Facility Hire
The Shire reserves the right to:
- refuse any application to hire; or
- cancel or alter the booking at any time.
Application for hire of a venue must be made on the online form located on Leschenault Leisure Centre's website and be completed by a person over the age of 18 years who will be responsible for payment of fees and any other charges arising from the booking, and for the observance of these conditions of hire.
Amendment of Hire Conditions
Hirers are advised that these conditions of hire may be amended by the Shire without notice at any time. Notwithstanding this, when conditions are amended every effort will be made to inform all hirers.
Bookings and Payment
All fees are charged in accordance with the Shire of Harvey's adopted fees and charges
All bookings must be confirmed prior to use.
Full payment is required prior to the booking unless otherwise arranged.
Cancellation Policy
Less than 5 days notice of intent to cancel = no refund
More than 5 days notice of intent to cancel = 25% of cost of total booking fee will apply
Use of Venue/Access
All functions are to be finished by your booked time and premises vacated (including all hirers equipment) unless otherwise arranged
The venue is to be used only for the approved purpose and within the allocated booking times, including set-up and pack-down.
The hirer is responsible for ensuring the room is left clean, tidy, and in the same condition as found.
Upon vacating the premises to ensure all gates, doors to buildings, power boxes are all locked.
Information about keys and access codes will be provided when your booking is confirmed
Damage
The hirer is responsible for any damage to the room, equipment or facilities caused during the hire period through misuse or negligence.
Any damage or maintenance issues must be reported to Centre staff as soon as practicable.
Behaviour
It is the responsibility of the hirer to ensure that no person behaves in a disorderly manner or causes a nuisance or annoyance. The hirer must ensure order of guests and that descent behaviour is maintained inside and outside the area (e.g. in car park and surrounding areas) before, during and after the function. If police are called to maintain order or disperse a disorderly crowd, the bond may be forfeited.
The hirer shall not conduct or permit any activity that would cause excessive noise or create a nuisance to any other person in the area. Use of amplification systems is at the Shire’s discretion. The hirer will comply with any reasonable request by any person to mitigate any such nuisance.
Prompt departure from the premises is expected by the specified time and in a quiet manner in consideration of neighbours.
Smoking
All Shire facilities are strictly non-smoking and the hirer shall undertake responsibility to enforce this.
Alcohol
If alcohol is to be consumed during the hire, written permission from the Shire must be given prior to the function.
Hirers selling liquor at a bar or by way of inclusion in ticketing costs, require a liquor licence and are to complete an Application-Permit to Consume Alcohol on Shire Property with the Shire.
It is the responsibility of the hirer to ensure compliance with liquor licensing legislation.
Food and Beverage
Food and non-alcoholic beverages may be consumed in the meeting room unless otherwise advised. The hirer is responsible for all cleaning and waste removal.
Any catering must comply with relevant food safety requirements.
Equipment
Any Shire equipment used must be operated appropriately and left in good condition.
Hirers must not bring in electrical equipment unless it is safe, compliant, and in good working order.
Security
The hirer is responsible for the security of the room during the hire period and must follow all instructions provided by staff when entering and leaving the facility.
Emergencies
The hirer will give effect to any reasonable direction of a designated Shire officer, where such direction has the intention of dealing with an emergency or preventing a foreseeable accident or loss. Where no Shire officer is present, the hirer shall undertake responsibility to respond to an emergency by clearing the area, contacting emergency services and minimising the hazard as appropriate and safe to do so.
Liability and Insurance
The Shire of Harvey Insurers do not provide Public Liability coverage for any person or group of persons that are an Association, Corporation, Sporting Body, Club, Business or Incorporate Body who hire a Shire facility.
If required by the Shire, hirers shall provide public liability insurance coverage with a minimum cover of $20 million to protect their group from any damage or injury that may occur. When required, evidence of Public Liability cover must be provided prior to commencement of hire.
All liability of loss or damage to property or persons during the hire of Shire premises is the responsibility of the hirer.
The Shire shall not accept liability for any damage, illness or injury caused or found to be caused to any person or property as a result of acts or omissions of the hirer, guests, invitees, or persons under their control.
The Shire is indemnified against any claim, loss or expense which may be made or arise as a result of the use of the hired premises.
Acceptance
By proceeding with a booking, the hirer acknowledges and agrees to these Terms and Conditions.
