By electronically signing this waiver, I acknowledge that I have read, understood, and voluntarily agree to the following terms before participating in the guided South Thompson River Float operated by Okanagan Affordable Rentals.
ASSUMPTION OF RISK
I understand that participating in a guided river float involves inherent risks including strong currents, cold water, changing weather, submerged objects, bridge hazards, collisions, capsizing, equipment failure, wildlife, delayed emergency response, serious injury, drowning, permanent disability, and death. I voluntarily assume these risks.
DESCRIPTION OF ACTIVITY
The activity includes meeting at Riverside Park, transportation to Valleyview Boat Launch, use of rental rafts and equipment, a guided float on the South Thompson River, supervision by one or more safety kayakers, and returning to Riverside Park.
MANDATORY SAFETY RULES
I will follow all written and verbal safety instructions, remain with my group, obey the safety kayaker, report emergencies immediately, and conduct myself responsibly. Failure to comply may result in removal without refund.
MANDATORY SAFETY VIDEO
Before participating I must watch the official Okanagan Affordable Rentals River Safety Video at https://youtu.be/7R7k9uWvhcc. By signing this waiver I confirm I watched the complete video, understand its safety information, had an opportunity to ask questions, and agree to follow all instructions contained in the video and provided by staff.
MANDATORY LIFE JACKET POLICY
A properly fitted life jacket (PFD) must be worn and securely fastened at all times while on the water.
BRIDGE SAFETY
I will stay well away from all bridges, bridge pillars, bridge supports, and bridge abutments. I understand these areas present dangerous currents, turbulence, debris accumulation, and entrapment hazards.
ALCOHOL AND DRUG POLICY
I certify I am not impaired by alcohol, cannabis, illegal drugs, or medication that affects my judgment.
WEATHER AND RIVER CONDITIONS
Trips may be delayed, shortened, rerouted, or cancelled if river or weather conditions become unsafe.
PARTICIPANT RESPONSIBILITIES
I will use reasonable care, respect other river users, protect rental equipment, and report unsafe conditions or damaged equipment immediately.
TRANSPORTATION
I agree to follow all safety instructions while boarding, riding in, and exiting the shuttle vehicle.
EQUIPMENT RESPONSIBILITY
I accept responsibility for equipment issued to me and agree to reimburse Okanagan Affordable Rentals for equipment lost or damaged through negligence or misuse.
MEDICAL FITNESS
I certify I am physically capable of participating and will disclose any medical condition that could affect my safety.
MINIMUM AGE REQUIREMENT
Participants must be at least 12 years of age. Participants under 12 are not permitted. Participants aged 12 to 18 must be accompanied by a parent or legal guardian throughout the activity, and the parent or legal guardian must electronically sign this waiver before participation.
EMERGENCY RESPONSE
Emergency response on a river may be delayed. Rescue by the safety kayaker cannot be guaranteed. I authorize emergency medical treatment if required and accept responsibility for related costs.
RELEASE OF LIABILITY
I release, waive, discharge, and hold harmless Okanagan Affordable Rentals, the City of Kamloops, Tourism Kamloops, and their owners, officers, employees, contractors, volunteers, agents, affiliates, successors, and assigns from claims arising from participation, transportation, equipment use, river conditions, rescue efforts, injury, illness, property damage, or death, to the fullest extent permitted by the laws of British Columbia.
INDEMNIFICATION
I agree to indemnify and hold harmless the released parties from claims or legal expenses arising from my actions or failure to follow safety instructions.
GOVERNING LAW
This agreement is governed by the laws of British Columbia and applicable laws of Canada. If any provision is unenforceable, the remaining provisions remain in effect.
PARTICIPANT DECLARATION
By signing electronically I confirm I have read this waiver, watched the required safety video, understand I am giving up certain legal rights, will wear my life jacket at all times, will stay away from bridges, am not under the influence of alcohol or drugs, and will follow all instructions from Okanagan Affordable Rentals and the safety kayaker.
