Consent to Use Electronic Records and Signatures
Please read this disclosure before you check the box and sign. By checking the box, you agree to the following.
1. Electronic delivery and signature. You agree that Smarter Credit and its affiliates and lending partners ("we," "us") may provide you with this application, and all related notices, disclosures, agreements, authorizations, and other records ("Records") in electronic form, and that you may sign them electronically. Your electronic signature has the same legal effect as a handwritten signature.
2. Scope of your consent. Your consent applies to this Business Funding Application and the Records reasonably related to it. It does not require us to provide any specific Record electronically, and we may still send Records on paper at our option.
3. Your right to a paper copy. You may request a paper copy of any Record at no charge. To request one, email support@smartercredit.com or write to us at the address in your application materials. Requesting a paper copy will not, by itself, withdraw your consent.
4. Your right to withdraw consent. You may withdraw your consent to receive Records electronically at any time before you submit, and going forward, by emailing support@smartercredit.com with the subject "Withdraw E-Sign Consent." Withdrawing consent may delay or prevent processing of your application, because we are unable to complete it without your electronic signature. Withdrawal takes effect only after we have had a reasonable time to act on it and is not retroactive to Records already provided or signed.
5. Keeping your contact information current. It is your responsibility to give us a current, valid email address and to notify us of any change by emailing support@smartercredit.com. We are not responsible for Records not received because your email address was invalid or out of date.
6. Hardware and software you need. To access, view, and retain the Records electronically, you need: (a) a device with internet access; (b) a current version of a common web browser (Chrome, Safari, Edge, or Firefox) that supports 128-bit encryption; (c) the ability to view and save PDF files (e.g., a PDF reader); (d) a valid email account; and (e) sufficient storage to save Records or a printer to print them. If our requirements change in a way that creates a material risk you cannot access or retain Records, we will notify you and give you the right to withdraw consent without fee.
7. Confirming your ability to access. By checking the box below and submitting this application electronically, you confirm that you can access and retain this disclosure and the Records in the electronic form in which they are provided.
8. Retention. We recommend you print or save a copy of this disclosure and each Record for your records.
