Please read this document carefully before signing. By signing this agreement, you acknowledge that you understand its contents and voluntarily agree to all terms.
1. Participant Information
I certify that all information I have provided is accurate and complete. I understand that Wheelie Bad Decisions ("WBD") is relying upon this information in allowing my participation.
2 Acknowledgment of Activity
I acknowledge that I am participating in a powersports training activity operated by: Wheelie Bad Decisions LLC
The activity may include:
- Wheelie training instruction
- Use of a wheelie training machine
- Use of motorcycles or related equipment
- Powersports demonstrations
- Private lessons
- Group events
- Public event activities
I understand that powersports activities involve inherent risks, including but not limited to falls, loss of control, equipment malfunction, collisions, injury, property damage, and other hazards.
3. Assumption of Risk
I voluntarily choose to participate and understand that participation may result in injury, illness, disability, death, or property damage. I knowingly and voluntarily assume all risks associated with participation, including risks arising from:
- My own actions or decisions
- Other participants
- Equipment operation
- Mechanical failure
- Weather conditions
- Uneven surfaces
- Loss of balance or control
- Failure to follow instructions
- Physical exertion
- Unexpected events
I understand that Wheelie Bad Decisions LLC provides a controlled training environment but cannot eliminate all risks associated with powersports activities.
4. Participant Responsibilities
I agree that I will:
- Follow all instructions provided by Wheelie Bad Decisions LLC staff
- Operate equipment only as instructed
- Stop activity immediately if instructed by staff
- Report any unsafe conditions
- Notify staff of any injury or discomfort
- Not participate while impaired by alcohol, drugs, medication, or any substance affecting my ability to safely participate
I understand that unsafe behavior may result in removal from the activity without refund.
5. Health and Fitness Acknowledgement
I confirm that I am physically capable of participating in this activity. I understand that participation requires:
- Physical coordination
- Balance
- Strength
- Reaction ability
- Ability to follow instructions
I agree to notify Wheelie Bad Decisions LLC staff of any condition that may affect my ability to participate safely.
6. Safety Requirements
I acknowledge that protective equipment is required. I agree to use required safety equipment, including:
- Helmet
- Appropriate footwear is mandatory. Participants must wear either ankle-covering boots or closed-toe shoes paired with high ankle socks and pants that fully cover the ankles. Participants with exposed ankles will not be permitted to ride.
- Required protective gear provided or approved by Wheelie Bad Decisions LLC
I understand that failure to use required safety equipment increases risk.
7. Weather & Environmental Conditions
I understand that Wheelie Bad Decisions LLC operates mobile events and outdoor activities. Activities may occur under varying conditions including:
- Heat
- Cold
- Wind
- Rain
- Outdoor environments
I understand that sessions may be modified, delayed, relocated under a canopy/covered area, or canceled when conditions are determined unsafe.
I agree that Wheelie Bad Decisions LLC staff has final authority regarding operational safety decisions.
8. Equipment Use & Inspection
I acknowledge that equipment is inspected and maintained by Wheelie Bad Decisions LLC. However, I understand that mechanical failures or unexpected equipment issues may occur.
I agree to immediately stop activity if:
- Equipment behaves unexpectedly
- I feel unsafe
- Staff directs me to stop
9. Release of Liability
In consideration for being allowed to participate, I voluntarily release, waive, discharge, and agree not to pursue claims against:
Wheelie Bad Decisions LLC
and its:
- Owners
- Members
- Employees
- Contractors
- Instructors
- Agents
- Event partners
- Representatives
For claims arising from participation, including claims related to:
- Personal injury
- Property damage
- Accidents
- Equipment use
- Ordinary negligence
to the fullest extent permitted by law.
10. Media Release
I grant Wheelie Bad Decisions LLC permission to photograph, record, and use images or videos of my participation for:
- Marketing
- Social media
- Advertising
- Promotional materials
I waive any right to compensation related to such use.
11. Indemnification
I agree to indemnify and hold harmless Wheelie Bad Decisions LLC and its representatives from claims, damages, losses, or expenses arising from my participation or actions.
12. Property Responsibility
I understand that I am responsible for my personal property.
Wheelie Bad Decisions LLC is not responsible for:
- Lost items
- Damaged personal property
- Personal equipment
- Vehicles
- Accessories
If any portion of this agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13. Emergency Medical Authorization
In the event of an emergency, I authorize Wheelie Bad Decisions LLC staff to seek appropriate medical assistance.
I understand that I am responsible for medical costs associated with treatment.
14. Governing Law
This agreement shall be governed by the laws of the State of Washington.
15. Acknowledgment
By signing below, I certify that:
- I have carefully read this entire agreement.
- I understand its contents.
- I understand that I am giving up certain legal rights, including the right to sue for claims arising from ordinary negligence.
- I understand the risks associated with motorcycle riding and wheelie training.
- I voluntarily choose to participate.
- I sign this agreement freely and without coercion.
16. Waiver Validity and Continuing Acknowledgement
This Waiver and Release of Liability shall remain valid and in full force for one (1) year from the date of signature and shall apply to all participation in activities, training sessions, events, demonstrations, competitions, private events, and other services provided by Wheelie Bad Decisions during that period.
By signing this Waiver, I acknowledge and agree that its terms apply to each and every visit or participation during the one-year validity period, and I understand that I will not be required to execute a new waiver for each individual session or event unless requested by Wheelie Bad Decisions.
I understand that participation involves inherent risks and that conditions, equipment, locations, activities, and circumstances may vary from one visit or event to another. My decision to participate on any subsequent occasion constitutes my continued acknowledgment and acceptance of the risks, releases, waivers, and other terms contained in this Waiver.
I agree to promptly notify Wheelie Bad Decisions of any material change in my physical condition, ability to participate safely, or other information previously provided that may affect my participation.
Wheelie Bad Decisions reserves the right to require a new or updated waiver at any time, including following changes to its activities, policies, operations, or waiver terms.
Upon expiration of the one-year period, I understand that I may be required to review and execute a new Waiver and Release of Liability before participating in any additional activities.
