    Bespoke Landscape Designs Ltd – Terms and Conditions (updated July 2025)

    By working with us, you can be confident that every stage of your project is supported by clear expectations and a professional, transparent approach.

    What this covers:

    How we handle payments and scheduling
    Your legal rights and cancellation options
    What to expect with start dates, delays, and site access
    How we manage changes, materials, guarantees, and media
    Responsibilities during and after works

    By accepting a quotation from Bespoke Landscape Designs Ltd ("The Company"), you ("You" – the Customer) confirm that you have read, understood, and agreed to these Terms and Conditions. Payment of the scheduling payment constitutes acceptance of these terms and acknowledges that this payment is non-refundable outside the 14-day cooling-off period as detailed below.

    1. Agreement to Terms

    By accepting the quotation, you authorise the Company to carry out the work outlined in the quotation and agree to pay all amounts due in full and on time.

    2. Payment Structure

    Our standard payment terms apply to all full garden installations and landscape projects (not repair works). All payments must be made in full and on time to secure scheduling, materials, and labour.

    2.1 Full Projects

    2.1.1 Scheduling Payment – 10%
    Payable upon acceptance of the quotation. This confirms your booking, secures your place in our schedule, and allows us to begin project planning.

    Note: This payment is non-refundable after the 14-day legal cooling-off period.

    2.1.2 Material / Pre-Start Payment – 40%
    Due approximately 2–4 weeks before your project is expected to start. This allows us to order materials, schedule equipment, and allocate your team. If your project includes special-order items or long-lead materials, this payment may be required sooner.

    Late payment may delay your project start.

    2.1.3 Final Payment – 50%
    Due on the day of project completion. Covers the remaining balance for all labour and materials. Interim payments may be requested for projects extending beyond a Friday or completed in phases.

    All materials remain the property of Bespoke Landscape Designs Ltd until full payment is received.

    2.2 Repair or Small Works

    These terms apply to repair works and smaller jobs (not full garden installations):

    2.2.1 Scheduling Payment – 30%
    Payable upon acceptance to confirm your booking and begin planning.

    2.2.2 Final Payment – 70%
    Due on the day of completion, covering the balance of labour and materials.

    All materials remain the property of Bespoke Landscape Designs Ltd until full payment is received.

    3. Right to Cancel (Cooling-Off Period)

    In accordance with the Consumer Contracts Regulations 2013, you have the legal right to cancel within 14 days of accepting the quotation.

    If no services have commenced, you are entitled to a full refund, including the scheduling payment.

    If work has started within the 14-day period, you’ll be charged for labour and materials to date.

    After 14 days, the scheduling payment is strictly non-refundable.

    4. Project Start Time

    Once you accept the quotation, we’ll provide an estimated timeframe. Around four weeks before your project, we’ll issue a provisional start date and material payment request.

    Please note: Start dates are not fixed until your project is next in line. Unpredictable factors (weather, overruns, seasonal load) may affect our schedule. We appreciate your flexibility.

    5. Material Price Changes

    Prices quoted are based on current supplier rates. Costs may change due to market fluctuations.

    5.1 If prices increase:

    We’ll inform you if materials cost more before ordering
    You must pay the difference before materials are ordered
    Late payment may delay your project

    5.2 Additional materials:

    If extra materials are needed (e.g. due to ground conditions), you will be notified
    These costs must be paid before further work continues
    We’re always transparent about additional charges and will confirm in writing.

    6. Access and Site Preparation

    You are responsible for ensuring that your site is safe, accessible, and ready before work begins.

    6.1 Before work starts:

    Clear obstructions (bins, toys, furniture, etc.)
    Move vehicles at least 2 metres away from the work area
    Unlock all gates and access points
    Provide working water and power sources (if required)

    6.2 If access is blocked or unsafe:

    £95 + VAT per hour waiting charge applies
    Work may be paused or rescheduled at our discretion
    Return visits or rebooking may incur additional costs
    Delays due to inaccessibility may affect your timeline.

