The trainee is aware in making this agreement to participate in training that certain elements of this training are physically demanding and potentially dangerous, and with this knowledge agrees to indemnify and hold harmless from all losses caused by accident, injury, or death, the trainer, any assistants, or any third parties who may be enrollees of the same class or seminar or who are students with the trainer, in the event that the trainee or the said third party is injured in any way during the performance and execution of techniques or instruction provided in this training. THE INDEMNITY AND RELEASE OBLIGATIONS CONTAINED HEREIN APPLY TO THE MAXIMUM EXTENT ALLOWED BY LAW EVEN IF THE CLAIMS ARE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OR STRICT LIABILITY OF THE TRAINER OR OTHER IDENTIFIED INDEMNITEES.
This release shall also include any landlord or leaseholder of any training facility in which training is conducted. I also agree that the terms hereof shall serve as a release and assumption of risk for my heirs, executors and administrators, and for all members of my family, including any minors.
The trainee attests that he/she is in good physical condition and has no known or suspected medical conditions that would preclude vigorous physical activity. It is recommended that participants have a checkup by a physician before beginning any new physical regimen.
It is further agreed that the trainee's name, photograph, or other representation for the purposes of promotion or publicity for this program or the trainer may be used without reimbursement, compensation, or notification.
Despite the risks involved, and in consideration of the right to participate in the activities, I, on behalf of myself, my child(ren), my executors, administrators, heirs, successors, assigns and next of kin VOLUNTARILY AGREE TO EXPRESSLY ASSUME ALL RISKS OF INJURY OR DEATH that might be associated with participation in the activities or any use of the facilities and equipment while training or participating in any way, to the greatest extent allowable by law.
In consideration for being permitted to participate in training activities and use the facilities and equipment, I AGREE TO RELEASE FROM ANY LEGAL LIABILITY AND AGREE NEVER TO SUE Safety Skills LLC or Urban Safety Training, its directors, officers, employees, volunteers, attorneys, independent contractors, and agents (collectively referred to as “Safety Skills, LLC” and “Urban Safety Training”), any hosting gym or facilities, it’s directors, officers, employees, volunteers, attorneys, independent contractors, and agents for injury or death resulting from my participation in the activities or use of the facilities, regardless of the cause, to the fullest extent allowed by law, including the alleged NEGLIGENCE of Safety Skills LLC or Urban Safety Training. I further agree to defend, indemnify, and hold harmless Safety Skills LLC and Urban Safety Training for any claims, lawsuits, damages, attorney fees, costs or judgments arising out of my participation in the activities or use of the facilities.
