Available Puppy Holding Fee Agreement

The Buyer Understands and Agrees That:

1.) The breeder of Hilltop Acres reserves the right of choice when it comes to placing puppies with families to ensure best match based on family lifestyle and potential compatibility of pup.

2.) Puppies are ready to leave our care at 8 weeks of age. If we feel the puppy is not mature enough to leave our care at that age, we do reserve the right to hold the puppy longer. Please understand that our top priority is to ensure the health and safety of the puppy first.

**Hilltop Acres will not entertain in allowing puppies to leave our care BEFORE 8 weeks of age.  Asking could potentially void this Holding Agreement.**

3.) The total price of a pup DOES NOT include transport fees and is per buyer’s expense.  In which may vary depending on services elected by buyer and will be discussed with buyer before the Holding Fee form is accepted. 

4.) Boarding of reserved pups is available and will be automatically incurred starting at 9 (nine) weeks of age, at $15 (fifteen) per day unless other arrangements have been made between buyer and seller or waiting on transport.

5.) Sales tax in the amount of 6.5 % (six-and one-half percent) will be added to all sales in the state of Arkansas.

6.) A $400 minimum Holding Fee is required to reserve the currently available young/newborn puppy as described above until he/she is 8 weeks old. The remaining balance is due by the time the pup is 7 weeks old ( if being delivered) or at time of scheduled pickup.

7.) The remaining balance is due by the time the pup is 7(seven) weeks old or at time of scheduled personal pickup/ personal breeder delivery.

8.) This Holding Agreement is NON-TRANSFERRABLE unless power of attourney can be proven for the person that submits the Agreement. 

 

The Buyer Understands and Agrees That:

1.) This Holding Agreement will be void with a partial refund within 30 (thirty) days of notification, minus a $200 (two hundred) fee for our time and inconvience if the breeder of Hilltop Acres feels that the potential living environment with the buyer will be unsafe or finds that the buyer falsified information to reserve the puppy.

2.)  This Holding Agreement will be void with a partial refund within 30 (thirty) days of notification, minus a $200 (two hundred) fee for our time and inconvience if a family reserves a puppy and simply decides that he/she no longer wants the puppy.

3.) This Holding Agreement will be void with a partial refund within 30 (thirthy) days, minus a $200 (two hundred) fee for our time and inconvience if the buyer fails to pay the remaining balance of the reserved puppy within 7 (seven) days of scheduled go home date.

**Without prior arrangments between buyer and seller.  This DOES NOT apply to a puppy that is being personally delivered by the breeder or is being personally picked up by the buyer**

4.) This Holding Agreement will be void without a refund and further obligations between buyer and the breeder of Hilltop Acres if the buyer drops communication with the seller and he/she is unable to be contacted once the reserved pup reaches 8 (eight) weeks and 3 (three) days old.  

5.) This Holding Agreement will be void without a refund and further obligations between buyer and the breeder of Hilltop Acres if Buyer fails to meet seller on scheduled day of meeting without notification or pick-up puppy within 5 (five) days of scheduled pick-up date.

6.) Holding fees will be refunded 100 % (one hundred percent) within 30 (thirty) days of notification,  if a reserved puppy becomes extremely ill, expires while in our care or develops/shows symptoms of a congenital defect while in the breeders care. 

**Unless the buyer wants to transfer their holding fee to another available puppy or wait on future pup.  In the case of a future pup, the buyer will be placed at the top of the waiting list.**

7.) Holding fees will be refunded 100 % (one hundred percent) within 30 (thirty) days of notification,if in a situation beyond the buyer’s control that he/she can no longer afford or provide the proper care of a reserved pup due to a life changing event and can provide proof of such with a notarized personal letter, police report, attorney letter, military letter or judicial documents.

8.)  Holding fees will be refunded 100 % (one hundred percent) if in a situation beyond the seller’s control if the reserved puppy will not be available to buyer as agreed. 

9.)  This Holding fees may be transferred to a different puppy than originally reserved if the breeder of Hilltop Acres and the buyer both agree that the current reserved puppy:

a.) would not be a good fit for the family.

b.) expires or becomes extremlely ill.

c)  is less than 6 weeks old and the buyer elects to aquire a different available puppy. 

 

I, the potential buyer, do hereby understand and agree to the Terms and Conditions as stated in this Holding Agreement to reserve a pup that is currently available at Hilltop Acres.  I furthermore understand and agree that once accepted, alterations of this agreement must be placed in writing and can only be made by both myself and the breeder of Hilltop Acres.  
Any disputes with this agreement will be handled in the county of the Sellers residence. State of Arkansas and Ashley County.
