold YMCA of Greater Saint John Inc. harmless from my and the Participants' right to any and all claims, losses or damages, causes of action, actions or demands as a result of participation in this Activity,

c) and voluntarily assuming all risks of Participant's participation in this Activity, whether known or unknown to me. Understanding that there are risks associated with the Participant participating in this Activity, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from my own actions or other's actions, inactions, or negligence, or the condition of the activity location(s) or facilities.

d) I represent that the Participants' is in good health and suffer from no physical impairment that would prevent the use of YMCA facilities.

1. No Fighting or roughhousing

2. Listen to All YMCA Staff & Volunteers

3.Appropriate clothing must be worn while using the facility

4. A swim test must be completed to access the waterpark

5. No sneaking non-members into the Waterpark

6. No Harassment, vulgarity, or intimidation by words, body language, or behaviour.

7. No Theft or behaviour that results in the destruction of property

8. Lifejackets must be worn at all times while using the Waterpark

9. Anyone under the age of 12+ Must be accompanied by an adult who is in the water.

By signing this Form, you are consenting to the taking of photographs and/or video recordings by the YMCA for the Purposes; you are assigning to the YMCA, and waiving any rights you have related to any such photographs and/or video recordings. You are consenting to the use of any such photographs and/or video recordings, in whole or in part, by the YMCA for any Purpose. For valuable consideration received but without any promise of remuneration, I hereby agree to allow photographs and/or video recordings to be taken of me, whether posed or candid, while I am on YMCA property and/or participating in YMCA activities or events. To be reproduced, published, displayed, broadcast, transmitted, licensed, sublicensed or otherwise used by the YMCA or any Authorized Third Party in connection with the Purposes, including without limitation on YMCA internet websites, in YMCA printed materials, or in any other materials or medium whatsoever and wherever (the "Work Product"). I confirm that neither the YMCA nor any Authorized Third Party shall be obligated to use the Work Product.

If signing on behalf of a participant.

I allow the Participant to participate in this Activity. I understand that I am responsible for the obligations and acts of the Participant as described in this document. I agree to be bound by the terms of this document.
