  • Overview

  • The Idaho State Board of Education (IBOE) and the Idaho Department of Education (IDE) have been authorized to waive ESSA statutory requirements for up to five years for Local Educational Agencies (LEAs) requesting related waiver.  The waivers will provide additional opportunities to improve student achievement and reduce administrative burdens. The areas of flexibility are as follows:

     Title I Part A: Section 1127(a)(b) Carryover and Waiver

    Currently, LEAs may carryover up to 15% of their Title I, Part A allocation, into the next fiscal year.  If an LEA has a need to carry over more than 15%, they may request a waiver from the State, but only once every three years.  This waiver allows LEAs to carry over more than the 15% of their Title I, Part A funds every year they are eligible, providing greater flexibility to make long-term, stratgic investments that improve student achievement.

     Title IV Part A: Section 4106 (e)(2)(C), (D), (E) and section 4109(b)

    LEAs receiving $30,000 or more in Title IV, PART A funds must spend at least 20% of their allocation on activities that support Well Rounded Educational Opportunities, at least 20%% on activities that support Safe and Healthy Students, and may spend no more than 15% of their technology funds on technology infrastructure. This waiver allows LEAs to waive these spending requirements, allowing LEAs greater flexibility to invest title funds in the areas that best address local needs while continuing to improve student well-being, school safety, and academic achievement.

  • PUBLIC NOTICE AND COMMENT:

    In accordance with federal requirements, districts applying for an Ed Flex waiver must: (a) provide the public with adequate notice of the proposed waiver, including a description of any improved student performance that is expected to result from the waiver, in a widely read or distributed medium; (b) provide the opportunity for parents, educators, and all other interested members of the community to comment on the proposed waiver; (c) provide the opportunity for the comments to be reviewed by any member of the public; and (d) submit the comments received with the agency's application to the Idaho Department of Education.
