SHTEIG AND SURF CAMP LLC CAMPER ENROLLMENT AGREEMENT, RELEASE OF LIABILITY & ASSUMPTION OF RISK.
IMPORTANT: THIS IS A LEGAL DOCUMENT. PLEASE READ CAREFULLY BEFORE SIGNING. BY SIGNING, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
This agreement is entered into by the undersigned parent or legal guardian (“Parent”) on behalf of the minor participant (“Camper”) in connection with participation in Shteig and Surf Camp LLC (“Camp”), including all camp-related activities.
1. CAMP ACTIVITIES
The Camper is permitted to participate in all camp activities, which may include but are not limited to:
Surfing instruction and ocean water activities, swimming, beach games, athletic activities, running and physical training, team sports, walking travel between locations, transportation by vehicle, going out for lunch, special trips, and any other activities organized by Camp staff.
2. ASSUMPTION OF RISK
Parent acknowledges that participation in ocean, beach, and athletic activities involves inherent and unpredictable risks, including but not limited to:
Rip currents, waves, tides, changing ocean conditions, drowning, collisions with people or objects, marine life, weather hazards, sun exposure, dehydration, slips, falls, equipment failure, and injuries resulting from physical exertion or outdoor conditions.
Parent understands that these risks (Has Ve’Shalom) may result in serious injury, illness, permanent disability, or death, and voluntarily assumes all such risks on behalf of the Camper.
3. SWIMMING & HEALTH CERTIFICATION
Parent certifies that:
- Camper is physically and mentally capable of participating in camp activities
- Camper is comfortable swimming in open water
- Camper has no undisclosed medical, behavioral, or physical conditions that would increase risk
- All relevant medical conditions, allergies, medications, or limitations have been fully disclosed to Camp
Parent understands Camp relies on this information in allowing participation.
4. RELEASE OF LIABILITY
Parent, on behalf of Camper and family members, hereby releases and holds harmless Shteig and Surf Camp LLC, its owners, employees, instructors, counselors, lifeguards, volunteers, agents, contractors, and affiliates (including transportation providers and the Borough of Deal where applicable) from any and all claims, liabilities, damages, or causes of action arising out of or related to Camper’s participation in Camp activities, including those arising from ordinary negligence.
This includes injuries, illness, property damage, or death occurring during any Camp-related activity.
5. INDEMNIFICATION
Parent agrees to indemnify and defend Shteig and Surf Camp LLC against any claims, damages, or expenses (including attorney’s fees) arising from Camper’s participation in Camp activities or actions, including claims brought by third parties.
6. TRANSPORTATION AUTHORIZATION
Parent acknowledges and consents to Camper being transported by Camp staff or authorized drivers in vehicles for Camp purposes.
Parent assumes all risks associated with transportation to, from, and during Camp activities.
7. EMERGENCY MEDICAL AUTHORIZATION
In the event of injury or illness, Camp staff are authorized to obtain emergency medical treatment for Camper, including transportation by ambulance if necessary.
Parent accepts full responsibility for all medical expenses incurred.
8. SUPERVISION & CAMP RULES
Camper is required to follow all Camp rules and staff instructions at all times.
Camp provides group supervision; continuous one-on-one supervision is not guaranteed.
Camp reserves the right to dismiss any Camper whose behavior is unsafe, disruptive, or non-compliant with Camp rules, without refund.
9. PERSONAL PROPERTY
Camp is not responsible for lost, stolen, or damaged personal belongings.
10. EQUIPMENT USE & DAMAGE
Parent is responsible for any intentional or reckless damage caused by Camper to Camp equipment or property.
11. SUN SAFETY
Parent acknowledges responsibility for providing sunscreen and ensuring Camper is instructed in its use. Camp staff may remind campers but are not responsible for application.
12. MEDIA RELEASE
Parent grants permission for Camper to be photographed or recorded during Camp activities and authorizes Camp to use such media for promotional, educational, or social media purposes without compensation.
13. REFUND POLICY ACKNOWLEDGMENT
Parent acknowledges and agrees to Camp’s refund and payment policies as provided at enrollment.
14. GOVERNING LAW
This agreement shall be governed by the laws of the State of New Jersey. Any disputes shall be brought exclusively in the courts of Monmouth County, New Jersey, where legally permitted.
15. SEVERABILITY
If any provision of this agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
16. ACKNOWLEDGMENT
Parent confirms that they have read, understood, and voluntarily agree to this agreement. Parent understands they are waiving significant legal rights, including the right to sue, and that this agreement is intended to be broadly interpreted in favor of Shteig and Surf Camp LLC.