    7. Delays and Customer Presence

    Delays may occur due to weather, supply issues, previous project overruns, or unforeseen conditions. We do our best to minimise disruption.

    7.1 If you're not present:

    We can continue the project if:
    We have site access
    Water and electricity are available
    Lock codes or keys have been provided

    If temporary services are needed, costs will be passed to you. We are not liable for issues caused by unsuitable power sources (e.g. extension leads).

    7.2 If delays are caused by the customer:

    Blocked access, missing utilities, or other trades interfering may result in a £95 + VAT/hour charge and rescheduling

    8. Changes to Design or Scope

    Any changes to the agreed design or specification must be confirmed in writing. This may:
    Incur additional charges
    Extend your project timeline
    We reserve the right to pause work until costs and changes are approved.

    9. Material Sourcing

    All materials must be sourced by Bespoke Landscape Designs Ltd or approved suppliers. This ensures:
    Quality and compatibility
    Warranty coverage
    Consistent standards

    9.1 Customer-supplied materials:

    We do not accept materials you supply unless agreed in writing. If used:
    They may void guarantees
    We cannot vouch for their quality or suitability
    Delays due to client-supplied items are not our responsibility.

    10. Insurance and Liability

    We hold full public liability insurance. While we take all reasonable care on site, we are not responsible for:
    Damage caused by existing defects
    Issues with undisclosed underground services
    Consequences of unstable or compromised ground

    11. Waste Removal and Site Clean-Up

    Unless otherwise stated, we will remove and dispose of all project-related waste.
    Skip hire or special disposal will be quoted separately
    Excess soil or rubble not accounted for may incur additional charges

    12. Client Responsibilities During Works

    If your project runs for more than one day:
    Ensure we have access each day
    Alert us promptly to any concerns
    Care for any living materials (e.g. watering turf) unless you’ve arranged a maintenance package

    13. Media and Promotions

    We may take photos and videos of your project for use in:
    Social media (Instagram, TikTok, YouTube, etc.)
    Website case studies and portfolios
    Advertising and print materials
    Educational/promotional content

    Where possible, we will blur or remove identifying details.

    If you do not wish us to use media of your property, please notify us in writing before work begins.

    14. Work Guarantee

    We offer a 12-month workmanship guarantee covering defects caused by our installation.

    14.1 Covered:

    Patio or paving movement due to poor base
    Defective drainage from poor installation
    Structural faults in fencing, decking, etc.
    Mortar-based joint failures

    14.2 Not Covered:

    Wear and tear, weathering, or material discolouration
    Damage by misuse, pets, vehicles, or third parties
    Moss, algae, or weed growth
    Living materials (turf, plants, etc.) due to their care needs

    If damage is caused by external factors or non-approved materials, the guarantee is void.
    Issues must be reported in writing within 12 months.
    If not covered, call-out and repair charges apply.

    This guarantee is in addition to your statutory rights.

    15. Force Majeure

    We are not liable for delays or inability to complete works due to events beyond our control, including:
    Extreme weather
    Supplier failure
    Illness or accidents
    Public health emergencies

    In such cases, we will reschedule works as soon as reasonably possible.

    16. Dispute Resolution

    In the event of a dispute, both parties agree to attempt to resolve the matter informally and in good faith. If a resolution cannot be reached, either party may refer the issue to mediation before pursuing legal action.

    This does not affect your statutory rights.

    17. Governing Law

    These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Scotland, and any disputes shall be subject to the exclusive jurisdiction of the UK courts.

    18. Severability

    If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

    19. Entire Agreement

    These Terms, together with your accepted quotation, constitute the entire agreement between you and Bespoke Landscape Designs Ltd. No other oral or written communications shall modify or override this agreement unless confirmed in writing by the Company.

    Acknowledgment of Terms and Conditions

    By paying the scheduling payment, you confirm that you have received, read, and fully accept the digital copy of Bespoke Landscape Designs Ltd’s Terms and Conditions provided with your quotation. This digital acceptance constitutes a binding agreement.
