Anticipated Puppy Waiting List Placement Fee Agreement

The Buyer Understands and Agrees That:

1.) The breeder of Hilltop Acres reserves the right of choice when it comes to placing puppies with families to ensure best match based on family lifestyle and potential compatibility of pup.

2.) The total price of a pup is determined by parentage and color/pattern.  In which may vary from litter to litter.

3.) The total price of a pup DOES NOT include transport fees and is per buyer’s expense.  In which may vary depending on services elected by buyer and will be discussed with buyer before the deposit form is accepted. 

4.) A $200 minimum placement fee (holding fee) is required to be placed on the waiting list.  This fee is to secure your place for choice of pup in any future litter here at Hilltop Acres. 

7.) Once puppies are born, families are contacted in the order that placement fees are received and each are given an opportunity to apply their placement fee to reserve a puppy.

8.) If a family agrees to use their placement fee to reserve a puppy, the fee becomes half of the required puppy holding fee.  An additional $200 ($400 total) is required to reserve a puppy until it is 8 weeks old. 

9.) Families may elect to apply their placement fee towards another anticipated litter if a pup of their desire is not born when contacted.

10.) If a family decides not to apply their placement fee towards a pup in the offered litter, the family will remain on the waiting list and will be contacted when the next litter is born and so on. 

**Depending on the number of placement fees that have been recieved, families that decide to wait after being contacted may or may not have same order of choice in a future litter.**

11.) This Holding Agreement is NON-TRANSFERRABLE unless power of attourney can be proven for the person that submits the Agreement. 

The Buyer Understands and Agrees That:

1.) This Holding Agreement will be void with a partial refund within 30 (thirty) days of notification, minus a $75 (seventy-five) fee for our time if a family places a holding fee on a future litter and simply decides that he/she no longer wants a pup from Hilltop Acres.

2.) This Holding Agreement will be void without a refund and further obligations between buyer and the breeder of Hilltop Acres if the buyer drops communication with the seller and he/she is unable to be contacted once a pup of potential interest is born and reaches 2 weeks of age.    

3.) This Holding Agreement will be void with a partial refund within 30 (thirty) days of notification, minus a $100 (one hundred) fee for our time and inconvience if a family places a holding fee on a future litter, a matched desired pup is born, the family declines said pup and then decide that they no longer want a pup from Hilltop Acres.   

4.) Placement fees will be refunded 100 % (one hundred percent) within 30 (thirty) days of notification, if the breeder of Hilltop Acres is unable to offer a pup as desired to buyer within 12 (twelve) months from the date a holding fee has been accepted.

 5.) Placement fees will be refunded 100 % (one hundred percent) within 30 (thirty) days of notification,if in a situation beyond the buyer’s control that he/she can no longer afford or provide the proper care of a anticipated pup due to a life changing event and can provide proof of such with a notarized personal letter, police report, attorney letter, military letter or judicial documents.

6.)  Placement fees will be refunded 100 % (one hundred percent) if in a situation beyond the seller’s control that a desired puppy will not be available to buyer as agreed.  Such as natural disasters, pandemics, majeure events or adverse marketing or trading conditions.

I, the potential buyer, do hereby understand and agree to the Terms and Conditions as stated in this Holding Agreement to reserve a pup from a future litter at Hilltop Acres.  I furthermore understand and agree that once accepted, alterations of this agreement must be placed in writing and can only be made by both myself and the breeder of Hilltop Acres.  
Any disputes with this agreement will be handled in the county of the Sellers residence. State of Arkansas and Ashley County.
