In consideration of my minor child(ren)/ward(s) {1stChild}, {childName40}, {childName41}, {4thChild} (each a “Participant” and, collectively, the “Participants”) being permitted to participate in AKP Sports Foundation’s Back 2 School Festival and related events and activities (the “B2S Festival”), I, {parentguardiansName}, as parent or legal guardian of each Participant named above, acknowledge and agree, on behalf of each Participant, to the following provisions:
1. I acknowledge that participation by each Participant in physical activities at the B2S Festival involves inherent risks. I acknowledge that the risks of temporary or permanent injury and illness (e.g., communicable diseases such as MRSA, influenza, and COVID-19) from the activities involved in this program are significant, including the potential for permanent paralysis and death, and that while particular rules, equipment, and personal discipline may reduce these risks, the risk of serious injury and illness remains. I acknowledge that participation in the B2S Festival involves incidental activities, including travel to and from the site of the B2S Festival, and the possible reckless conduct of other participants.
2. I acknowledge and agree that each Participant will comply with the stated, written, and customary terms and conditions for participation. If I or a Participant observes any unusual, significant hazard during participation in the B2S Festival, I will remove the Participant from the activity and bring the hazard to the attention of the nearest official immediately.
3. I acknowledge that I am solely responsible for all costs related to any potential medical treatment or transportation for any injury sustained by a Participant during participation in the B2S Festival. I knowingly and freely assume all such risks on behalf of each Participant, both known and unknown, even if arising from the ordinary negligence (but not the gross negligence or willful misconduct) of AKP Sports Foundation, including but not limited to its agents, representatives, partners, and employees. I am voluntarily consenting to each Participant’s participation in the B2S Festival with knowledge of the danger involved and hereby agree to accept, on behalf of each Participant, all risks related to personal injury, property damage, or any other harm that may arise in connection with participation in the B2S Festival and related events and activities.
4. I hereby agree, for myself and on behalf of each Participant and our respective heirs, assigns, personal representatives, and next of kin, to release, waive, indemnify, and hold harmless AKP Sports Foundation, its officers, officials, agents, and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (collectively, “Releasees”), from any and all present and future claims, causes of action, losses, or liability for injury, damage to property, illness, disability, or death, whether arising from the ordinary negligence of the Releasees or otherwise, to the fullest extent permitted by law. Nothing in this Agreement releases any Releasee from liability for gross negligence, willful misconduct, or violation of law.
5. I hereby grant AKP Sports Foundation and its affiliated entities a non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and publicly display photographs, videos, or other content depicting each Participant that is captured by or on behalf of AKP Sports Foundation at the B2S Festival, for promotional, marketing, or other lawful purposes related to AKP Sports Foundation. I understand that no compensation will be paid for this use.
6. I acknowledge that this Waiver and Release of Liability Agreement (“Agreement”) contains the entire agreement between the parties and supersedes any prior written or oral agreements between them concerning its subject matter.
7. I acknowledge that this waiver is intended to be as broad and inclusive as permitted under the laws of the State of California. I agree that if any portion of this Agreement is held invalid, the remainder will continue in full force and effect. I agree that the provisions of this Agreement will survive and remain in full force and effect after the B2S Festival ends on August 8, 2026.
8. I authorize AKP Sports Foundation and its officers, officials, agents, and employees to obtain emergency medical treatment for each Participant, including first aid, transportation to a medical facility, and necessary medical procedures, if I cannot be reached in a timely manner during the B2S Festival. I understand that I remain solely responsible for all costs of any such treatment or transportation, as set forth in Paragraph 3 above.
FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)
Parent/Legal Guardian Certification: I certify that I am the parent or legal guardian of each Participant named above and have the legal authority to sign this Agreement on each Participant’s behalf.
