Nobility in Action ("NIA"), a Texas nonprofit corporation, offers opportunities to participate in some of its activities and operations (the "Activities"). By signing this Waiver and Release of Liability Agreement (the "Agreement"), and in consideration of the opportunity to participate in activities at NIA, I, on behalf of myself or my minor child, agree to the terms below.

This is a legal document. Please read it carefully. By signing below, you are agreeing to the statements in this document on behalf of BOTH yourself and your minor child, if applicable. If you have questions, please ask them before signing.

For my safety and that of others, I/my child will comply with all NIA rules, directions, and training. I will tell NIA staff if I see any hazardous conditions or danger while engaging in the Activities or at an NIA site. I agree that I/my child will wear clothing and shoes appropriate for the Activities, utilize any protective gear made available to me by NIA, and treat all those present with respect and care.

I confirm that I am 18 years old or older (and any minors under my care who will be participating in the Activities meet NIA's minimum age requirements, if any). I understand that I am responsible for knowing my/my child's physical condition and making decisions about participation. I am aware of no physical or medical problem or condition that will limit or interfere with my/my child's ability to participate in the Activities under either predicted or emergency conditions. I also understand that medical attention may not be readily available. If at any time I/my child feel unable to comfortably participate, I/my child will stop.

I knowingly and voluntarily enter into this Agreement on behalf of myself and/or my minor child. I know and acknowledge that participation in the Activities can be a potentially dangerous activity and may involve moving, lifting, or handling moderately heavy or sharp items, exposure to an indoor or outdoor kitchen environment, limited physical touch by others to instruct and support safe and appropriate yoga or other movement activities, or other moderately strenuous physical activity related to yoga or movement classes. Participation in the Activities has risks that may arise from my own actions, or the actions of NIA or others present at the Activities' location(s). Such risks of participation may arise from the risks inherent to physical movement and exertion and from conditions at the location or outdoors, including heat, uneven terrain, allergens, insects, dust, noise, lack of lighting, weather, use of equipment, and unforeseen acts of third parties. I understand that participating potentially exposes me to these and other risks, including bodily injury, death, and property damage.

I understand and acknowledge the risks associated with the Activities. With such information and awareness, and with the recognition that other factors may create additional such risks, I knowingly, freely, and voluntarily, on behalf of myself and/or my minor child: (a) register for the Activities; (b) participate in the Activities; and (c) assume and accept the risks of all injury, death, property damage or loss, financial obligation, loss of privacy, loss of reputation, and all other injuries and other consequences, whether known or unknown, whether foreseen or unforeseeable, that may result, directly or indirectly, from my participation in the Activities, regardless of the cause.

On behalf of myself and any minor child under my care, I waive and release NIA and its directors, officers, agents, employees, volunteers and affiliates (collectively, "Released Parties"), from any and all liability, claims, costs, and damages of any kind which I or my heirs, next of kin or legal representatives may have or which may later accrue, resulting or arising directly or indirectly from (a) my participation in the Activities or presence at or travel to the site or (b) any first aid, transportation or medical care provided to me in connection with my participation. This Agreement includes, in each such case, all claims in respect of death, personal injury, illness, property damage, loss, financial obligation, or expenses, and in each case regardless of the cause or whether such claims arise from tort, contract or otherwise, and even if caused by negligence, whether passive or active. I agree not to sue any of the Released Parties on the basis of these waived and released claims.

I authorize NIA, in its sole and absolute discretion, to provide first aid and to arrange medical assistance, transportation, and emergency services for me or my child in the case of injury or illness during my participation in the Activities. I understand that I am solely responsible for any costs related to any and all medical treatment and transport.

NIA may take photos or videos of me/my child when participating in the Activities. I consent to the use by NIA of my/my child's image, voice, name or story in any format, including video, print, or electronic (collectively, "Materials"), to promote NIA's programs or for any other purposes. NIA may include the Materials on its website, in its publications, or through any other media, including social networking platforms. I waive any right to inspect or approve the finished product or to receive any payment. I grant to NIA all copyrights in the Materials and waive any legal claims relating to the Materials, including those relating to copyright or rights of publicity or privacy.

This Agreement will be legally binding not only on me but also on my heirs, next of kin, and legal representatives, and will run in favor of, and may be enforced by, each of the Released Parties. It will be binding to the fullest extent permitted by law.

If any provision of this Agreement is found to be illegal, invalid, or unenforceable, the remaining terms will be effective. This Agreement will be governed by Texas law.

By signing below, I acknowledge that I have thoroughly read and understand this Agreement. I also represent that the statements I have made in this Agreement are true and that I am at least 18 years of age; or, if I am younger than 18 years, that the signature and consent of my parent or legal guardian is included below. I have read this Agreement and fully understand that by signing this Agreement, I am giving up legal rights and/or remedies that may be available to me.
