I. NOTICE OF PRIVATE STATUS
This document constitutes a private contractual covenant entered into voluntarily between the undersigned Member and Sweet Mother Earth, a Private Membership Association formed by right of private association and expression under the First Amendment to the Constitution of the United States, and protected under the laws of the California, operating outside the District of Columbia and outside any political or legislative post or position.
Membership is not open to the general public.
II. ACKNOWLEDGMENT OF RIGHTS & AUTHORITIES
The Member affirms and acknowledges:
The right to freedom of association, freedom of speech, and free exercise of religion (U.S. Const. amend. I).
That private associations are protected from compulsory disclosure and regulation (NAACP v. Alabama, 357 U.S. 449).
That religious and spiritual ceremonies are protected expressive conduct (Church of the Lukumi Babalu Aye v. City of Hialeah, 508 U.S. 520).
That participation is governed by private contract, not public statute, pursuant to California Civil Code §§ 1550–1599.
III. PRIVATE MEMBERSHIP TERMS
By signing this covenant, the Member agrees that:
Membership is voluntary and revocable
No services are offered to or accepted from the general public
All activities occur within private jurisdiction
All gatherings, ceremonies, and rites are private, consensual, and member-only
No member acts as an agent of the State or any political subdivision
IV. ASSUMPTION OF RISK & LIABILITY WAIVER
The Member knowingly and voluntarily:
Assumes all risks associated with participation in:
Spiritual ceremonies
Cultural or ancestral rites
Plant-based ceremonial practices (where applicable)
Educational or ministerial gatherings
Waives any and all claims against:
Sweet Mother Earth
Its ministers, facilitators, elders, or members
Its trustees or coordinators
Including claims known or unknown, pursuant to California Civil Code § 1542, which the Member expressly waives.
V. NO MEDICAL OR LEGAL REPRESENTATION
The Member acknowledges:
No medical diagnosis or treatment is provided
No legal advice is rendered
Participation is not a substitute for licensed medical, legal, or emergency services
All actions are undertaken by informed consent
VI. CONFIDENTIALITY & PRIVACY
The Member agrees:
Not to disclose private matters, ceremonies, or membership information
That membership records are confidential and protected
That disclosure without consent constitutes a breach of private contract
VII. NON-PUBLIC ACCOMMODATION DECLARATION
The Member acknowledges that Sweet Mother Earth:
Is not a public accommodation
Does not operate under civil rights public access statutes
Exists by private covenant only
Admits members by invitation and consent alone
VIII. SEVERABILITY
If any provision is held unenforceable, the remainder of this Covenant remains in full force and effect.
IX. ACCEPTANCE & EXECUTION
By signing below, the Member affirms they are:
Of lawful age
Of sound mind
Acting without coercion
Entering into this Covenant knowingly and voluntarily
