  • Conditions of breeding
  • This Breeding Contract sets out your rights and obligations in breeding to TANGO IN HOLLYWOOD. This Contract is between you(the Owner) and Engleston performance horses 2349 Millwood road ,Coolamon, NSW ,2701 (the Stallion Owner).
  • Your obligations
  • 1.You agree that you have read and understood the terms and conditions of this Breeding Contract and agree to comply with the terms and conditions for the duration of this Breeding Contract.
  • 2.You must provide all relevant and/or requested information as required. This includes the mare's registration papers at the time of booking and any other information, unless otherwise agreed with the stallion owner.

  • TANGO IN HOLLYWOOD

  • 3.You agree to pay the total fees payable, at the times prescribed, and agree that the booking fee is non-refundable.
  • 4.Your mare must be healthy, sound, halter broken, well-mannered and in breeding condition.
  • 5.One form per mare is required to be completed and returned.

  • Collection and use of Semen

  • 6.You agree that all semen collected remains the property of Engleston performance horses until full payment has been received.
  • 7.Semen can be chilled or frozen. You must provide at least: (a) 48 hours notice for chilled semen (B) fresh semen
  • 8.Semen must only be used to breed 1 foal to the mare described in this Breeding Contract and must not be used to breed to another mare or to breed more than one (1) foal.
  • 9.Breeding by embryo transfer using the semen which results in more than 1 foal will incur a breeding fee for each additional foal.
  • 10.The mare owner is responsible for the costs of shipment of chilled semen if applicable and collection fee.
  • 11.The Stallion Owner is not responsible for lost, damaged or delayed shipments.
  • 12.You must advise the Stallion Owner, in writing, of the result of a 14 and 42 day pregnancy scan.
  • 13.Breeding Certificates will not be issued unless the mare is registered and Service Fee is paid in full, unless another agreement is made between the Owner and the Stallion Owner. All breeding certificates will be sent at the end of the breeding season.

  • Payment terms

  • 14.You agree that you will pay the Service Fee of $2,500 payable under this Breeding Contract, as follows: (a) $500- non-refundable booking fee upon signing of this contract (b) $2000- payable prior to the release of any semen.

  • 14.You agree that any transportation costs, veterinary costs and associated costs are not included in the Service Fee.

  • Live Foal Guarantee (LFG)

  • 16.A free return (Live Foal Guarantee) is given with return privilege the following season, subject to conditions.
  • 17.You will be entitled to a return privilege if the foal does not stand up and nurse for 48 hours and suitable evidence, such as an autopsy report, is provided.
  • 18.You must inform the Stallion Owner of the death within one (1) week and provide written evidence from a Licensed Veterinarian confirming the death of the foal and the health of the mare for re-breeding.

  • TANGO IN HOLLYWOOD

  • 19.If the mare is to be returned but you fail to arrange for her re-breeding in the following season, the service fee will be forfeited, and the guarantee will lapse.
  • 20.No guarantee on the return privilege service unless there is prior approval with the stallion owner. The mare owner must pay all costs aside from the Breeding Fee.

  • Liability

  • 22.You understand and agree that the Stallion Owner will not be liable for any loss, damage or injury caused by, connected to or arising from any activity under this Breeding Contract.

  • General

  • 23.In the event of a misunderstanding or a dispute under this Breeding Contract, both parties must attempt to resolve the dispute between themselves. Where there is no resolution, the parties are then entitled to take any relevant action as allowed by law to resolve the misunderstanding or dispute.
  • 24.The law of New South Wales applies to this Breeding Contract
  • 25.This Breeding Contract may be executed by electronic signature which will be considered an original signature and will have the same force and effect as an original signature. An "electronic signature" includes electronically scanned and transmitted versions of an original signature.
