• PUPPY SALES CONTRACT - LIMITED REGISTRATION (PET ONLY)

  • This Agreement is entered into between Ellen Quinn of DeVine Danes and the undersigned Buyer for the puppy described below. This contract governs the sale, health, ownership, and future placement of the puppy produced from DeVine Danes.

  • BUYER INFORMATION

  • PUPPY INFORMATION

  • 1. SELLER OF RECORD & PAYMENT

  • The Seller is the sole seller of record and has received all payments related to this puppy. The Seller alone is responsible for deposits, purchase price, refunds, and all financial transactions with the Buyer.

  • 2. INITIAL HEALTH GUARANTEE (SELLER RESPONSIBILITY)

  • The Seller guarantees that the puppy is in good health and free from visible signs of illness or communicable disease at the time of sale. The Buyer may choose to have the puppy examined by a licensed veterinarian within seventy-two (72) hours of pickup or delivery. If the puppy is determined to be unhealthy due to conditions present prior to sale, the Buyer may return the puppy to the Seller with written veterinary documentation for resolution at the Seller's discretion. If the Buyer chooses to keep the puppy, the Seller is not responsible for veterinary
  • expenses. Failure to complete a veterinary exam within 72 hours voids this portion of the
    guarantee.

  • 3. DEVINE DANES GENETIC HEALTH GUARANTEE (THIRD-PARTY)

  • DeVine Danes provides a two (2) year limited, non-transferable genetic health guarantee
    against life-altering or debilitating inherited genetic defects that significantly affect quality of life.
    Diagnosis must be supported by complete veterinary documentation. DeVine Danes reserves
    the right to request a second veterinary opinion at DeVine Danes' expense. If a covered
    genetic defect is confirmed:
    A replacement puppy of equal value will be provided when available
    No monetary refunds will be issued
    If the Buyer elects to keep the affected puppy, a 50% credit toward a future DeVine Danes
    puppy may be applied (excluding shipping, boarding, or veterinary costs) DeVine Danes is
    not responsible for veterinary expenses incurred after the puppy leaves the Seller's
    possession.

  • 4. CONDITIONS NOT COVERED BY ANY GUARANTEE

  • The puppy is sold as a household companion only. The buyer agrees to provide proper nutrition,
    veterinary care, training, socialization, and humane living conditions.
  • The following conditions are not considered inherited genetic defects and are not covered under
    this contract:
    • Intestinal parasites, coccidia, giardia, or bacterial/viral infections
    • Parvovirus, distemper, coronavirus, mycoplasma, brucellosis
    • Hypoglycemia
    Allergies or allergy-related conditions
    • Cherry eye or other eye conditions
    • Mange (including demodex)
    Panosteitis
    • Hypertrophic Osteodystrophy (HOD)
    Osteochondritis Dissecans (OCD)
    Wobbler's syndrome
    • Addison's disease
    • Pica or nutritional deficiencies
    Bloat (gastric torsion)
    • Vaccine reactions or vaccinosis
    Environmental or stress-related illness
    These conditions may be influenced by nutrition, growth rate, vaccination protocol, environment,
    or stress and are beyond breeder control.

  • 5. BUYER RESPONSIBILITIES

  • Feeding low-quality food (such as Ol' Roy or comparable brands) voids the genetic health
    guarantee.

  • 6. SPAY / NEUTER & BREEDING RESTRICTIONS

  • This puppy is sold on Limited Registration (Pet Only).
    Spay or neuter is required between 18 and 24 months of age, unless medically exempt with
    written veterinary documentation. Early alteration voids the genetic health guarantee. No
    puppy from this litter may be bred without prior written consent from DeVine Danes,
    regardless of ownership or registration status.
    Unauthorized breeding constitutes a material breach of contract.

  • 7. REHOMING, RETURN & RIGHT OF FIRST REFUSAL

  • If the Buyer can no longer keep the puppy at any time during its life, the puppy must not be sold,
    given away, surrendered to a shelter, or placed with a rescue. The breeder/seller must be
    contacted for return.
    DeVine Danes retains the right of first refusal and final authority regarding return or placement
    of the puppy.
    A $5000 fine will apply if a puppy has been rehomed without permission.
    Transportation costs remain the responsibility of the Buyer unless otherwise agreed in writing.

  • 8. ABUSE OR NEGLECT

  • If abuse or neglect is proven by veterinary or legal documentation, the puppy must be returned
    immediately at the Buyer's expense. No refund will be issued.

  • 9. COMMUNICATION & DISPUTES

  • Buyer agrees to contact the Seller directly regarding all concerns. DeVine Danes is not
    responsible for routine buyer communication.
    Buyer agrees not to publicly defame or misrepresent the Seller or DeVine Danes.

  • 10. Governing Law & Venue

  • This Agreement shall be governed by and construed in accordance with the laws of the State in
    which the Seller resides.
    Any legal action, claim, or dispute arising from or relating to this Agreement shall be brought
    exclusively in the courts located within the Seller's county of residence, and the parties
    expressly consent to personal jurisdiction and venue in those courts.
    The Buyer waives any objection to venue or jurisdiction based on inconvenience or any other
    grounds.

  • This contract represents the entire agreement between Buyer and Seller. DeVine Danes'
    involvement is strictly limited to the genetic health guarantee and return provisions stated

  • herein.
