KOTS 2026 – Participant Disclaimer & Assumption of Risk

By signing this document, I acknowledge, agree, and declare as follows:
1. Binding Effect of Regulations
I confirm that I have read, understood, and agree to be bound by the Supplementary Regulations for this event and all instructions, directions, requirements, and decisions issued by event officials. These obligations form part of the conditions of my entry and participation.
2. Acknowledgement and Acceptance of Risk
I acknowledge that motorcycle competition is inherently dangerous and carries significant risks, including but not limited to:
* Serious personal injury, permanent disability, or death
* Damage to, or total loss of, my property
I acknowledge that risks may arise from track conditions, weather, mechanical failure, collisions, actions or omissions of other participants, officials, volunteers, contractors, or spectators, and the proximity and speed of racing motorcycles.
I voluntarily and knowingly participate in the KOTS 2026 event and fully assume all risks, whether known, unknown, foreseeable, or unforeseeable, to the maximum extent permitted by New Zealand law.
3. Release and Waiver of Liability
To the fullest extent permitted by law, I irrevocably release and waive any right to bring or maintain any claim, demand, or proceeding against the North King Country Motorcycle Club (NKCMCC), its officers, officials, employees, volunteers, contractors, committee members, office holders (past and present), subcommittee members, and agents, arising out of or in connection with:
* Any injury suffered by me; or
* Any damage to or loss of my property,
however caused, including through negligence, error, omission, or breach, except where liability cannot lawfully be excluded under New Zealand law.
4. Indemnity
I agree to indemnify, defend, and hold harmless NKCMCC and its representatives from and against all claims, demands, losses, damages, liabilities, fines, penalties, and costs (including full legal costs on a solicitor‑client basis) arising directly or indirectly from:
* My participation in the event
* My actions, omissions, equipment, or motorcycle
* Any breach of this disclaimer or the Supplementary Regulations
This indemnity survives the completion or termination of the event.
5. Fitness, Medical Condition, and Anti-Doping
I warrant that I am physically and medically fit to participate in motorcycle competition and that no condition exists that may affect my ability to do so safely. I accept full responsibility for monitoring my own physical condition before and during the event.
Furthermore, I acknowledge that I am bound by and subject to Motorcycling New Zealand (MNZ) and Drugfree Sport New Zealand rules regarding anti-doping, and I consent to any alcohol or drug testing that may be required during the event.
6. Insurance
I acknowledge that NKCMCC does not provide personal accident, medical, income protection, or property insurance for participants. I am solely responsible for arranging any insurance cover I consider necessary.
7. Compliance with Officials
I agree to comply immediately and fully with all directions, instructions, and decisions of event officials and the Club committee. I acknowledge that failure to comply may result in exclusion from the event without refund and without liability to the Club.
8. Technical Inspection
I accept that any stripping, inspection, testing, or reassembly of my motorcycle required for technical, compliance, or safety purposes will be undertaken entirely at my own cost and risk. I waive any claim arising from such inspection.
9. Responsibility for Property Damage
For the purposes of this disclaimer, “my property” includes motorcycles, equipment, tools, vehicles, and personal effects owned by me, in my possession, or under my control.
I acknowledge that I am solely responsible for any damage caused by me, my motorcycle, or my equipment to:
* NKCMCC property, facilities, or equipment
* Property of other participants
* Property of spectators
I agree to fully reimburse or compensate the Club or affected persons for all repair, replacement, or associated costs.
10. Privacy & Health and Safety Incident Reporting
* **Privacy:** I consent to NKCMCC collecting, holding, and using the personal information provided in this form for the administration and promotion of this event and motorcycling generally. I acknowledge my rights under the Privacy Act 2020 to access and correct this information.
* **Health and Safety / Accident Reporting:** I acknowledge that in the event of any injury, incident, or near-miss involving myself, details may be recorded for incident-management purposes and, where required, reported to Motorcycling New Zealand (MNZ) or WorkSafe New Zealand under health and safety legislation.
11. Motorcycle Compliance
I warrant that my motorcycle complies with all technical requirements in the Supplementary Regulations and is, to the best of my knowledge, in safe working order and fit for competition.
12. Event Changes
I acknowledge that the event may be delayed, modified, shortened, or cancelled due to weather, safety concerns, or circumstances beyond the Club’s control. I agree that no liability shall arise from such changes.
13. Decisions of Officials
I acknowledge that decisions made by the Club, its committee, and event officials regarding safety, eligibility, scheduling, discipline, protests, and event management involve judgment and discretion. I agree that no liability shall arise from such decisions, except where liability cannot lawfully be excluded.
14. Voluntary Organisation
I acknowledge that NKCMCC is a voluntary organisation and that committee members, officials, and volunteers act in a voluntary capacity. I accept that any guidance or advice provided is general in nature and that I remain solely responsible for my own safety, equipment, and decisions.
15. Participants Under 16
Where the participant is under 16 years of age, this disclaimer must be signed by a parent or legal guardian, who agrees to be bound by its terms and accepts full responsibility for the participant’s involvement.
16. Survival of Terms
This disclaimer and all associated obligations survive the completion, cancellation, or termination of the event.
17. Legal Rights
Nothing in this disclaimer limits or excludes any rights or obligations that cannot lawfully be excluded under New Zealand law, including rights under the Accident Compensation Act 2001.
