Forge Training Centre uses email and text messaging to provide essential membership information, including unexpected gym closures, holiday hours, schedule or class changes, grading and testing information, and other time-sensitive updates.

Membership fees are processed monthly by pre-authorized debit through Rotessa.

Your recurring membership fee will be withdrawn on the same calendar date each month as your membership start date.

If you join partway through the month, your first payment may be prorated based on your start date.

A $35 NSF fee may apply to returned or unsuccessful payments.

JIU-JITSU AND MIXED MARTIAL ARTS IS DANGEROUS

1. Forge Training Centre Inc. is a corporation incorporated pursuant to the laws of the Province of Ontario. Forge Training Centre Inc. shall be referred to in the agreement as “FTC”.

2. The Member hereby agrees to be bound by the terms of this MEMBERSHIP AGREEMENT. The member will be permitted to use FTC’s premises and facilities, and is entitled to receive training and instruction in Mixed Martial Arts or Martial Arts, together with general fitness training (“Mixed Martial Arts, Martial Arts, Jiu-Jitsu”)

3. The Member agrees to remit to FTC, a monthly membership fee, which fee will be posted at FTC premises, which may change, from time to time, and without notice, at the sole discretion of FTC.

4. The Member fully understands that the practice of Mixed Martial Arts or Martial Arts or Jiu-Jitsu, in any form, involves the risk of serious injury and the Member freely and voluntarily assumes any and all risks and hazards inherent in his/her
participation in any programs or training offered by FTC.

5. The member further understands that the practice of mixed Martial Arts, in any form involves greater risk of serious injury than most traditional Martial Arts programs and the Member freely and voluntarily assumes any and all risks and hazards inherent in his/her participation in any programs of training offered by FTC.

6. The Member, him/herself, his/her executors, administrators, dependents and other personal representatives, hereby absolves and indemnifies FTC and all their shareholders agents and employees, as well as other students or persons under
the control of FTC (herein referred to as the “Indemnified”) from all liability howsoever arising for injury or damage (including, but not limited to, the Member’s person, whether fatal or otherwise property and personal belongings) however caused including by the negligence of the indemnified, arising out of, or participating in, Martial Arts or Mixed Martial Arts or in connection with Martial Arts or Mixed Martial Arts or in any way caused by, or arising out of, any activity carries on by the indemnified.

7. The Member warrants that he or she has not at any time been excluded from practice of Martial Arts or Mixed Martial Arts by a medical practitioner or any person or entity including a Martial Arts or Mixed Martial Arts club / training centre.

8. The Member warrants that he/she is not presently receiving treatment for any illness, disorder or injury which would render it unsafe for the member to take part in Mixed Martial Arts or Martial Arts. The Member further warrants that should the Member begin receiving treatment for any illness, disorder or injury which would render it unsafe for the member to take part in Mixed Martial Arts or Martial Arts the Member will immediately notify FTC of same.

9. FTC reserves the right to terminate the Member’s membership at FTC at the sole discretion of FTC.

10. If any provision of this Membership Agreement is held to be illegal, invalid or unenforceable by any competent authority, such as legality, invalidity or unenforceability shall not in any manner affect or render illegal, invalid or unenforceable any other provision of this Membership Agreement.

11. This membership Agreement, together with the Rules appended as Schedule A, shall constitute the entire Agreement between the Purchaser and Vendor. There is no representation, warranty, collateral agreement or condition, whether direct or
collateral or expressed or implied, which induced any part hereto to enter into this Membership Agreement or on which reliance is placed by such a party, or affects this Membership Agreement.

12. Any issues arising from this Membership Agreement or arising out of the Member’s involvement with FTC is to be governed by the laws of the Province of Ontario and the courts of Ontario shall have exclusive jurisdiction to entertain any
action in respect of any of the foregoing issues.

By signing below, I confirm that I am the member named in this form or, if the member is under 18, their parent or legal guardian. I acknowledge that I have read this agreement in full, understand the risks associated with martial arts training, voluntarily assume those risks, and agree to the terms of the Membership Agreement and Liability Waiver.
