FOOTE PARTY RENTALS & EVENTS

Agreement/Jurisdiction

The person(s) whose signature(s) appear on this contract, known as "Renter" "Client" "You" or
"Your", agree that (Foote Party Rentals & Events LLC) Name known as "Provider", "We" or "Our"
shall provide event rental services at clients specified event, time and location. This is a binding
contract which incorporates the entire understanding of the parties, and any modifications must
be in writing, signed by both parties, and physically attached to the original agreement. Client
assumes responsibility for all collection costs and legal fees incurred should enforcement of this
contract is broken. The Parties agree that this Agreement shall be governed by Arkansas law.

Booking
In order to book your event a 25% non- refundable deposit and a signed rental contract is required.
A minimum of two products is required to book Foote Party Rentals & Events LLC for your event
date.

Payments and Cancellation Policy

A non refundable fee of a quarter of the total amount is due at the time of booking; this payment is

non-refundable and must be paid in order to secure your items for your event day. Last three quarters
needs to be paid two weeks before the event day, unless otherwise agreed upon. Payment can be
made via cash, check, cash app (payable to Foote Party Rentals & Events LLC), Apple Pay or credit card. Credit card payment will be taken through wave app and are subject to a 4% processing fee. For
cancellations 60 days before your event will be eligible to 100% of your funds returned. For
cancellations 30 days prior to the event will be eligible to 50% of your funds returned. Anything less
than a 30 day notice will be non refundable. The entire amount of contract is still owed to Foote
Party Rentals & Events LLC. If parties are negligent and fail to cancel in a timely manner. The
Owner may terminate this agreement immediately upon the failure of Renter to make rental
payments when due, or upon Renters filling for protection from creditors in any court of competent
jurisdiction. If the renter needs to reschedule their event, we ask that you notify us a week in advance
to keep your credit and plan your event for a future time.

Liability
Foote Party Rentals & Events LLC promises a high quality service, but is not liable for unforeseen
circumstances, including but not limited to inclement weather, government restrictions,
transportation problems, illness, accidents, labor disputes or strikes, Acts of God, and other causes
beyond reasonable control. A delay in transit shall not constitute grounds for a discount or refund.
We will do our best to be flexible with providing alternatives where such a situation arises. Foote
Party Rentals & Events LLC is not responsible for damage or loss.

Equipment
All rented equipment and decor are the property of Foote Party Rentals & Events LLC and must
remain onsite at the setup space. The Client is responsible for all losses due to theft, vandalism,
misuse or damage of equipment caused by the Client or their guests. In the event the equipment is
damaged, misplaced, stolen, the Client agrees to be billed for the repair or replacement cost of the
item(s).

Travel
A mileage fee will be charged as follows: miles/km ( .63 per mile)Please note the rate is for round
trip. (Milage is normally charged round trip)

Miscellaneous Fees
Costs incurred for travel and delivery of the service are to be paid by the client. That may include but
are not limited to: parking, valet, tolls, etc. All costs will be added to your invoice. Damage waiver 15%,and expedited service fee 10%

Rental Duration
This Agreement begins at stated time and date on the beginning of this agreement and will remain
in full force and effect until the Equipment is returned to the Owner, it is agreed that the Renter
will return the Equipment on the above stated date and time unless the Agreement is terminated
earlier.

Late Returns
If the equipment is returned to the Owner after the date and time that the rental period ends, the
Renter agrees to pay the Owner a charge of $50.00 per each day plus the value of the rental beyond
the end of the rental period, until the Equipment is returned. The Owner is also allowed to subtract
these charges from the security deposit (if applicable). If equipment has not been returned after 5
days of due date,The items will be noted as stolen and you will be charged for replacement of items,
service charge and any other charges that result from the replacing the missing items.

Equipment Care
It is agreed that the Equipment must only be used in a proper and careful manner consistent with
the Owner's instruction and/or as the Equipment was originally designed. Normal wear and tear is
to be expected. 

Flower Wall Care

Please treat our flower walls with care. Please do not lean, climb, sit, or hang on the flower wall, and do not attach decorations, tape, hooks, or adhesives without prior approval. Flower walls may not be moved from the agreed-upon setup location by the client or guests. The renter is responsible for any damage that occurs during the rental period and will be charged for any necessary repair or replacement costs.

Legal Fees
In the event of a dispute resulting in legal action, the successful party will be entitled to its legal
fees, including, but not limited to its attorneys fees, collection fees and the like.

Equipment/Decor Delivery
The equipment shall be delivered to Renter and picked up by Foote Party Rentals & Events LLC at
the above stated date and time, unless otherwise agreed upon. Foote Party Rentals & Events LLC
will inspect equipment before returning to insure there is no damage. All damage costs will be billed
to client.
